1983,andtheConstitutionandlawsoftheStateofNewYork.PlaintiffsweredeprivedoftheirfederalandstateconstitutionalandNewYorkStatecommonlawrightswhenpoliceofficersoftheNewYorkPoliceDepartment("NYPD")andemployeesoftheNewYorkCityDepartmentofSanitation("DSNY')(together"CityDepartments"),actingpursuanttoapolicyandontheauthorityofNewYorkCityMayorMichaelBloombergandunderthedirectionofCommissionersRaymondKellyandJohnDoherty,conductedasurprisenighttimeraidofZuccottiPark,a.k.a."LibertyPark"(the"Park").2.
As
partoftheraid,theCityDepartmentsseizedandretainedpossessionofpersonalpropertybelonging
to
OWS,includingatleastapproximately3,600booksfromOWS'sPeople'sLibrary("People'sLibrary"orthe"Library"),aswellasvariouslibraryfurnishings,computers,andotherelectronicequipment("Libraryfurnishingsandequipment").Only1,003oftheatleastapproximately3,600booksthatwereseizedwererecovered;moreover,oftherecoveredbooks,201weresodamagedwhileinthepossessionoftheCityofNewYorkthattheyweremadeunusable.Thus,atleastapproximately2,798bookswereneverreturnedorweredamagedandmadeunusable.AlmostallofthelibraryfurnishingsandequipmentthatwereseizedbyDefendantswerenotreturnedorreturnedinanunusablecondition.Tothisday,OWShasnotbeentoldbytheCityofNewYorkwhathappenedtothemissingbooksandlibraryfurnishingsandequipment.Uponinformationandbelief,themissingbooksweredestroyedaspartoftheraid.Uponinformationandbelief,theraidwasauthorizedbyMayorBloombergandexecutedbyJohnDoeandRichardRoeandotherspresentlyunknowntoPlaintiffs("JohnDoeandRichardRoe
etal.")
intheircapacityasofficials,employeesandloragentsoftheCityDepartments,exceptfortheconductrelatedtoPlaintiffs'requestforpunitivedamagesasmoreparticularlysetforthbelow.
