CHARLESJ.GIFT,inhisofficialcapacityastheDirectorofPublicSafety,SinclairCommunityCollegeandJOHNDOENos.1-10,intheirofficialandindividualcapacities,Defendants.NowcomePlaintiffsRuthDeddens("Deddens"),EthelBorel-Donohue("Bore1-Donohue")andBryanKemper("Kemper")(collectively,the"Plaintiffs")andfortheirComplaintagainsttheDefendantsnamedhereinherebyallegeasfollows:INTRODUCTION1.Thisisanactionfordeclaratoryjudgment,permanentinjunction,andnominaldamagesunder42U.S.C.§1983arisingfromtheunconstitutionalactions,aswellaspolicies,practicesandcustoms,oftheDefendantsthathaveresultedintheviolationoftheconstitutionalrightsofthePlaintiffs.DuetoDefendants'policies,practicesandcustoms,aswellascertainconductbyoneormoreDefendant,PlaintiffshavesufferedandwillcontinuetosufferirreparableharmtotheirrightsundertheFirstAmendmenttotheUnitedStatesConstitutionandtheFourteenthAmendmenttotheUnitedStatesConstitution.2.Bymaintaining,implementing,andenforcingvaguepoliciesthat(i)restrictandprohibitstudentsandinvitedspeakersfromengaginginexpressiveactivityatSinclair,(ii)restrictandprohibitspontaneousspeechbystudentsandinvitedspeakersinresponsetorecentorstill-unfoldingevents,(iii)vestunfettereddiscretioninuniversityadministratorstorestrictspeechofstudentsandinvitedspeakers,(iv)vestunfettereddiscretioninofficialsandemployeesofSinclairCommunityCollege,includingofficialsandemployeesoftheDepartmentofPublic~2-
 
SafetyofSinclairCommunityCollege/SinclairPoliceDepartment,torestrictthespeechofstudentsandinvitedspeakers,and(v)threatenstudentsandinvitedspeakerswithdisciplinaryorcriminalchargesforviolationofsuchpolicies,DefendantshaveimpededandwillcontinuetounconstitutionallyimpedePlaintiffsintheirefforttodistributeliterature,hostandparticipateinpoliticalrallies,anddisplaypoliticalmessagesatSinclairadvocatingfortheadoptionof,orpreventionof,certainpoliticalmeasures.SuchexpressiveactivityisprotectedbyandatthecoreoftheFirstAmendment.3.Additionally,Plaintiffsdesiretoengageinotheractivitiesconsistentwiththeirpurposeandgoalsasmoreparticularlydescribedhereinand,insodoing,toengageinactivitiesprotectedbytheFirstAmendmentinandabouttheSinclaircampuswithoutbeingsubjectedtothethreatofenforcementortheactualenforcementofapolicy,practice
or
customthatfailstocomplywiththerequirementsoftheUnitedStatesConstitution.4.Asaresultofthepolicy,practiceandcustomoftheDefendants,aswellascertainconductbyoneormoreDefendant,PlaintiffshavesufferedandwillcontinuetosufferirreparableharmunlesstheDefendantsareenjoinedfromrestrictingtheirprotectedspeechinthismanner.
