OnJune12,2012,theStateofFloridafiledanInformationchargingShellieZimmermanwithPerjuryinOfficialProceeding,aviolationofFloridaStatute837.02(1)stemmingfromherallegedfalsestatementaboutthedonationfundatMr.Zimmerman'sbondhearingonApril20,2012.Mrs.Zimmermanhassincebeenarrestedonthecapiasandhasbeenreleasedfromcustodyonbond.6.SinceApril26,2012,anymoneyinthedonationfund,includingsubsequentdonationstothelegaldefensefundhavebeenoutofthecontrolofMr.Zimmerman,hiswifeoranyfamilymemberexceptfor$20,000thatwaswithheldforongoinglivingexpenses.Currently,allmoneyinthelegaldefensefundisunderthecontrolofanindependenttrusteeandisnotaccessible

toMr.Zimmermanorhisfamily.AnyexpenditureonbehalfofMr.Zimmermanmustbeapprovedbythefundadministrator.ThewebsitestartedbyMr.ZimmermanhasbeencloseddownaspartoftheoverallremovalofMr.Zimmerman'sinternetpresence.Anewwebsite,www.gzdefenseftilld.com.wasestablishedandiscurrentlyactiveandisavailabletoacceptdonationstohelpMr.Zimmermanoffsetlegaldefenseexpensesandreasonablelivingexpenses.ThosefundsarelikewisebeingdirectedtothefundadministratorandarenotaccessibletoMr.Zimmermanorhisfamily.7.Mr.ZimmermanisstillentitledtoareasonablebondnotwithstandingtheCourt'sfindingthatMr.Zimmermanfailedtodisclosetheexistenceofthedonatedmoneyathislastbondhearing.FloridaConstitutionArticle1Section14providesthat,Unlesschargedwithacapitaloffenseoranoffensepunishablebylifeimprisonmentandtheproofofguiltisevidentorthepresumptionisgreat,everypersonchargedwithacrimeorviolationofmunicipalorcountyordinanceshallbeentitledtopretrialreleaseonreasonableconditions.Ifnoconditionsofreleasecanreasonablyprotectthecommunityfromriskofphysicalharmtopersons,assurethepresenceoftheaccusedattrial,orassuretheintegrityofthejudicialprocess,theaccusedmaybedetained.Seealso,FloridaStatute907.041andStatev.Paul,783So.2d1042(Fla.2001).8.Thedefendantdoesnotposeariskofhanntothecommunitynorisheaflightrisk.Onthenightoftheincidentbeforebeingarrestedandcharged,Mr.Zimmermanremainedinregularcontactwithlawenforcementandcooperatedfullyintheirinvestigation;whilereleasedonthisCourt'sinitialbond,
Mr.
Zimmermanfullycompliedwiththeconditionsofhisrelease;andwhendirectedtosurrenderhimselfaftertheCourtrevokedbond,hedidsotimely.9.Mr.Zimmermanhasnocriminalconvictions,nohistoryoffailingtoappearatcourtproceedingsandhassignificanttiestothecommunityasevidencedathisinitialbailhearing.
