LordSteynconcludedhisjudgmentasfollows:"InLawcontextiseverything."Thiscasedealswithwhetherornot,withinthecontextofextraditionproceedingsandtherecordofthecaseevidencepresentationprocesstheapplicants,KimDotcomandhisassociates,areentitledtodisclosureofinformationheldbytheprosecutingauthoritiesbeitofageneralorarestrictednature.[2]MrDotcomthroughMrDavisonandhisassociatesthroughMrFoleyarguethatthecontextdemandsit.MrRuffinfortheUnitedStatesarguesthatthecontextinthisparticularcase,intheabsenceofanyidentifiedjusticiableissue,meansthatdisclosureisnotavailable.[3]Myconclusionisthatdisclosureisavailabletoalimitedextent.Thatdisclosureiscompletelycompatiblewiththecontextofextraditionproceedingandtheutilisationoftherecordofthecaseprocedureandinparticularwithinthecontextandfactualcircumstancesofthiscase.Myreasonsfollowandmydecisionisstructuredinthisway.[4]Icommencebyidentifyingtheissueandgivesomeofthebackgroundtothiscase.IthenidentifywhatitisthatissoughtbytheapplicantsandsummarisetheargumentsadvancedbyMrDavisonandMrFoley,followedbyasummaryoftheargumentsadvancedbyMrRuffin.Ithenmovetoadiscussionofthemattersarguedinthecontextofthelawandtheissuestobedecided.Istartwithaconsiderationoftheextraditionprocess,discusstherecordofthecase(ROC)processandconsiderthepowersoftheCourt,especiallywithinthecontextofcommittalproceedingsandwhetheranoralevidenceapplicationneedstobemadeinextraditionproceedings.IthenconsiderthenatureofthedecisiontobemadeinextraditioncasesandwhetherornottheprovisionsoftheNewZealandBillofRightsAct1990(NZBORA)areengaged.Ithenmovedtotheprincipalissue-thatofwhetherdisclosureisavailableasagainstthecontextualbackgrounddiscussed,considerthescopeofdisclosureandthenidentifythedisclosurethatshouldbemade.
