MOTION TO CONTINUE PROBABLE CAUSE HEARING
The Defendant, ROBERT BRADDOCK, hereby moves to a continuance of theprobable cause hearing in this matter from June 21, 2012 for thirty (30) days to July 20,2012. In support thereof, it is submitted:1.
 
This Defendant was arrested and presented on May 30, 2012 and released onbond by the Court (Martinez, U.S.M.J.).2.
 
This Defendant was arrested via Criminal Complaint.3.
 
The probable cause hearing is scheduled for June 21, 2012.4.
 
This Defendant understands that since he was arrested without an indictment heis entitled to a preliminary hearing before the Court to determine whether there is probablecause sufficient to continue his prosecution. Federal Rules of Criminal Procedure 5. TheDefendant also understands that Federal Rules of Criminal Procedure Rule 5.1 calls for aprobable cause hearing to take place no later than 21 days for a defendant not in custody.5.
 
This Defendant has signed a written waiver for his signature which wouldprovide the Court with written authority to waive the time limits described in Fed.R.Crim.P.5.1 – through July 20, 2012.
