LUTWIN,LLP,forhisVerifiedComplaint,respectfullyallegesthat:1.Atalltimeshereinaftermentionedtheplaintiff,NATHANIELCARTER,wasandstillisaresidentoftheCountyofKings,StateofNewYork.2.Atalltimeshereinaftermentionedthedefendant,CITYOFNEWYORK("CITY")wasandstillisamunicipalcorporationdulycreated,organizedandexistingunderandbyvirtueofthelawsoftheStateofNewYork.3.Atalltimeshereinaftermentioned,thedefendant,CITY,itsagents,servants,officers,employeesandassignsactedundercoloroflaw.4.ANoticeoftheClaimofplaintiff,NATHANIELCARTER,andhisintentiontosuethereon,andofthetimeswhenandplaceswherehisinjuriesweresustained,wasdulyservedandfiledwiththedefendant,CITY,onthe

dayofAugust,2011.5.Morethanthirty(30)dayshaveelapsedsincetheserviceofsuchNoticeofClaimonbehalfofplaintiffNATHANIELCARTER,andthedefendant,CITY,hasfailedorrefusedtoadjustsuchclaim.

6.AtalltimeshereinaftermentionedthedefendantCITYmaintainedandoperatedandcontrolledtheNewYorkCityPoliceDepartmentforpurposesofenforcinglawsandcarryingoutmunicipalpoliceproceduresonbehalfoftheCityofNewYorkanditsresidents.7.ThatonJune12,2011,theplaintiff,NATHANIELCARTER,waslawfullyandproperlyonapublicsidewalkinthevicinityof1488SterlingPlace,CountyofKings,CityofNewYork,StateofNewYork.8.ThatonJune12,2011,theplaintiff,NATHANIELCARTER,whilehewaslawfullyandproperlypresentintheareaof1488SterlingPlace,CountyofKings,CityofNewYork,StateofNewYork,waswithoutgoodcausefalselyandwrongfullyarrestedanddetainedbyofficersoftheNewYorkCityPoliceDepartment.9.Thatthereafter,onoraboutJune12,2011,theplaintiff,NATHANIELCARTERwaswrongfullychargedwithConsumptionOfAlcoholOnaPublicStreet.10.Thatthereafter,onoraboutJune12,2011,theplaintiff,NATHANIELCARTERwasphysicallyassaultedandwasthevictimofabattery.Withoutprovocation,officersoftheNewYorkCityPoliceDepartmentstrangledtheplaintiffabouttheneck,placedadrawstringaroundhispenis,andstrangledhispeniscausingbodilyinjury.Further,whileonabench,anofficer,orofficersbeatplaintiffcausingfurtherdamages.11.Thattheaforesaidchargeagainsttheplaintiff,NATHANIELCARTER,causedbytheCITY,wasamaliciousprosecution,becausetheCITYhadfull
 
andcompleteknowledgethattheplaintiffhadbeenimproperlyarrested,andtherewasnotascintillaofcredibleevidencetosupportthechargesforwhichtheplaintiffwascharged,andthattheplaintiffwascompletelyinnocentofthechargesforwhichhewascharged.
ASANDFORAFIRSTCAUSEOFACTIONONBEHALFOFPLAINTIFFNATHANIELCARTERFORFALSEARREST
12.ThatonJune12,2011,theplaintiffwaslawfullyandproperlypresentintheareaof1488SterlingPlace,CountyofKings,CityofNewYorkanddidnotpossessanyopencontainerofalcohol.13.Thatbyreasonoftheaforesaidpremisesandtheactionsofthedefendant,CITY,itsagents,servants,employees,officersandassigns,theplaintiffwasfalselyarrestedandhasbeeninjuredanddamaged,andhastherebysufferedgreatmentalandbodilydistress.14.Byreasonoftheforegoingpremises,theplaintiffhasbeendamagedinasumwhichexceedsthemonetaryjurisdictionofalllowercourtswhichmightotherwisehavejurisdictionofthisaction.
