Procedural History:
Respondent filed a petition to declare his marriage with wife, Fely null and void to the RTC. Decision of the RTC was in favor of the respondent and OSG intervened. The appeal to reverse RTCs decision on CA was declined.

Facts:
Respondent married Fely in the Philippines. Fely left for US and obtained a divorce decree which she sent to respondent to be signed. Fely then married an American and was naturalized as an American citizen. Respondent filed the petition due to psychological incapacity. Respondent testified, presented their marriage license and submitted the invitation where Fely used her American husbands last name.

Issue:
Whether or not Fely is psychologically incapacitated?

Ration Decidendi:
1. No sufficient evidence to prove Felys being psychologically incapacitated. 2. Felys marriage with respondent is still existing since she was still a Filipino citizen when she obtained the divorce decree. 3. The evidence presented by respondent can be ground only for legal separation and not for nullification.

Holding:
Petition granted, CA decision reversed.
