Phase two consultation Statement of community consultation
Have your say on our revised plans for the proposed Thames Tunnel
Every year enough untreated sewage to fill the Royal Albert Hall 450 times enters the River Thames. We need the Thames Tunnel to address this problem.

Our statement of community consultation

The Thames Tunnel is needed to capture discharges from combined sewer overflows (CSOs) into the River Thames. Untreated sewage, which currently flows directly into the River Thames from the CSOs, would be captured and stored in the main tunnel and the tunnels that connect the CSOs to the main tunnel before being transferred for treatment. The reduction in untreated combined sewage entering the River Thames would bring long-term benefits for the environment and users of the river. The main tunnel would start at Acton Storm Tanks in west London, where it is at a depth of approximately 30m and end at Abbey Mills Pumping Station in east London at a depth of up to 70m. It would be approximately 25km long and have an internal diameter of 7.2m. Once flows have been transported to Abbey Mills Pumping Station, they would be transferred to Beckton Sewage Treatment Works via the Lee Tunnel. This is a major engineering project and during construction our works could have the potential to affect amenity in the area surrounding some of our sites. These effects will be reduced as far as possible and will not be permanent. Permanent above ground structures would also be required at these locations to operate the Thames Tunnel. This Statement of community consultation (SOCC) sets out how we intend to consult members of the public and local communities in the vicinity of the project. It supersedes the SOCC published in September 2010. We have produced a Community consultation strategy (CCS), available at our website, in association with our SOCC, which details our commitment to consult on the project in more detail. On 16 November 2010, the Secretary of State for Environment, Food and Rural Affairs made a written ministerial statement to Parliament that she intends to bring the project within the scope of the Planning Act 2008. This intention is reflected in the draft National Policy Statement for Waste Water, which was published in autumn 2010 and Defras recent consultation on including proposed major wastewater transfer and storage infrastructure projects within the scope of the Planning Act 2008 through amendments to sections 14 and 29 of that Act. The proposed changes would mean that the Thames Tunnel would be considered within this regime; and the application would be examined by the Infrastructure Planning Commission, or its successor. As a result, we are undertaking our pre-application consultation consistent with the requirements of the Planning Act 2008. This document meets the requirements of section 47(1) of the Planning Act 2008, which states that the applicant must prepare a statement setting out how the applicant proposes to consult, about the proposed application, people living in the vicinity of the land. We are completing an Environmental Impact Assessment (EIA) of the project. The EIA will investigate and record the effects of the project on the environment, and help us ensure that the project is sustainable and minimises effects on the environment and amenity. We will publish our Preliminary environmental information report as part of our phase two consultation and invite comments on the environmental and amenity effects of the project that it identifies. Our application will be accompanied by a full environmental statement reporting the findings of our EIA.

We will publicise our proposed application under section 48 of the Planning Act 2008 in summer 2012. A period of six weeks will be allowed for receipt of comments on the proposed application.
What we will consult on
The overriding aim of our pre-application public consultations on the project is to ensure that local communities we consult have a chance to understand and influence our proposals. During phase two consultation, we will ask for comment on: the need for the project including whether a tunnel is the most appropriate solution our preferred tunnel route including detailed alignment of the tunnel our preferred sites for the construction and permanent works the detailed proposals for our preferred sites, which take into account the results of our phase one consultation and further, more detailed, technical work undertaken the effects of the project as reported in our Preliminary environmental information report. When we undertake section 48 publicity, we will publicise our proposed application in accordance with the requirements of the Planning Act 2008 and the Infrastructure Planning (Applications: Prescribed Forms and Procedures) Regulations 2009.
Who we will consult
For phase two consultation we will consult technical consultees, landowners, significantly affected persons and the community including the general public, people living in the vicinity of the project, local businesses and community representatives and groups, including hard-to-reach groups. We will send letters to those living at least 250m from the boundary of each site and within a broad corridor along the tunnel route; the boundary will be applied flexibly according to the scale and nature of the proposed works and taking into account the characteristics of the surrounding area. Additionally we will advertise the exhibitions in the local press and public buildings close to sites and where possible we will display site notices and posters locally. When we undertake section 48 publicity we will publicise our application in the prescribed manner, including placing a formal notice in specified newspapers.

We will provide clear and concise public information about the project throughout the consultation process as set out in the table below. Feedback
When we will consult
We undertook our phase one consultation between 13 September 2010 and 14 January 2011. Our phase two consultation commences on 4 November 2011 and ends on 10 February 2012, lasting 14 weeks. We may need to amend our scheme after the commencement of our phase two consultation. Should this be necessary, we would consider on a site by site basis whether our changes would affect the nature of the comments received from the public at phase two consultation, and where appropriate undertake further targeted consultation. This would comprise public exhibitions and provision of project information, and would be for a period of not less
Our preferred method for receiving comments is via our website but we will also provide paper feedback forms at our public exhibitions and on request. We are legally required to have regard to all the responses we receive through phase two consultation and section 48 publicity. A report on phase two consultation will be produced and published on our website, which will give details of responses to the formal consultation and explain how we have taken them into account in developing our proposals. The reports on phase one and phase two consultations will form the basis of the consultation report that we must submit in support of our application.

Setting the land referencing limits

The limits of the land referencing area are determined by the statutory requirements for consultation and ultimately notice of the DCO application and incorporate the following criteria. Any land or property: within the tunnel and settlement/nuisance zone limits within the shortlisted surface sites limits considered to be an in river structure abutting the tunnel and settlement/nuisance zone limits fronting a public road where the half width of public road falls within limits within a buffer of 100 metres surrounding a shortlisted site within the sites and nuisance zones required for substantial alteration to the road network.

The criteria will be expanded to include additional sites when known required for replacement open space or collateral purposes needed for e.g. flood compensation.

Desktop activities
HM Land Registry (HMLR) activities
Land Registry data is ordered for the extents of the land referencing limits and placed on Property Watch to capture any changes that may occur to the data prior to submission of the application. The Land Registry data is received in the form of a shapefile and digital copies of the Registers and Plans. This data is interrogated to establish any freehold, leasehold, mortgagee, other charges and restrictive covenant information. The information gathered is stored within webPERCS, the land referencing database. From this data the landownership parcels can be created and updated through further enquiries. The parcel boundaries are drawn to reflect unique ownership information and are stored spatially within a GIS database.

Major land owners

1.2.4 Land interest information is requested from major landowners (including local authorities). Requests to local authorities also include authorisation to access the electoral roll for large areas; access to the Councils land terrier mapping; information about public highways and private roads; information about special category land; e.g. sites of special scientific
interest, areas of outstanding natural beauty, public open spaces, common land, public allotments, parks and recreation areas etc; information about statutory undertakers (e.g. gas, water, electricity, media service providers); Information relating to extant planning permissions which may alter the ownership details of a land parcel and future public and privately funded developments. 1.2.5 Additional desktop activities are undertaken to confirm information received through site enquiries and the Land Registry. Companies House searches are undertaken to ensure registered companies details are correct and the registered office address is used for service of notices. Quick Address Search (QAS) is carried out for all interests to verify other interests and to confirm details for those identified elsewhere.

Site Referencing
Non-contact site visits
Non-contact site visits are undertaken to identify potentially complicated sites and to write descriptions for entry into the referencing database (webPERCS) in preparation for the interested party information. This aids in the checking process and will form the basis for the property descriptions for the Book of Reference. In addition the OS mapping information is checked against what the site actually consists of. Any discrepancies are noted and amended in the land ownership parcels.
Contact site visits

1.3.2 Contact site visits are undertaken to identify the occupation details for a property in addition to confirming details which may have been gathered through Land Registry checks and for other unregistered land and property. The site team complete a Land Information Questionnaire (LIQ) with the occupier of the property to establish all additional interest information. Should no response be gained at the property an LIQ is left for the occupants to complete and return by post. If no response is received the property will be visited a further 2 times to attempt to gather the required information,

Postal LIQs
1.3.4 In some circumstances, when the Land Registry data has been fully interpreted, LIQs will be posted in advance prior to contact site visits taking place. Included with the questionnaire will be individual plans showing the anticipated land ownership boundary. Respondents are asked to complete the questionnaire and amend the boundary plan illustrating any modifications required and return the complete package to the project team. The land referencing team will analyse this return information and conduct follow up enquires when necessary.

Data Management
webPERCS
All correspondence with potentially affected parties is uploaded into the referencing database. This includes Land Interest Questionnaires (by post and completed via one-one interview), telephone enquiries and follow-up letters. In order to ensure diligent inquiry has been carried out the dates and times of all site visits are recorded. The Land Registry titles and plans along with the LIQs and other supporting data are uploaded against the parcel and interest information to not only show a detailed history of the investigation but to provide easily available source information for all land and property. All formal notices and postal lists are also uploaded onto webPERCS and. Each notice is linked to the individual interests.

We would like to let you know about our plans for the construction of the Thames Tunnel. This major project is urgently needed to help tackle the 39 million tonnes of untreated sewage which overflows into the River Thames in an average year, when Londons Victorian sewerage system becomes overloaded after rainfall. During our first phase of public consultation on the project, 13 September 2010 14 January 2011, we asked for your comments on our proposed routes and sites. We have been listening to the feedback and we have made some important and significant changes to our plans. This has resulted in a refined and redesigned scheme. We are about to commence our second phase of consultation on the project. We will be consulting local planning authorities, statutory consultees, members of the public and landowners with an interest in the land over and through which the project will be constructed or who may be affected by construction or operation of the tunnel. We expect to submit our application for consent in late 2012 and to start construction of the scheme in 2016. We are consulting all those who live close to a construction site or the proposed tunnel and we would like you to find out more about how the Thames Tunnel may affect you, taking into account the changes to the project since phase one consultation. We do not need to acquire any part of your property. This is a major construction project and depending on where you live or work, you need to understand what we are planning to do and how it may affect you. We are committed to an inclusive and meaningful pre-application consultation with the community, technical consultees and landowners. In accordance to our revised Statement of community consultation, site notices were displayed to publicise our Phase two consultation and to provide details of our proposals and local public exhibition dates for each of our preferred sites. Notices were also displayed as part of our land referencing process where it had not been possible to establish details of persons having a significant interest in land that may be affected by our proposals. Information on the content and locations of our notices displayed for the duration of our Phase two consultation is provided within the report and accompanying appendices.

Introduction
Our Community consultation strategy (CCS) states the need to consult with the community, technical consultees and landowners during our preapplication process. This is to ensure these groups are informed of our proposals for the Thames Tunnel and have the opportunity to influence the scheme. Following feedback received during Phase one consultation, we wanted to improve the coverage of publicity for our proposals. We are committed to an inclusive and meaningful consultation process as well as responding to feedback. Consequently, in addition to the wide range of methods used to publicise our proposals during Phase one consultation, for Phase two consultation we also displayed site notices within the immediate vicinity of the proposed preferred sites. The report also accounts for the provision of notices for land referencing purposes where we had not been able to identify ownership details of land that might be affected by our proposals. The purpose of this report is to document the process for displaying notices publicising our Phase two consultation proposals, accounting for the location of each notice and date erected. The report stands as a record of how we have approached the provision of site and land referencing notices and should be read in conjunction with the Phase two consultation report and Section 37 report.

Site notices
Our Statement of community consultation (SOCC) sets out how we intend to consult members of the public and local communities in the vicinity of the Thames Tunnel project. The original SOCC was published on 16th September 2010 at the start of our Phase one consultation, and a revised version was published on 4th November 2011 for Phase two consultation. Both SOCC versions were consulted on with the relevant local authorities and other stakeholders before publication. As the provision of site notices is not a statutory requirement under the Planning Act 2008, our original SOCC did not include proposals to display

Site notices site notices as part of our Phase one consultation. In response to feedback received to improve the coverage of publicity of our proposals, our revised SOCC for Phase two consultation states that where possible we will display site notices and posters locally to the affected site in order to publicise our proposals. In addition, we recognise that at some sites the catchment area of those that may be affected or interested in our proposals extends beyond those living in the vicinity of the site, such as users of parks and other open spaces. The provision of site notices close to or on the curtilage of the preferred site, therefore, allows as many people as possible to be aware of our proposals and respond to Phase two consultation.

Land referencing notices

In accordance with Section 44 of the Planning Act 2008, we have a statutory duty to consult with all persons having a significant interest in land that may be affected by our proposals. This requirement is reflected within our CCS, which states that for Phase two consultation, a comprehensive land referencing had been carried out of all property interests within 100m of our preferred sites as well as property interests that lie above and in the vicinity of the preferred tunnel route. Where it had not been possible to obtain land interest details through our land referencing procedures, which included obtaining Land Registry data and site visits, notices were erected in relation to the parcels of land where land interest details were unknown. Whilst the provision of notices for land referencing purposes is not a statutory requirement, they were erected in order to ensure every reasonable and practical measure possible had been employed to identify all land interests we may affect, as required under the Planning Act 2008.

Notice content
Each notice displayed information of our proposals for the corresponding nearby site. Information publicised on each notice included a site location plan, summary of our proposed works and details of local exhibitions, as well as our consultation website address. No differentiation was made between the content of site notices and land referencing notices. In order to ensure an inclusive consultation of our proposals, and in accordance with best practice, each notice contained details for a telephone language interpreter. Notices also displayed a translation of this provision into the two or three most common languages, other than English, spoken in the area around our proposed sites as identified by the relevant local planning authority. Translations were only displayed on notices where such language information had been provided by the relevant Local Planning Authority (LPA). Please refer to Appendix A for an example copy of our notices.

Notice locations
Site notices were erected for all Phase two consultation sites. The locations of the site notices were initially chosen using the professional

Site notices judgement of the planning team. The relevant LPAs were then advised of the proposed locations, with amendments made in response to comments received. Confirmation of the final site notice locations were received from all affected LPAs, with the exception of the London Borough of Greenwich, as well as Transport for London. Agreement was also sought from MI6 (CTSA) due to the proximity of this sensitive receptor to the Albert Embankment Foreshore site. 6.1.2 The majority of site notices were erected within the public highway or on land owned by the local authority. Whilst no response was received from Greenwich, these notices were only fixed on land within Thames Water ownership and, subsequently, no land owner consent was required. Site notices for Cremone Wharf and King Edward Memorial Park were also displayed within the local park notice boards, at the request of the relevant LPA. The location of notices for the purpose of land referencing was dependent on the parcels of land where land interest details were unknown. Notices were erected as close to these areas as possible at appropriate locations on the public highway. We are proposing to use parts of our existing pumping station and storm water tanks site (Acton Storm Tanks) for construction work and to accommodate a permanent building and structures required to operate the main tunnel. The site would receive the main tunnel from Carnwath Road Riverside and connect the existing local combined sewer overflow (CSO), known as the Acton Storm Relief CSO, to the main tunnel.

The three CSOs are known as Greenwich Pumping Station, Deptford Church Street and Earl Pumping Station, and the long connection tunnel is known as the Greenwich connection tunnel.
Work is required to control the existing combined sewer overflow (CSO), known as the Shad Thames Pumping Station CSO, which currently discharges untreated sewage into the River Thames. In order to deliver the project we are proposing to use parts of our existing pumping station (see above) for this construction work and permanent structures required to control the CSO.

We need to carry out new works at Beckton Sewage Treatment Works to allow the additional sewage flows from the Thames Tunnel arriving via the Lee Tunnel to be pumped out. The works would be contained within the boundary of Beckton Sewage Treatment Works, which is located on the north bank of the River Thames. The River Roding (Barking Creek) is to the east of the site and to the west a mixture of business parks and retail parks on Armada Way. The works would be carried out on two sites within Beckton Sewage Treatment Works.

Methodology
Thames Water carried out a community stakeholder audit, identifying and documenting the details of organisations based near or operating in the vicinity of the preferred alignment option. The audit spanned 14 London Planning Authorities i.e., those which contain any preferred site. This audit was aimed at creating a database of potentially interested parties, who would not otherwise appear on statutory consultee lists. The objective was to locate as many relevant third sector organisations and business groups as possible, so as to involve them in the consultation around Thames Tunnel. The types of organisations located varied from residents groups, who would have a very local interest, interest groups whose remit would cover large swathes of the river and Local Strategic Partnerships with a borough wide interest, who would be accustomed to engaging in the planning process. In general, organisations were classified as follows, with some groups falling into more than one classification: a. Local Strategic Partnership b. BAME groups (borough wide and regional) c. Faith groups (borough wide and regional) d. Local interest groups (within consultation zone) e. Residents associations (within consultation zone) f. Regeneration partnerships (within consultation zone) g. Educational institutions (within consultation zone) h. Other potentially relevant groups and services

The search for places of worship was qualified as below, to ensure that the contact details collected in the audit were of value to the consultation process: a. Places of worship (including small parish churches etc) are included only if they lie within the consultation zone. The reason behind contacting them would then be the chance of any localised impacts upon their premises or their congregations. E.g., St Saviour's Church, St Georges Square in Westminster. b. Include faith groups or forums or wide ranging institutions if they lie within the borough and may potentially play a role in the religious or cultural life of the residents of the consultation zone. Professional
judgement should be used to gauge if this is the case. E.g. Westminster Bahai Community.

Research Sources and Checklist

Research sources and the audit checklist for identifying community stakeholders are outlined below: a. Check Site Suitability Report (SSR) for interest groups; get contact details (postal addresses only, wherever possible.) b. Check the latest record of consultation with the relevant Local Planning Authority (LPA). Get contact details of any neighbourhood groups / other groups mentioned by LPA or any other stakeholder. c. Get Local Strategic Partnership and / or LPA area forum and / or Ward Assembly details from LPA website. They will usually have a lead officer named.
d. Check the LPAs Statement of Community Involvement for references to relevant local organisations; refer to consultation feedback indices, if available. e. Find online Community and Voluntary Sector (CVS) forum page for each LPA. Note contact details of all organisations: i ii Operating near the site (see postcode, ward boundaries, check GIS map). Define near as within a ward / within a postcode That may have an interest in the site based on the nature of the organisation

In accordance with The Planning Inspectorate Advice note fourteen: Compiling the consultation report we have undertaken safeguards to ensure that feedback comments are grouped appropriately. This appendix sets out the process followed.

N.2.2 As set out in section 3.2, as far as possible feedback comments received were analysed against the question which they were submitted against in our feedback form (see appendix M for further details). This approach was only deviated from when it was clear that the comments made in response to a particular question related to another part or a question within the same part of the feedback form. Where feedback was submitted in alternative forms, as far as possible, feedback was placed against the questions within our feedback form. In

the feedback form, respondents were asked to state their view on certain questions by means of tick boxes. For these questions, views were only assigned where the respondents view point was clear from their feedback. Where the respondents point of view was not clear, this part of the question was left blank. Where no feedback was received in relation to a particular question, it was left blank. Where feedback was received that did not respond to any of the questions in the feedback form, it was entered into a separate part of the feedback form for other comments.

N.2.6 Feedback was then assigned a high level theme. These differed depending on the part of the feedback form. The themes are set out in table P.1. Detailed grouping of feedback

N.2.8 Once feedback had been assigned a theme, it was assigned a sub-theme. This process entailed firstly determining whether the feedback received was making a supportive or neutral comment, raising objections, issues or concerns or suggesting mitigation/suggestions or alternative solutions. Secondly sub-themes were assigned to reflect the detailed points raised in feedback comments. We introduced a series of processes to ensure that similar feedback was dealt with in a consistent manner and that our anticipated list of detailed points could be adapted as necessary. The steps undertaken were: within the team analysing the feedback, individuals were assigned different high level themes and analysed all feedback assigned that theme. This had two benefits: (i) it ensured that similar feedback received on the same and different sites were dealt with in a consistent manner; and (ii) provided an additional stage of checking in relation to allocation of high level themes since high level themes could either be deleted or added at this stage. if new points were raised by respondents during the analysis process, new sub-themes were added and feedback assigned against these points if the sub-themes did not reflect the feedback received, these were reworked to reflect the points that were raised within the sub-themes we created an other category where comments which did not neatly fit within the existing list and were only raised by a few respondents could be assigned if specific points were raised by respondents in relation to a specific site or specific point, points could be bespoked to include this additional detail. For example, the standard code is: should use/consider an alternative site; in light of feedback received at Acton Storm Tanks the point became should use/consider an alternative

site, specifically one that causes less nuisance to residential properties.
Checking
N.2.10 A sample of the feedback assignments were reviewed to check for consistency of theme and sub-theme assignment and to review the need for additional or revised sub-themes. This process was undertaken by a team member who was not directly involved in the analysis process. Additionally, a selection of correspondence received and details of the themes and sub-themes that were assigned was reviewed by the project team to confirm that it agreed with the approach that had been adopted. This process did not identify any changes to the assignment of themes or sub-themes.
