MEMORANDUMOFLAWINSUPPORTOFMOTIONTODISMISS
TheindictmentatbarchargesdefendantWilliamFlanagan,then-SecondDeputyPoliceCommissionerfortheNassauCountyPoliceDepartment,withthreemisdemeanorsandonefelonyinconnectionwithhisallegedroleinthenon-arrestofahighschoolstudentwhohadbeenaccusedofstealingcomputerequipmentfromhishighschool.Severalofthemattersraisedinthemotiontowhichthismemorandumisattachedrequiresomefurtherexplication.Asallegedinthemotion,theindictmentisfaciallydefectiveinthatnoneofthecountseffectivelychargesanoffense,andseveralcountsarevariouslyduplicitousandmultiplicitous.Further,insufficientevidencewasadducedtothegrandjurytosupportaprimafaciecaseastoanyofthechargedcrimes,andnolesserincludedoffensesareavailable.
I.THEINDICTMENTANDAPPLICABLELAW
Theindictmentneedstobeexaminedfromthebottomup.Asnotedindefendant'smovingpapers,CountsFiveandEight-officialmisconductundertwodifferentstatutorytheories-allegenecessarylegalandfactualpredicatesforCountsOneandTwo,conspiracyandreceivingarewardformisconduct,respectively.IftheconductallegedinCountsFiveandEightwasnotcriminalinnature,thenitwasnotcriminalto"conspire"toengageinthatconduct,anditwasnotcriminalunderthe

chargedsectiontoreceivearewardforengaginginthatconduct,evenifallallegedfactsaretrue.Thus,ifFiveandEightarestrickenasinsufficient,CountsOneandTwocannotstand.CountFivechargesOfficialMisconductbynonfeasance,orderelictionofduty,inviolationofNYPL§195.00(2).Thatsectionreads,inrelevantpart:"Apublicservantisguiltyofofficialmisconductwhen,withintenttoobtainabenefit...2.Heknowinglyrefrainsfromperformingadutywhichisimposeduponhimbylaworisclearlyinherentinthenatureofhisoffice."CountFiveallegesinrelevantpartthatthedefendant:...beingapublicservant,withtheintenttoobtainabenefit...knowinglyrefrainedfromperformingadutywhichisimposedupon

bylaworisclearlyinherentinthenatureofhisoffice,towit:defendant,aSuperiorOfficerintheNassauCountyPoliceDepartment,interferedwithafelonyinvestigationtopreventthearrestofthetargetofthatfelonyinvestigationdespitetherebeingprobablecausetoarrestthetargetandacooperativecomplainantwillingtoproceedwithcriminalcharges,inordertobenefitthetarget'sfather,afinancialandpersonalbenefactortomembersoftheNassauCountyPoliceDepartmentincludingthisdefendant.CountEightchargesOfficialMisconductbymalfeasance,inviolationofNYPL§195.00(l).Thatsectionreads,inrelevantpart:Apublicservantisguiltyofofficialmisconductwhen,withintenttoobtainabenefit...Hecommitsanactrelatingtohisofficebutconstitutinganunauthorizedexerciseofhisofficialfunctions,knowingthatsuchactisunauthorized."CountEightallegesinrelevantpartthatthedefendant:...beingapublicservant,withtheintenttoobtainabenefit...committedanactrelatingtohisofficebutconstitutinganunauthorizedexerciseofhisofficialfunctions,knowingthatsuchactisunauthorized,towit:defendant,aSuperiorOfficerintheNassauCountyPoliceDepartment,actingwithothers,directedasubordinatetoreturnrecoveredstolenpropertytoacooperativecomplainantinanopencriminalinvestigationinanefforttojustifythenon-arrestofatarget,whosearrestwouldhaveotherwisebeenwarranted,inordertobenefitthetarget'sfather,afinancialandpersonalbenefactortotheNassauCountyPoliceDepartment.2
 
CountOnechargesConspiracyintheSixthdegree,inviolationofPL105.00.Thatsectionreads,inrelevantpart:"Apersonisguiltyofconspiracyinthesixthdegreewhen,withintentthatconductconstitutingacrimebeperformed,heagreeswithoneormorepersonstoengageinorcausetheperformanceofsuchconduct.CountOnealleges,inrelevantpart:Thedefendants...withintentthatconductconstitutingacrimebeperformed,agreedwithoneormorepersonstoengageinorcausetheperformanceofsuchconduct,towit:eachdefendant,withtheintenttoengageinconductthatconstitutedthecrimeofOfficialMisconduct,agreedwithoneormorepersons,includingthefatherofatargetofafelonyinvestigationwhowasnotamemberoftheNassauCountyPoliceDepartment,toreturnrecoveredstolenpropertytoacooperativecomplainantinanopencriminalinvestigationinanefforttojustifyandensurethenon-arrestofatargetwhosearrestwouldhaveotherwisebeenwarranted,inordertobenefitthetarget'sfather,afinancialandpersonalbenefactorofmembersoftheNassauCountyPoliceDepartment.CountTwochargesReceivingRewardforOfficialMisconductintheSecondDegree,inviolationofPL200.25.NYPL

200.25readsinrelevantpart:"Apublicservantisguiltyofreceivingrewardforofficialmisconductintheseconddegreewhenhesolicits,acceptsoragreestoacceptanybenefitfromanotherpersonforhavingviolatedhisdutyasapublicservant."CountTwoalleges,inrelevantpart,thatthedefendant:...beingapublicservant...solicited,accepted,oragreedtoacceptabenefitfromanotherpersonforhavingviolatedhisdutyasapublicservant,towit:defendant,theSecondDeputyCommissionerofPoliceintheNassauCountyPoliceDepartment,acceptedgiftcardsfromtheparentsofthetargetofanopenfelonypolicecomplaintinvolvingthetheftofelectronicequipmentfromJFKHighSchool.Thesecardsweregiventothedefendantbythetarget'sparentsafterthedefendantdirectedandeffectuatedthereturnofthatstolenpropertywhicheffectivelyendedanyfurtherNassauCountypoliceinvolvementinthiscaseandensuredthenon-arrestofthetarget,despitetherebeingprobablecausetoarrestthetargetandacooperativecomplainantwillingtoproceedwithcriminalcharges.Thetarget'sfatherwasafinancialandpersonalbenefactoroftheNassauCountyPoliceDepartment,includingthisdefendant.
