TheLosAngelesUnifiedSchoolDistrictiscommittedtomaintaininga
workingand
learningenvironmentthatisfreefromsexualharassment.Sexualharassmentoforbyemployees,students,orpersonsdoingbusinessfortheDistrict,isa
form
ofsexdiscrimination
in
thatitconstitutesdifferentialtreatmenton-thebasis
of
sex,oractualorperceivedsexualorientationorgender.
As
'such,itisaviolationofstateandfederallawsandaviolationofthispolicy.TheDistrictconsiderssexualharassmentto
be
amajoroffense,whichcanresultindisciplinaryactiontotheoffendingemployeeincludingbutnotlimitedtotermination.AnyemployeeoftheDistrictwhobelievesthatshe
or
hehasbeena
target
ofsexualharassmentshallbring
the
problemtotheattentionofthesite.administratorordesigneesothatappropriateactionmaybetakentoresolvetheproblem.Complaints.willbepromptlyinvestigatedinawaythatrespectstheprivacyofthepartiesconcerned.TheDistrictprohibits-retaliatorybehavioragainstanyonewhofiles
a
sexualharassmentcomplaintoranyparticipant
in
the
complaintinvestigationprocess.Thisbulletinreplaces
BUL-1893.0.
Thisrevisioncontainsupdatedinformationregardingtherelatedresourceslisted.Thisrevisionalsoreflectscurrentstateandfederalrequirementsandprovidesguidanceandproceduresforinvestigatingemployeetoemployeecomplaintsofsexualharassment..

birth.
Sexshallmeanthebiologicalconditionorqualityofbeing
a
femaleormalehumanbeing.Sexualorientationshallmeanactualorperceivedheterosexuality,homosexuality,orbisexuality.

SexualHarassment:Sexualharassmentmayinclude,butisnotnecessarilylimitedto,

theuseofsuggestive,derogatory,orvulgarcomments;theuseofsexualinnuendoorslurs;makingunwantedsexualadvances,invitations,orcomments;pesteringfordates;makingthreats;and/orspreadingrumorsaboutorratingothersastotheirsexualactivityorperformance,Visual-unwelcomeconductsuchasthedisplayofsexuallysuggestiveobjects,pictures,posters,writtenmaterial,cartoons,ordrawings;theuseof
graffiti

anannualbasisatthebeginningoftheschoolyear.Notification-Posting:AcopyoftheDistrict'ssexualharassmentpolicypostershallbedisplayedinaprominentlocationinthemainadministrativebuildingorotherareaofthecampusorschoolsite."Prominentlocation"meansthatlocationwherenoticesregardingrules,regulations,procedures,andstandardsofconductareposted.The"TitleVIIComplaintManager"posters,inbothEnglishandSpanish,areattachedtothisBulletinandaretobeusedtoidentifythoseschoolsiteadministratorsdesignatedtohandlesexualharassment(andsexdiscrimination)complaints.-
Notification-Publishing:
AcopyoftheDistrict's"SexualHarassmentPolicy"one-pagesummary,whichisattachedtothisBulletin,shallbeincluded
in
anyschoolorDIstrictpublication(e.g.,LocalSchoolFacultyorHandbook)thatsetsforththeschool'sortheDistrict'scomprehensiverules,regulations,procedures,andstandardsofconduet.
ResponsibilityforImplementationofPolicy:
AdministratorsEachAdministratorshouldensurethat:Employeesreceiveinformationonanannualbasisrelatedtosexualharassment.(Seeone-pagesummaryattachedtothisbulletin.)Employeesshall:CooperatewiththeDistrict'seffortstoeliminateandpreventsexualharassment.EncourageanyoneallegingthatheorsheisatargetofsexualharassmenttoBUL-1893.1OfficeoftheGeneralCounselPage3of13August1,.2005
