2008 REVISED STUDENT ELECTION CODE OFDE LA SALLE UNIVERSITY - DASMARIÑAS ARTICLE IGeneral ProvisionsSection 1.
Title 
.
 This Code shall be known and addressed as the2008 Revised Student Election Code of De La Salle University-Dasmariñas (DLSU-D).
Section 2.
 Applicability.
 
 This Code shall govern the StudentCommission on Election (SCE); political parties, candidates andstudents prior, during and after the election period; electoralprocess and to the extent appropriate to all plebiscites in theUniversity Student Council (USC) and all College StudentCouncil (CSC).
 ARTICLE IIThe Student Commission on ElectionSection 3.
Student Commission on Election 
. 
 There shall be anelectoral board, which shall be called the Student Commission onElection, hereinafter referred to as the SCE. The latter shall be anindependent and autonomous body. For the purpose of this section, the term
independen 
tmeans free from any encroachment coming from the schooladministration and other institutional sectors. The term
autonomous 
shall be defined as the state of having limited self-government as defined by this Code. 
Section 4.
Funding.
Every regular semester, ten (10) pesos perstudent shall be automatically transferred from USC trust fund tothe account of SCE. Additional funding may be requested by SCE for the second semester subject to the approval of USC. 
Section 5.
Composition of the SCE.
 
 The SCE shall be comprised of:
 
Commissioners, composed of one (1)chairperson, one (1) co-chairperson and seven (7)regular commissioners;
 
Officers, composed of one (1) secretary andone (1) treasurer;
 
College Heads; and
 
SCE Members.For the purpose of this section,
SCEMembers
shall refer to those who are notCommissioners, Officers and College Heads. On theother hand,
members of the SCE
shall refer to theCommissioners, Officers, College Heads and SCEMembers.
Section 6.
Manner of Creation of the SCE.
  The SCE Commissionersshall be identified by the incumbent SCECommissioners  within  thirty (30) calendar days before the start of the term of office of the incoming SCE. The guidelines shall be formulated by theincumbent SCE Commissioners
Section 7.
Qualifications of the Commissioners and Officers 
. Thefollowing are the qualifications of a commissioner and officers.No SCE member shall be a commissioner or an officerunless1)
 
He or she must have been a student of the University for atleastone (1)year immediately preceding the appointment.2)
 
He or she must have not been found guilty of committing any major offense as defined in the University StudentHandbook.3)
 
He or she must have not been found guilty of committing any election offense as defined in this Code.4)
 
He or she must have obtained a GPA of 1.5 or higher, withno failing grades in any subjects enrolled during the semesterimmediately preceding in.5)
 
He or she must not be an officer from any student grouprecognized by the University.

He or she mustnot be amember or a supporter, directly orindirectly, of any accredited political party of the University.7)
 
He or she must have completed the SCE technicalrequirements such as:a.
 
 Accomplished application formb.
 
Certificate of Good Moral Character from Office oStudent Services (OSS)c.
 
 Three (3) 2x2 picturesd.
 
Certification of Grades last semestere.
 
Photocopy of registration formf.
 
Formal written parental consentg.
 
Underwent a screening thru a panel interview to beconducted by the incumbent commissioners
Section 8.
Qualifications of the SCE members.
 No student shall beadmitted to the SCE as a member unless1)
 
He or she is a bona fide student of the University immediately upon application for membership.2)
 
He or she must have not been found guilty of committing any major offense as defined in the University StudentHandbook.3)
 
He or she must have not been found guilty of committing any election offense as defined in this Code.4)
 
He or she must have with no failing grades in any subjectsenrolled during the semester immediately upon theapplication for membership.5)
 
He or she must not a member or a supporter, directly of indirectly of any accredited political party of the University.6)
 
He or she must have fulfilled the SCE technical requirementssuch as:a.
 
 Accomplished application formb.
 
 Three (3) 2x2 picturesc.
 
Certification of Grades last semesterd.
 
Photocopy of registration forme.
 
Formal written parental consentf.
 
Underwent a screening thru a panel interview to beconducted by the incumbent Commissioners For purposes of this Section, a bona fide student means thathe/she is currently enrolled in this University.
Section 9.
Manner of Selecting Commissioners 
. To qualify as an SCECommissioner, he/she must have met the following qualifications: a.
 
Must be a current SCE Member for at least one (1)academic year.b.
 
Must have complied with Sec 7 of Article II of theElection Code.c.
 
Must have been recommended by an incumbentCommissioner.d.
 
Must get the support of the majority of both theincumbent Commissioners and SCE Membersthrough secret ballot.e.
 
Must not have been found guilty of committing any major offense as defined in the University StudentHandbook.f.
 
Must have not been found guilty of committing any election offense as defined in this Code. At no point shall there be more than five (5)commissioners who are graduating during their term of office. An SCE member who is nominated by his fellow members to become a Commissioner but fails to secure arecommendation of an incumbent Commissioner, must obtain atwo-thirds (2/3) vote of the SCE members to become aCommissioner.
Section 10.
 Adviser.
 a.
 
 The SCE shall have an adviser from De La SalleUniversity-Dasmariñas who is a regular full-timefaculty member.b.
 
 The SCE adviser shall be chosen from among thethree (3) nominees submitted by the SCE. Thenomination shall be made after the incoming SCECommissioners have been identified, but not laterthan the start of term of office of SCE.Theadministration, through the Dean of Student Services,appoints the adviser.

 The SCE adviser shall have a term of one year, whichshall commence on the same date as the term of office of the incumbent SCE.d.
 
 The SCE adviser shall have the following functions:d.1 Advise the Student Commission onElectionsd.2 Maintainliaisebetween the SCE and the Administrationd.3Maintain close relations with the SCE andtheir duties in accordance with the goals andprinciples of the Commission. e.
 
 The SCE adviser shall have no voting power in themeetings and deliberations of the Commission. 
Section 11.
Term of Office. 
 The term of office of the SCE shall be forone academic year, its commencement shall concur with the termof office of the USC officers as defined in the 2008 USCConstitution. All commissioners and officers are entitled toreappointment. 
Section 12.
Vacancy.
Permanent vacancy in any SCE position may occur in any of the following circumstances:a.
 
Impeachment of any commissioner in accordance with Article XIV of this Code;b.
 
Resignation from office;c.
 
Obtaining a failing grade during his/her term;d.
 
Have been found guilty of a major offense asdefined in the Student Handbook; ande.
 
Conviction of any Criminal offense by a regularcourt;Likewise, temporary vacancy may occur in any of the following circumstances:a.
 
Having an official business of any officer/s,commissioner/s or SCE member/s outside theUniversity; andb.
 
Filing a leave of absence 
Section 13.
Rules in Filling Up of Vacant Positions.
In case of temporary or permanent vacancy of the position of theChairperson, the co-chairperson shall act or assume the officesimultaneously.
 
In case of temporary or permanent vacancy of theposition of the Co-chairperson, the seven (7) commissioners shalldecide who among them shall assume the position. Whenever there is a permanent vacancy in the position of any Commissioner/s, the College Head, from which the removedCommissioner is previously assigned, shall assume the positionupon a confirmation by a majority vote of the remaining Commissioners. The position of the College Head, however, shallbe filled up by any SCE member.
 ARTICLE IIIPowers, Duties and ResponsibilitiesSection 14.
Scope of the Powers, Duties and Responsibilities.
 TheSCE shall exercise jurisdiction over all matters pertaining toelections, plebiscites and referenda within this Code.
Section 15.
 
Decisions of the SCE.
 
 The SCE may sit en banc or inthree divisions, each with three (3) commissioners, and shallpromulgate its rules of procedure in order to expeditepromulgations of resolutions and decisions, disposition of election cases, including pre-proclamation controversies. All such election cases on the College Council-level shallbe heard and decidedby adivision, provided that appeal from thedecision of the division shall be decided by the Commission enbanc, while USC-level issues and cases shall be decided en bancand such decisions shall be appealed to the Magistrate which shallrender a decision within five (5) working days upon receipt of theappeal.Issues, petitions, cases and actions that concern or affectpolitical parties, their registration and accreditation, dissolution,disqualification, membership and operations shall be decidedby a division.Cases shall be raffled by the SCE Chair in the presenceof at least a majority of the Commissioners;provided, that theassignment of cases shall be made as evenly as possible.
