I.Introduction
1.TheprincipalpurposeofthisPetitionistoseekissuanceofawritofmandamusuponeachmemberoftheHarrisburgCityCouncildirectingeachmembertoimplementaprovisionofthepreviouslyCourt-confirmedRecoveryPlanrequiringa1

increaseintheCity'sEarnedIncomeTax,orEIT,imposedundertheauthorityoftheLocalTaxEnablingActandAmendedAct47,whichisacriticalcomponentoftheCourt-confirmedRecoveryPlanandcriticallyneededtohelpameliorateHarrisburg'ssevereoperatingdeficitandtoeffectuateaconsensualRecoveryPlan.ThisHonorableCourthasalreadyorderedCityCouncilto
 
implementthisprovisionbyvirtueofhavingconfirmedtheRecoveryPlanthatcontainsthisprovision.

AmendedAct47,Section704(a)(1).Inaddition,theReceiverhasorderedCityCounciltoimplementtheprovisionpursuanttoSection708(a)(1}Yet,theEITinitiativehasnotbeenimplemented.
In
addition,theReceiverseeksawritofmandamuswithregardtoanotherprovisionintheCourt-confirmedRecoveryPlan,whichwillbeexplainedbrieflyattheendofthisPetition.2.ThisPetitionhasbeenserveduponeachmemberofCityCouncil--CouncilPresidentWandaWilliams,BradKoplinski,EugeniaSmith,SusanBrown-Wilson,SandraReid,PattyKim,andKellySummerford--anduponcounsel(hereinafter,"OppositionCounsel")whorepresentscertainmembersofCityCouncilandtheCityTreasurerandController.OppositionCounselhasindicatedthathisclientsopposeimplementingtheEITinitiativecontainedintheCourt-confirmedRecoveryPlanandarethuspotentiallynon-compliantparties.
II.
PROCEDURALBACKGROUND
3.PetitionerisanadultindividualhavingaprofessionaladdressforserviceofprocessatOfficeoftheReceiverfortheCityofHarrisburg,401FinanceBuilding,Harrisburg,PA17120.4.OnDecember2,2011,thereceiverwhoprecededPetitioner,DavidUnkovic,wasappointedtobetheReceiverfortheCityofHarrisburgbyOrderof

HonorableCourtpursuanttotheapplicableprovisionsofAmendedAct47.5.AmendedAct47providesthat
in
theeventthataconsensualresolutionofthefiscaldistressofafinancially-distressedcityhasnotbeenachieved,theGovernormaydeclareafiscalemergencyandmaydirecttheSecretaryoftheDepartmentofCommunityandEconomicDevelopment("DCED")tofileapetition
with
thisHonorableCourttonominateareceiver.AmendedAct47providesthattheappointedreceivershallformulateandsubmittothis
