knowledgewheredefendantshavetriedtoliftthesecrecybuttheirapplicationshavealwaysbeenrejected.Inotherwords,MrAssange,notwithstandingtheavalancheofpublicitydamagingtohimabouttheprosecutioncase,willbetriedinsecretandthepublicwillnotbeawareofanyexposureinthecourtroomoftheweaknessofthatcase.Prosecutionwitnessesneednotworryaboutotherwitnessescomingforwardtorefutetheirevidencebecausetheirevidencewillnotbeheardinpublic.5.Thetrialwillbeheardbyajudgeandthreelaypersonswhositwithhimorher.Thethreelaypersons,appointedbypoliticalparties,areoftenmembersoftheparliesthatappointthem.6.IshouldaddthatthedangercausedbymediaprejudiceisalsopresentatCourtofAppeallevel,wherethehearingswillagainbeinsecret.

10.Borgstromappealedagainstthedismissaloftherapechargetoanotherprosecutor,MarianneNy,andshedecidedbothtoupholdhisappealandtotakeoverthecaseherself.TheprocessbywhichthisappealwasdecidedexcludedMrAssangeandhislawyerentirely.TheyhadnorighttointerveneorargueagainstitandnoonecouldappeartoupholdMsFinne'sdecision.This,ofcourse,isabreachoftherulethateveryoneshouldbeentitledtobeheardinrelationtomattersthataffecttheirlibertyortheircivilrights.AstheProsecutortodecidethatMsFinnewaswrongandthatsheshouldreinstitutetheinvestigation,MsNyhas,byvirtueofthisprocedure,becomeajudgeinherowncause'.Thisiscontrarytothewell·~known.principleinthe
