forunlawfularrest,unlawfulconsp1racy,defamationandintentionalinfliction
of
emotional
distress.The
civilclaimswere
based
on
a,lleged
wrongfulconductcommitted
by
respondentandhisofficeinprosecutingtheAlbanyCountycriminalmatter.InJune
2010,
the
federal
district
court
presiding
over
theFloridacivilaction
determineda
motionforsummaryjudgmentfiled
by
respondentandtheotherAlbanyCounty
defendants,
denyingthemotionwithrespecttovirtuallyalloftheclaimspendingagainsttheminthataction.OnNovember
15,
2010,AlbanyCountyCourt(Herrick,
J.)
dismissedthefifthindictmentinthe
criminal
proceedinganddisqualifiedrespondent'sofficefromfurtherprosecutingthatmatterbasedonaconflictofinterestaris1ngfromthefederal
civil
