Virginiaandelsewhere,thedefendant,JeHyungYoo,andothers,didknowingly
combine,conspire,confederate,andagreetoobstruct,delay,andaffectcommerceandthemovement
of
anyarticleandcommodityincommerce,byrobbery,extortion,andthreats
of

anotherperson,
and
didcommit
an
overtactinfurtherance

this
conspiracy,
in
violation
of
Title
18,

observations

observations

made

me
were

me
bymy
review
of
records,documents,
and
other
physical
evidenceobtained
during
the
course
ofthis
investigation.

II.
THE
DEFENDANT
AND
HIS
CRIMINAL
HISTORY
5.
Defendant
Je
Hyung
Yoo
("defendant")
isa
citizen
of
the
Republic
of
Korea
(South
Korea).
He
enteredthe
UnitedStates
on
or
about
June
19,1993
pursuant
to
a
B1/B2non
immigrant
visa.
B1/B2
non-immigrant
visa-holders
are
authorized
to
remain
in
theUnited
Statesfor
a
periodnot
to
exceedsix
months.The
defendant
has
remained
inthe
United
States
inviolation
of
his
non-immigrant
visa.
The
Department
of
HomelandSecurity
has
ordered
the
defendantremovedfromtheUnitedStatesandthedefendantiscurrentlyinthecustody
of
the
Department
of
Homeland
Securitypending
removal
to
South
Korea.
6.Thedefendant'sarrestsandconvictionsincludethefollowing:
a.On
January
16,
2011,
thedefendantwasarrestedbythe
FairfaxCounty(Virginia)PoliceDepartmentforpossessionwith
intenttomanufacture,sellordistributeacontrolledsubstancein

of
Virginia
Code
§
18.2-248.
On
November
4,
2011,
the
defendant
was
convicted
and
sentenced
to
five
years
of
imprisonment,
with
four
yearsandnine
months
of
the
sentencesuspended.
b.
On
March
17,
2011,the
defendant
was
arrested
by
Fairfax
County
(Virginia)Police
for
assaultagainst
a
family
member
in
violation
of
Virginia
Code
§
18.2-57.2,
but
the
casewas
not
prosecuted.
c.
On
July
16,
2011,
the
defendant
was
arrested
by
the
FairfaxCounty
(Virginia)
PoliceDepartment
as
a
fugitive
on
a
felony
offense.
The
defendant
was
extradited
to
Prince
George's
County
(Maryland)
toface
prosecution
for
credit
cardfraud
and
theft.
d.On
March
3,2011,
the
defendant
was
arrested
by
the
Fairfax
County
(Virginia)PoliceDepartment
for
Burglary
in
violation
of
Virginia
Code
§
18.2-91.Recordschecksrevealed
that
thedefendant
was
deportable
as
an
alien
whohad
beenpreviously
convicted
of
possession
with
intent
to
distribute
a
controlledsubstance.
AnICE
detainer
was
filed
against
the
defendant
withthe
Fairfax
County
AdultDetentionCenterandthechargesagainstthedefendantwere
dismissed.
