The Court is requested to pursue more detailedquestioning if a particular juror’s answer reveals that furtherinquiry is appropriate and, in such instance, to conclude with aninquiry as to whether the particular fact or circumstance wouldinfluence the juror in favor of or against either the Governmentor the defendants.A. Introduction1. This is a criminal case. The defendant RAJAT K.GUPTA is charged with federal crimes in an Indictment filed by agrand jury sitting in this District. The indictment is notevidence. It simply contains the charges that the Government isrequired to prove to the satisfaction of the jury beyond areasonable doubt. I would now like to summarize the charges inthis case in order to determine whether there is anything about

the nature of this case that may make it difficult orinappropriate for any of you to serve on the jury.2. The Indictment contains a total of six counts.You will hear a lot more about these charges in the coming days,but let me now provide you with a brief summary of theallegations in this case.Count One of the Indictment charges that RAJAT K. GUPTAconspired to violate the federal law that makes it unlawful tocommit securities fraud. More specifically, Count One chargesthat RAJAT K. GUPTA joined in an agreement or understanding withRaj Rajaratnam and others to disclose material, nonpublicinformation, referred to as Inside Information, about GoldmanSachs, Procter & Gamble, and the J.M. Smucker Company, inviolation of GUPTA’s duties of trust and confidence.Counts Two through Six of the Indictment charge thatRAJAT K. GUPTA committed securities fraud by disclosing InsideInformation to Raj Rajaratnam and others who then traded orcaused others to trade securities on the basis of the InsideInformation.3.Does any juror have any personal knowledge of thecharges in the Indictment in this case?
