Sale Conducted by Auctioneer
Should any dispute arise from the taking of bids, the auctioneer'sdecision will be final. Announcements from the ring will take precedence over the printed material.
Accidents:
Although every precaution will be taken to protect the safety and comfort of buyers andanimals, neither the sales management, auctioneer or seller assumes any responsibility in this matter and disclaims any liability, legal or otherwise, in the event of accident or loss of property. Purchasesbecome the responsibility of the buyer at the fall of the gavel.
Loading:
To avoid disruption of the sale, no goats will be loaded until the sale is concluded.Transportation health certificates will be the responsibility of the purchaser.
Payment:
Payment will be made before day’s end, and before taking control of the purchase.
Payment may be made by Visa, Mastercard, or Discover credit card, cash, cashier's check, traveler'scheck, and business or personal check with proper identification. Credit card purchases, including DV Auction purchases, will have 3.25% of the sale price added to the purchase. Purchases via DV Auction may have an additional fee assessed by DV Auction.
Registration certificates for goats sold as “registration pending” will be mailed to the buyer as soon as
received from the ABGA office. Pedigrees, birth dates, and herd book status will be provided to thebuyer at sale time.Transfer of ownership shall be the responsibility of the buyer.
Guarantees:Bucks:
Should any buck seven months of age or over, fail to prove a breeder after being used on doesknown to be breeders, the matter shall be reported to the seller within seven months following date of purchase. Seller will then have the right and privilege of ninety days to prove the buck a breeder. Noguarantee is given that semen collected from the buck will freeze.
Does:
In the event a female more than one year old is claimed to be a non-breeder, after being bredregularly to a buck known to be a breeder and after being treated by a licensed veterinarian, the matter must be reported in writing to the seller within seven months of sale date, or by the time the female is19 months old if purchased prior to her first birthday. Seller shall have six additional months in which toprove any such female a breeder and may use any registered buck of the breed available to him.Females sold as bred, exposed, served, or otherwise indicating mating, are not guaranteed to bepregnant nor to deliver live kids, unless such guarantee is expressly stated by the seller in a personalcontract.Transportation charges on animals returned to or recovered from the seller shall be the responsibility of the buyer. If the seller is successful in proving the animal in question to be a breeder, then said animalwill be reclaimed by the purchaser at his/her expense. Should the seller fail to prove the animal abreeder, then the buyer is guaranteed a satisfactory replacement, F.O.B. or a refund of the actual
purchase price, seller’s option.
No incidental expenses such as feed, care, veterinary charges, etc., will be charged by either partywhen making settlement. In no event shall the seller be responsible for more than the purchase price.
Exception to Guarantee:
In any case where the animal is subject to any hormonal or surgicalreproduction techniques after the sale, this guarantee is null and void.
Rights and Obligations:
The above terms and conditions shall constitute a contract between thebuyer and seller and be equally binding to both. Resale of animals following purchase in this sale shallconstitute a separate transaction and the rights and obligations of the two parties connected thereto arenot covered by the terms and conditions of this sale.
