RELATING TO CONTRACTS.
DESCRIPT:
Establishes provisions relating to automatic renewal clauses under the fair trade regulations law.Requires any person that sells or offers to sell any products or services to a consumer pursuantto a contract that has a specified term of more than 1 month and an automatic renewal clauseunder which the contract will automatically renew for a specified term of more than 1 monthunless the consumer cancels the contract to disclose the automatic clause and the procedure bywhich the consumer can cancel automatic renewal of the contract clearly and conspicuously inthe consumer contract. Requires any person that sells or offers to sell any products or servicesto a consumer pursuant to a consumer contract that has a specified term of 12 months or moreunder which the contract will automatically renew for a specified term of more than 1 monthunless the consumer cancels the consumer contract to notify the consumer clearly andconspicuously that the consumer contract will automatically renew unless the consumer cancelsthe contract; how to cancel the contract; and the deadline by which the consumer shall respondto cancel the consumer contract and prevent automatic renewal. Requires any person whoknowingly violates this provision or who knowingly fails to cancel an automatic renewal contractupon consumer request to be deemed to have engaged in unfair method of competition andunfair or deceptive act or practice in the conduct of any trade or commerce. -- HB0663 CD1

Provides that any vessel may be deemed abandoned if the vessel has been moored orotherwise left in the waters of the State or on public property contrary to law or rules having theforce and effect of law, or left on private property without authorization of the owner or occupantof the property and if the vessel's registration certificate or marine document has expired and theregistered owner no longer resides at the address listed in the vessel registration or marinedocument records of the department of the US Coast Guard; the last registered owner of recorddisclaims ownership and the current owner's name or address cannot be determined; the vesselidentification numbers and other means of identification have been removed so as to hinder ornullify efforts to locate or identify the owner; and the vessel registration records of thedepartment of land and natural resources and the marine document records of the US CoastGuard contain no record that the vessel has ever been registered or documented and theowner's name or address cannot be determined. Allows decision whether a vessel isabandoned to be made by the chairperson of the board of land and natural resources withregard to public property under the jurisdiction of the department of land and natural resources;any other state department or agency through its director with regard to public property withinthe department or agency's respective jurisdiction; or any county through its mayor or themayor's designee, or chief of police with regard to public property within the respective county's jurisdiction. -- Amends provisions relating to when public auction not required. Allows the stateor county agency that took custody of the vessel to sell the vessel by negotiation, dispose of it as junk or donate the vessel to any governmental agency after public notice of intended dispositionhas been given. -- Amends provisions relating to vessels abandoned on premises of personsengaged in repair business, of private marinas, and by adding of yacht clubs or of other privateproperty owners. -- HB2589 CD1
