filed
intheThirdDepartmentalleging
that
respondentengagedinconductprejudicial
to
the
administrationof
justicewhenhisofficereleasedapublicstatementcriticizingthedecisionofajudgeinapendingcriminalmatter.Respondentfiled
an
answer
admitting
thematerialallegations
of
thepetitionandassertingcertainlegaldefenses.ThematterwassUbsequentlytransferredtothisCourt
by
orderoftheThirdDepartment

entered
May
20,2011.Followingthattransfer,the
parties
wereaffordedanopportunitytofilewiththisCourtpapersaddressinganyoutstandinglege1issues,andrespondentthereafter.appearedbeforethiscourtand

mattersinmitigation.Respondentadmitsthat,in2006,
his
officecommenced
an
investigation
of
theallegedillegalsaleof
pce
sc.rLpti.onmedicinetoAlbanyCounty
residents
bycerta1nindividuals
who
wereoperatingapharmacylocatedinFlorida.Withrespecttothatmatter,a
series
offiveindictmentswashandeddown
by
anAlbanyCountygrandjury.InSeptember
2008,
afterthefourthindictmentwasdismis~edandrespondent'sofficewasgrantedleave
tore-present
the
dismissed
indictment,certainofthedefendantsinthecriminalproceedingfiledinFloridaacivilaction
agaj.nst
respondentandamemberofhisstaff.aswellas
theAlbany
CountyDistrictAttorney'sOffice,asserting
claims
forunlawfularrest,unlawfulconsp1racy,defamationandintentionalinfliction
of
emotional
distress.The
civilclaimswere
based
on
a,lleged
wrongfulconductcommitted
by
respondentandhisofficeinprosecutingtheAlbanyCountycriminalmatter.InJune
2010,
the
federal
district
court
presiding
over
theFloridacivilaction
determineda
motionforsummaryjudgmentfiled
by
respondentandtheotherAlbanyCounty
defendants,
denyingthemotionwithrespecttovirtuallyalloftheclaimspendingagainsttheminthataction.OnNovember
15,
2010,AlbanyCountyCourt(Herrick,
J.)
dismissedthefifthindictmentinthe
criminal
proceedinganddisqualifiedrespondent'sofficefromfurtherprosecutingthatmatterbasedonaconflictofinterestaris1ngfromthefederal
civil
actionpendinginFlorida.Indisqualifyingrespondent'soffice,JudgeHerricknotedthatthefederalcivilclaimsin
Florida.had
survived
a
mctionfor
summary
judgmentandthatrespondentandhisofficethereforehada"personal.professionalandfinancialstakeintheoutcomeofboththecivilandcriminalcases."Pursuant;toCountyLaw
