Detective David Ramirez, shield 7183 of the Missing Persons Squad, states as follows: At the time and places described below in the County and State of New York, the Defendant committed the offenses of: 1. PL125.25(1) Murder in the Second Degree (1 count )

the defendant, with intent to cause the death of another person, caused the death of such person and of a third person. The offenses were committed under the following circumstances: Deponent states that he is informed by defendant that defendant strangled Etan Patz and placed him inside a plastic bag, thereby causing the death of Etan Patz, on or about May 25, 1979 in the basement of 448 West Broadway. Deponent further states that based upon his interviews of several individuals whose identities are known to the District Attorney's Office and his review of the case files of the New York City Police Department and the Federal Bureau of Investigation that on May 25, 1979, Etan Patz, who was six years old, left his parents' home to go to his school bus stop and never arrived at school, never returned home, and has never been seen since May 25, 1979.
