2.AsaSpecialAgent,Iconductofficialcriminalinvestigations,primarilyinvolving
passportandvisa-relatedimmigrationfraudandidentifytheftcrimes.
3.Thisaffidavitissubmittedinsupportofacriminalcomplaintandarrestwarrant
forQuanAnhNGUYEN,andisbasedoninformationobtainedthroughpersonalobservation,statements
of
witnesses,informationsuppliedtomebyotherlawenforcementofficers,and

informationobtainedthroughtheuseoflawenforcementcomputerizeddatabases.4.Thisaffidavitcontainsinformationnecessarytosupportprobablecauseforthis
criminalcomplaint
and
arrest
warrant.This
affidavit
isnot
intended
to
includeeach
and
every
factandmatterobservedbymeorknowntothegovernment.
5.TheImmigrationandNationalityAct(INA)establishesthetypes
of
visas
available
for
travel
tothe
UnitedStates
and
whatconditions
mustbemet
before
an
applicant
canbe
issued
a
particular
classificationof
visa.
Pursuant
tothe
INA,
a
foreignnationaldesiring
to
entertheUnitedStatestemporarilyforbusiness(B-l)orforpleasure,tourismormedicaltreatment(B-2)mayapplyforanon-immigrantvisitorvisaataU.S.EmbassyorConsulate.
Thesevisitorvisasarecollectivelyknownas
B1/B2
visasandcanbeobtainedonlythroughan
applicationandanoralinterviewwithaU.S.DOSOfficerataU.S.EmbassyorConsulate.6.TheINAalsoestablishesvisaineligibilitiesthatmakeavisaapplicantineligible
foravisaincertainsituations.Inaddition,theINAcontainsprovisionsforcertainineligible
applicantstoapplyforwaivers
of
theirineligibility.TheINA,inpart,statesthegrounds
of
ineligibilityfornon-immigrantvisastoincludeapriorconvictionforacrimeinvolving
moral
turpitude
(CIMT).
Additionally,withlimitedexceptions,allvisaapplicantsarepresumedtobe
immigrants
("intendingimmigrants")
unless
and
until
theysatisfytheconsularofficerthatthey
qualifyforoneofthenonimmigrantvisacategoriesdefinedinINAsection
101(a)(15).
