ARTICLE 1 - RECOGNITION
101 The Employer recognizes the Union as the exclusive bargaining agent for all employees of Ming Pao Newspapers (Canada) Ltd. in the city of Toronto save and except supervisors, persons above the rank of supervisor and persons employed in a confidential capacity in matterspertaining to labour relations.Clarity Note:Supervisors are persons performing managerial functions as per section1(3)(b) of the Act.102 In this Collective Agreement, it is presumed that gender references tomale or female employees apply equally to the other sex.
ARTICLE 2 – MEMBERSHIP & DUES DEDUCTION
201 The Employer agrees as required by section 47 of the Ontario Labour Relations Act, 1995, as amended from time to time, to deduct from themonthly earnings of each employee covered by the Collective Agreement,an amount equal to the regular union dues (as specified in writing by CEP,Local 87-M, Southern Ontario Newsmedia Guild and calculated inaccordance with the terms below) and to remit the total of such deductionsby cheque to the Treasurer of the Union before the 15
th
day of the monthfollowing the month in which deductions are made. The Employer shall,when remitting dues, give the names of the employees from whose paydeductions have been made.
202 The monthly remittance of dues to the Union shall he substantiated by aseparate listing of gross earnings and dues deductions for each employeefor the month. The Employer must receive written notification of anychanges in the amount of regular monthly union dues. Such change shallbe implemented in the month following notification.203 In addition to the foregoing, the Employer agrees upon receipt of writtendirection from the Union, which shall be given at least two weeks inadvance of such deduction, to deduct special assessments as required bythe Union and to remit the deductions by cheque to the Treasurer of theUnion before the 15
th
day of the month following the month in which thedeductions are made. The Employer shall provide the names of theemployees whose pay deductions have been made to the Union.204 The Union shall indemnify and save harmless the Employer including itsagents and employees from any and all claims or actions arising out of or in any way related to deductions made in accordance with this article.
