I.INTRODUCTION
Format and Scope of This Concept Paper
This concept paper will deal with the issue of prosecution of piracy occuring beyond territorialwaters of states or more familiarly known as piracy jure gentium,in particular the apparent lack of it. Toward this end, this concept paper will be divided into three parts literature reviews. In the first part, this paper will review literature on jurisdiction of states to try the crime of piracy juregentium, keeping in mind that in many jurisdictions there are two types of piracy i.e. piracy juregentium and the offence of piracy as laid down by municipal (state) law. In the second part, this paper identifies the problem and lacunae in the current situation with regard to the issue of piracy jure gentium prosecution. Finally in the third part, this paper will review literature on the specificrecommendation to fill in this lacunae, in particular the role undertaken by the United Nationsthrough the Security Council.

leistes
and
 peirates
.
 Leistes
is derived from the Greek word
leis
which in turn originate from the Indo-3
