Lungren was criticized for voting for the measure He was concerned that an earlier version had too restrictive a spending cap, but is now convinced that it would shrink the size of government to traditional levels. The U.S. Forest Service terminated the contract with Aero Union to operate seven P3 Orions used for firefighting missions. Spellman said Lungren was not being responsive to homeowners forced to pay high flood insurance rates. Said Supreme Court Decision Would Lead to Release of Prisoners in California That Would Lead Directly to Rapes and Assaults In May 2011, Lungren stated that the release of thousands of prisoners in California, resulting from the Supreme Courts decision to release 38,000 to 46,000 prisoners, would directly lead to rapes and assaults on California residents. On the House floor Lungren said, You rarely say this, but I fear that there will be murders, there will rapes, there will be assaults, there will be unnamed and unnumbered crimes in my home state as a direct result of todays decision by the U.S. Supreme Court. Co-Sponsored a Bill to Jump-Start the Property Assessed Clean Program In 2011, Lungren co-sponsored a bill to jump-start the Property Assessed Clean Energy program, a program that helped property owners install green upgrades, after it ran into government roadblocks in 2010. The program used low-interest government financing to help fund installations of energy-efficient solar panels, insulation, water conservation systems and more. More than half of the country had approved some version of the program, which was a magnet for stimulus funding. Retrofits were mostly financed with bonds issued by local governments and then applied as a regular surcharge on homeowners property taxes, which lightened the heavy upfront costs of such improvements. But the Federal Housing Finance Agency balked at a component of the program that, in a foreclosure, prioritized the PACE lien over an existing mortgage. The PACE Protection Act from Reps. Mike Thompson (D-Calif.), Dan Lungren (R-Calif.) and Nan Hayworth (R-N.Y.) would compel the housing finance agency to back down and allow PACE to proceed. I am pleased that, after consultation with the Committee and thorough analyses, the AoC has entered into a new waste removal contract that will divert the majority of Congress solid waste from local landfills and save taxpayers thousands annually, wrote Lungren in a statement Thursday. Waste-to-energy facilities, woefully underutilized here in the U.S., are an environmentally efficient, cost-effective means to reduce greenhouse emissions and divert waste from landfills, he added, noting that the contract will help divert up to 90 percent of the Capitol complexs non-recyclable solid waste from landfills. Touted $994,500 Grant for South Sacramento Habitat Conservation Plan In August 2011, Lungren touted a $994,500 in Section 6 grant for the South Sacramento Habitat Conservation Plan (SSHCP). The grant was from the U.S. Department of the Interior to support ongoing planning efforts to protect over 48,000 acres of high-quality species habitat and establish a largely intact and interconnected preserve system. Lungren said, The SSHCP is an important planning document for the Sacramento region; one that will protect and enhance Sacramento Countys unique natural resources while allowing the region to achieve carefully planned economic development. However, the firm King and Spalding withdrew as the Houses counsel. Lungren wrote a letter saying King and Spaldings cut and run approach is inexcusable and an insult to the legal profession. Less than one week after the contract was approved engaging the firm, they buckled under political pressure and bailed with little regard for their ethical and legal obligations. Cathy Kennedy, 55, is a registered nurse said, The tax of one-half of one percent that we are proposing on large financial transactions could generate $350 billion annually to fund health care, infrastructure, jobs and schools. In 2011, it was reported that Lungren worked with groups on an agriculture-friendly guest worker program which was considered as a potential amendment to mandatory E-Verify legislation. The amendment would create a guest worker plan that would be administered by U.S. Department of Agriculture. The H-2A guest worker program for agriculture, in 2011, was run by the U.S. Department of Labor. The paper reported that Lungrens plan may be the best the industry can do to balance out the enforcement provisions of mandatory E-Verify legislation. Mandatory use of E-Verify could knock more than 50% of agricultural laborers out of work, industry sources have said. Reopened Public Discussion About Draining and Restoring Hetch Hetchy In 2012, the senior editor of the Sacramento Bee, Dan Morain, wrote that Lungren had reopened the public debate over draining and restoring the Hetch Hetchy for political ends. Morain wrote that Lungren has never much been associated with the environment, but he faces a well-funded Democratic challenger, Ami Bera, in a swing seat this year. Trying to remedy one of the worst environmental travesties in California knows no partisan bounds, a Lungren campaign aide, Rob Stutzman, told Morain. [Op-Ed, Sacramento Bee, 2/15/12] Accused of Favoring Having Californians Pay Up to $10 Billion to Dismantle the Water System In 2011, Lungren was accused of favoring having Californians pay up to $10 billion to dismantle a water system that serves 7 percent of the states population. Ed Harrington, general manager of the San Francisco Public Utilities Commission responded to Lungrens claim that San Francisco could be doing much more to use recycled water. Harrington wrote, his environmental epiphany is less about the environment or the efficient use of water. It is more about sticking it to San Francisco and having Californians pay up to $10 billion to dismantle a water system that serves 7 percent of the states population. The paper wrote But the city uses almost none of its own groundwater anymore. It does little to harvest rainwater, and its water reclamation efforts are minuscule. Lungren asked asking Interior Secretary Ken Salazar to look at whether San Francisco was breaking its agreement regarding the water. The LA Times acknowledged that Lungrens motivation was not to make San Francisco a better water citizen, but said, the Interior Department should investigate anyway. Lungren advocated for dismantling OShaughnessy Dam and restoring Hetch Hetchy Valley to its original state. [Editorial, LA Times, 1/15/12] Advocated for Restoring the Hetch Hetchy Valley Which was a Reservoir Providing Water to San Francisco In 2012, Lungren advocated for blowing up the Hetch Hetchy Reservoir, which provides San Franciscans and 1.7 million other Bay Area residents. The second Yosemite Valley that Lungren advocated for was in Yosemite National Park - buried under 300 feet of water. The Schwarzenegger administration in 2006 estimated the cost at $3 billion to $10 billion. Lungren said he was advocating for an environmental cause, while his critics countered he received a zero rating from the League of Conservation Voters and said it was a ploy to position himself as green against opponent Ami Bera.

Opponents of the plan included Sen. Dianne Feinstein and House Minority Leader Nancy Pelosi. Lungren has asked Interior Secretary Ken Salazar to investigate whether San Francisco is violating the 1913 Raker Act, which authorized the dam. Lungren claims that the law requires San Francisco to use other water sources before tapping the Tuolumne. These include toilet-to-tap water recycling, rainwater harvests and groundwater. Urged to Rally Bipartisan Support for Natomas flood control project, even Though Project Not in New District In 2011, Lungren may have complicated the need for bipartisan support for the Natomas flood control project by writing a letter to Supervisor Serna. Lungren criticized Serna, but the Sacramento Bee defended him. Lungren also advocated for the Auburn dam, but the Sacramento Bee reported that Congress was unlikely to support the dam. Due to new redistricting maps, Lungren will not continue to represent part of Natomas after 2012. But voters in his newly redrawn district will nonetheless be watching to see if he uses his status in the House to break this logjam and help a vulnerable part of the Sacramento region. To do so, he needs to act in bipartisan fashion, focus on the task at hand and not engage in side agendas.

Favored Putting Water Source in Jeopardy to Restore Valley In 2011, the headline of a story read Drain it! Pay More for the Water! The Hetch-Hetchy Saga Continues. Lungren argued that due to his love affair with Yosemite the Hetch-Hetchy valley currently holding San Francescos water supply should be drained so that the valley can be restored. The possibility that we might have a second Yosemite Valley is something that at least I believe ought to be looked at. And yet everyone who opposes us seems to be afraid of looking at the facts. Opponents have said the plan would be too costly and detrimental to the water supply. War on Women Group Targeted Lungren Position on Birth Control Support In 2012, a press release was issued that the group Unite Against the War on Women was targeting Lungren at a Sacramento rally. The release said Lungren led the charge to claim nationwide coverage of birth control is an affront to religion. [San Francisco Chronicle, press release, 4/28/12] Criticized Rule Requiring Religious Employers to Contribute to Contraception In 2012, Lungren criticized the White Houses compromise on a rule that required religious employers to provide access to birth control. Lungren alleged that under the White Houses accommodation, the religious employer continues to pay premiums that contribute to the revenues of the insurers. The money paid by religious employers for what will inevitably be higher premiums thereby frees up insurer funds to pay for abortion-inducing drugs, sterilization, and contraception in violation of their strongly held beliefs.
