AFFIDAVIT IN SUPPORT OF CRIMINAL COMPLAINT
1, Cynthia H. Samples (the liAftianf), being duly swom, depose and state:
1.I am a Special Agent with the United States Department of Homeland Security,
Homeland Security lnvestigations (HSI) assigned to the office of the Assistant Special Agent in
Charge, West Palm Beach, Florida, and have been employed by HSl since August of 2009. Ihave successfully completed the Criminal lnvestigator Training Program and Special AgentTraining at the Federal Law Enforcement Training Center in Glynco, Georgia. Among myresponsibilities as a Special Agent is the investigation of crimes against children, particularly
offenses involving child pomography and the exploitation of children via the lnternet.
2. The facts set forth in this affdavit are based upon my personal knowledge,information obtained in this investigation from others, including other law enforcement officers,my review of documents, and information gained through training and experience. Since thisaffidavit is being submitted for the limited purpose of establishing probable cause to support aCriminal Complaint, I have not included each and every fact known to me concerning thisinvestigation, but have set forth only those facts necessary to establish probable cause to believe
that Gary K. SCHATZ (YOB: 1952) has violated Title 18, United States Code, Section 2422(19.
On June 14, 2012, an individual using the screen nnme Gary sent an undercover
law enforcement officer (hereinafter$çUC'') a private message via the Internet, specitkally
through BoyAhoy, a web-based social networking application that can be installed on an iphoneand/or ipad. The UC was using a protile purporting to belong to a 15 year-old male; lfl'm 18-3

years. Get it hehe.'' Gary's tirst message to the UC was çtvery cute how about diner'' and thechat continued. As the conversation progressed, Gary asked the UC

$çu go to college?'' and the
UC responded çlNo high school.'' Gary then asked
,
çlok r u planning college'' and the UC repliedilln a couple of years yes.'' Within the snme minute, Gary asked the UC if he was interested inSlgetting together.'' Shortly thereafter, Gary provided a telephone number and asked the UC to
call or text him.
5.The exchange through BoyAhoy ended

and the UC sent a text message to thenumber Gary provided simply saying ;tHey
.
'' The conversation developed and quickly turned
sexual in nature when Gary provided explicit sexual details from a previous exchange with
another male via this app, %çI met 1 person on this app and she (sicl was really really strange.''
The UC replied, lshow so'' and tûwhy was he strange
.
'' Gary stated, tçl-le wanted to get together
and talk so I went and picked him up and he told me he was really homy wanted me to give him
'
a blowjob'' and 1$I said l don't even know you 1'm not doing anything like that.'' The UC replied
with, çlwell l think he should have asked you first'' Gary stated, t1I would have if you ask nicely''and ççAnd maybe got to know him a Iittle bit before l sucked his dick

sexually explicit statements to the UC before informing him that he needs to go back to work

Prior to ending the conversation, Gary tells the UC that he is from tlsunrise

Approximately tive hours later, the UC and Gary commence their text messagingvia phone once again. During the exchange
