128-20.PROHIBITINGTHEFEEDINGOFWILDLIFEANDREGARDINGWASTEDISPOSALA.Definitions.Thefollowingwordsandphrases,wheneverusedinthisOrdinance,shallbeconstruedasdefinedinthissection:1.Premises-meansproperty,realorpersonal,owned,occupied,leased,orexpresslypermittedtobeusedbyaperson,withinthelimitsoftheCityofNorthampton,includinganyconfinedareaorlocalitysuchasaresidence,business,room,shop,building,motorvehicle,refusecontainer,dumpsterenclosure,garbagecans,orcompostsite,subjecttotheexceptionssetforthinParagraphD,below.2.Person-anyperson,resident,occupier,firm,corporation,orotherbusinessorganization.3.Wildlife-anyundomesticatedandunrestrainedanimalorfowl,includingbutnotlimitedtobears,coyotes,-foxes,raccoons,skunksandotheranimalsorfowlcausing.publicsafetythreats.

4.Wildlife-ResistantRefuseContainer(WRRC)-afullyenclosedcontainerthatcanbeconstructedofpliablematerialsornon-pliablematerials(e.g.,steel),butmustbereinforcedtodeteraccessbywildlife.Thecontainermustemployasturdylidthathasalatchingmechanismpreventingaccesstoitscontentsbywildlife.5.Wildlife-ProofDumpsterEnclosure(WPDE)-afullyenclosedstructureconsistingoffoursidesandarooforcoverofsufficientdesignandconstructiontopreventaccessbywildlife.Thedoororcovermusthavealatchingmechanismsufficienttoprevententrybywildlife.Thesidesofthestructuremustextendtowithintwoinchesoftheground,andventilationopeningsmustbecoveredwithaheavygaugesteelmeshorothermaterialofsufficientstrengthtopreventaccessbywildlife.Meshopeningsshallnotexceedone-quarterinchinwidth.
B.
FeedingofWildlifeProhibited1.Nopersonshallintentionallyorknowinglyfeed,use,place,provide,give,expose,deposit,scatter,distribute,leaveorstoreanyrefuse,foodproduct,petfood,orother--materialornutritivesubstanceonanypremisesinamannerwhichwouldconstitutealure,attraction,orenticementofwildlifeonpropertywithinthecityofNorthampton.Feedthatisdepositedbynaturalvegetationorfoundsolelyasaresultofnormalagriculturalorgardeningpractices,aswellasstandingcropsplantedandleftstandingaswildlifefoodplotsthatmaybeusedbywildanimals,isnotconsideredfeedingfortbe------purposesoftheseregulationsand-isallowed.2.ThepersonsresponsibleforenforcingthisOrdinanceshallmonitorandrespondtocomplaintsaboutwildlife.Thelandownerorpersonresponsibleforpremiseswhereproblemswithwildlifefeedinghaveoccurredwillbenotifiedofthecomplaintandofferedsuggestionsforremediationbytheenforcingpersons.3.Failureofapersontorespondtoanoticeofcomplaintwithin14daysmaybeconstruedasevidencethatthewildlifefeedingwasdonewiththeknowledgeorconsentofthelandownerorresponsibleperson.C.ConditionsRequiringNewContainersorEnclosures1.Intherespondingtowildlifecomplaints,theenforcingpersonsshallmakeadeterminationwhetherornotrefusecontainersonthepremisesarethesourceofthewildlifefeedingproblem.2.Ifrefusecontainersaredeterminedtobethesourceofthewildlifefeedingproblem,thelandownerorpersonresponsibleforthepremiseswillberequiredtoreplacethemwithaWRRCorWDPEasdefinedinthisOrdinance.Failuretocomplywith

maybeexposedanddoorsmustbekeptclosedandlatchedwithawildlife-proofmechanismexceptwhenloadingorremovingrefuse.Ifdamaged,allowingaccessbywildlife,repairsmustbemadetotheoutdoorcompactorwithin24hoursafterwrittennotificationbytheCityofNorthampton.D.Exceptions-ThefollowingentitiesoractionsareexemptfromtherequirementsofthisOrdinance:1.Anyindividual,companyorcorporationthatisdulylicensedbytheCommonwealthofMassachusettsorentitledunderlawtopossesswildlifeofanykind.2.AnyactionthatisofficiallysanctionedbytheCommonwealthofMassachusettsthatwouldrequirefeeding,baiting,orluringofwildlife(i.e.,capturingandtaggingwildlifeforscientificprojectsandstudy).3.Anyindividual,company,orcorporationthatisengagedinlawfulagriculturalpursuits,includingbutnotlimitedtogrowingcrops,cropbearingplantsorraisinglivestock.4.Thisordinanceshallnotbeinterpretedsoastoprohibitbirdfeeders,providedthatifabirdfeederisdeterminedtobethefeedingsourceof
