ProceduralBackground
TwoGroupsofFiveorMoreIndividuals(Protestants),onerepresentedbyBerthaDudleyandStanleyMayes,andtheotherrepresentedbyEricaHurtt,timelyfiledaprotestagainsttheApplicationunderDistrictofColumbiaOfficialCode§25-602.ThepartiescamebeforetheAlcoholicBeverageControlBoard(Board)foraRollCallHearingonDecember27,201I,andaProtestStatusHearingonFebruary8,2012.TheProtestHearingoccurredonMarch21,2012.TheBoardlefttherecordopenuntilApril9,2012,inordertogiveAdvisoryNeighborhoodCommission(ANe)IBadditionaltimetovoteontheproposedVoluntaryAgreementwiththeApp1icant.TheBoardnotesthatANC1Bwasdismissedfromthisprotest,becausearepresentativeoftheANCdidnotappearattheProtestStatusHearing.InreAllSouls,LLC,tlaAllSouls,BoardOrderNo.2012-094,1-2(D.C.A.B.C.B.Mar.7,2012).Nevertheless,ANCIBproperlysubmittedarecommendationunderDistrictofColumbiaOfficialCode§25-609.TheBoardrecognizesthatanANC'sproperlyadoptedwrittenrecommendationsareentitledtogreatweightfromtheBoard.SeeFoggyBottomAss'nv.DistrictofColumbiaABCBd.,445A.2d643(D.C.1982);D.C.Code§§1-309.10(d);25-609(WestSupp.2012).Accordingly,theBoard"mustelaborate,withprecision,itsresponsetotheANC['s]issuesandconcerns."FoggyBottomAss'n,445A.2dat646.Here,ANC1BrecommendsthatwedenytheApplication,becauseitwillnegativelyimpacttheneighborhood'speace,order,andquiet.Therefore,althoughANCIBwasdismissedasaProtestant,theBoardwillaccordANC1B'srecommendationgreatweightasrequiredbylaw.WefurthernotethatourdecisionalsoconsiderstheissuesraisedbytheProtestants;namely,thattheApplicationisinappropriateonthegroundsthatitwilladverselyimpactthepeace,order,quiet,pedestriansafety,andrealpropertyvaluesofthearealocatedwithin1,200feetoftheestablishment.D.C.Code§25-313(b)(WestSupp.2012);23DCMR§§1607.2;1607.7(b)(WestSupp.2012);
