BACKGROUND
OnJune12,2012theBoardofSupervisorsdirectedtheCommunityDevelopmentDepartmenttoprepareadraftinterimordinancetoaddressmarijuanacultivationonatemporarybasis,whiletheMedicalMarijuanaCultivationAdvisoryBoardcontinuestodevelopadraftcultivationordinancefortheBoard'sconsiderationinthefuture,Thistemporaryurgencyordinanceisintendedtoprovideaclearlocallanduseordinancetoprohibitcultivationonvacant,undevelopedproperties,whilealsosettinglimitsontheamountofmedicalmarijuanaallowedonpropertiesdevelopedwithresidences,particularlywithinresidentialneighborhoods.Section65858oftheCaliforniaGovernmentCodecontainsprovisionstoallowforanurgencymeasuretoadoptaninterimordinancetobeapprovedfora45-daytimeperiod.Afour-fifthsvoteoftheBoardofSupervisorsisrequired.
An
interimordinancecanbeextendedbytheBoardifappropriatefindingsaremadethatthereisacurrentandimmediatethreattothepublichealth,safety,orwelfare.StaffrequeststhattheBoardreviewanddiscusstheattachedinterimordinance,makewhateverrevisionsyoufeelarenecessary,andadopttheordinance.Staffwillbepreparedtomakerevisionstotheordinanceduringthehearing,basedonconsensusdirection,andwillprojecttheordinanceonthescreenwhilemakinganyrevisions,Also,theMedicalMarijuanaCultivationAdvisoryBoardismeetingonFriday,June22

StaffwillbepreparedtodiscussanyadditionalrecommendationsthattheAdvisoryBoardreachesconsensuson,atthehearing.
RECOMMENDATION
StaffrecommendsthattheBoardofSupervisorsmakesthefollowingfindingsandadopttheinterimurgencyordinance:

1.Thereisacurrentandimmediatethreattothepublichealth,safety,orwelfareasaresultofunregulatedcultivationofmedicalmarijuanaonvacantpropertiesandexcessiveamountsofmarijuanacultivationinresidentialneighborhoodsthroughoutLakeCounty.2.Proposition215wasintendedtoenablepersonswhoareinneedofmarijuanaformedicalpurposestouseitwithoutfearofcriminalprosecutionunderlimited,specifiedcircumstances.Proposition215furtherprovidesthat"nothinginthissectionshallbeconstruedtosupersedelegislationprohibitingpersonsfromengaginginconductthatendangersothers,ortocondonethediversionofmarijuanafornon-medicalpurposes."TheballotargumentssupportingProposition215expresslyacknowledgedthat"Proposition215doesnotallowunlimitedquantitiesofmarijuanatobegrownanywhere."3.In2004,theLegislatureenactedSB420(codifiedasCaliforniaHealthandSafetyCodeSection11362.7etseq.)toclarifythescopeofProposition215,andtoprovidequalifyingpatientsandprimarycaregiverswhocollectivelyorcooperativelycultivatemarijuanaformedicalpurposeswithalimiteddefensetocertainspecifiedStatecriminalstatutes.4.CaliforniaHealth

SafetyCodesection11362.83expresslyallowscitiesandcountiestoadoptandenforceordinancesthatareconsistentwithSenateBill420.5.ThisOrdinanceisnotsubjecttotheCaliforniaEnvironmentalQualityAct(CEQA)pursuanttoSections15060(c)(2)(theactivitywillnotresultinadirectorreasonablyforeseeableindirectphysicalchangeintheenvironment)and15061(b)(3)(thereisnopossibilitytheactivityinquestionmayhaveasignificanteffectontheenvironment).Inadditiontotheforegoinggeneralexemptions,thefollowingcategoricalexemptionsapply:Sections15308(actionstakenasauthorizedbylocalordinancetoassureprotectionoftheenvironment)SampleMotionImovetowaivethereadingoftheordinance,readingitintitleonly.Ioffertheordinance.2

ORDINANCENO._ANURGENCYMEASUREADOPTINGANINTERIMORDINANCEPROHIBITINGCOMMERCIALMEDICALMARIJUANACULTIVATIONANDCULTIVATIONONVACANTPROPERTIES,ANDLIMITINGOUTDOORCULTIVATIONAMOUNTSINTHECOUNTYOFLAKE,ANDDECLARINGTHEURGENCYTHEREOFWHEREAS,in1996,thevotersoftheStateofCaliforniaapprovedProposition215,"theCompassionateUseAct",whichwasintendedtoenablepersonsinneedofmedicalmarijuanatoobtain,use,andcultivatemarijuanaformedicalpurposesuponrecommendationbyalicensedphysicianandtoencouragethestategovernmenttoimplementaplantoprovideforthesafeandaffordabledistributionofmedicalmarijuana,andWHEREAS,onJanuary1,2004,SenateBill420becameeffectivetoclarifythescopeoftheCompassionateUseActandtoallowcitiesandcountiestoadoptandenforcerulesandregulationsconsistentwithSenateBill420andtheCompassionateUseAct;andWHEREAS,whiletheLakeCountyZoningOrdinancedoesnotpresentlyallowthecultivationofmedicalmarijuana,suchcultivationisoccurringatrapidlyincreasingfrequencyandinlargequantitiesthroughouttheCounty,particularlyonvacantpropertiesandresidentialzonesintheunincorporatedareasoftheCounty;andWHEREAS,medicalmarijuanacultivationraisesissuesoffirstimpressionfortheCountybecausetheCountyZoningOrdinancedoesnotpresentlyaddressorregulateitinanymanner,includingbutnotlimitedtothequantityofcultivationandidentificationofwhichzoningsuchalanduseisallowed;andWHEREAS,ifmedicalmarijuanacultivationwereallowedtocontinuewithoutrestrictionitislikelytocontinuetoproliferateinlargequantitiesinresidentialneighborhoodsandundeveloped
