AN ACTSTRENGTHENING THE PHILIPPINE DISASTER RISK REDUCTION ANDMANAGEMENT SYSTEM, PROVIDING FOR THE NATIONAL DISASTER RISKREDUCTION AND MANAGEMENT FRAMEWORK AND INSTITUTIONALIZING THENATIONAL DISASTER RISK REDUCTION AND MANAGEMENT PLAN,APPROPRIATING FUNDS THEREFOR AND OTHER PURPOSES
Be it enacted by the Senate and the House of Representatives of the Philippines inCongress assembled:
SECTION 1. Title
 – This Act shall be known as the
“Philippine Disaster Risk Reductionand Management Act of 2009.”Sec.2. Declaration of Policy –
It shall be the policy of the State to:(a) Adhere to and adopt the universal norms, principles, and standards of humanitarian assistance and the global effort on risk reduction as concreteexpression of the country’s commitment to overcome human sufferings due torecurring disasters.

(b) Uphold the people’s constitutional rights to life and security by addressing theroot causes of vulnerabilities and increasing their capacities and enhancingtheir overall resiliency to disasters.(c) Uphold the supremacy of civilian authority over the military particularly in thecontext of complex emergencies and human-induced disasters.(d) Institutionalize the policies, structures, coordination mechanisms and programswith continuing budget appropriation on disaster risk reduction from nationaldown to local levels towards building a disaster-resilient nation andcommunities.(e) Mainstream disaster risk reduction into physical and land-use planning, budget,infrastructure, education, health, environment, housing, and other sectors.(f) Adopt and implement a coherent, integrated, proficient and responsive disaster risk reduction program integrated in the development plan at various levels of government adhering to the principles of good governance such astransparency and accountability within the context of poverty alleviation andenvironmental protection.(g) Adopt an integrated and coordinated, multi-sectoral, inter-agency andcommunity-based approach to disaster risk management that shall be bothanticipatory of and responsive to the socio-economic and environmentalimpacts of disasters including those due to climate change.(h) Recognize and strengthen the capacities of local government units andcommunities in mitigating and preparing for, responding to, and recoveringfrom the impact of disasters.(i) Engage the participation of the civil society organizations (CSOs), the privatesector and volunteers in the government’s disaster risk reduction programstowards complementation of resources and effective delivery of services tothe citizenry.(j) Incorporate internationally accepted principles of disaster risk management in thecreation and implementation of national, regional and local sustainabledevelopment and poverty reduction strategies, policies, plans and budgets.

(k) Recognize the country’s various and particular local risk patterns and the need tocapacitate, strengthen, and decentralize powers, responsibilities andresources for disaster risk reduction and response to regional and localauthorities.(l) Provide maximum care, assistance and services to individuals and familiesaffected by disaster; implement emergency rehabilitation projects to lessenthe impact of disaster and facilitate resumption of normal social and economicactivities.
Sec.3. Definition of Terms
 – As used in this Act(a)
Capacity
 – a combination of all strengths and resources available within acommunity, society or organization that can reduce the level of risk, or theeffects of a disaster. Capacity may include physical, institutional, social or economic means as well as skilled personal or collective attributes such asleadership and management. Capacity may also be described as capability.(b)
Civil Society Organizations (CSOs)
 – are non-state actors whose aims areneither to generate profits nor to seek governing power. CSOs unite people toadvance shared goals and interests. They have a presence in public life,expressing the interests and values of their members or others, and arebased on ethical, cultural, scientific, religious, or philanthropic considerations.CSOs include non-government organizations (NGOs), professionalassociations, foundations, independent research institutes, community-basedorganizations (CBOs), faith-based organizations, people’s organizations,social movements, and labor unions.(c)
Climate Change
 – a change in climate that can be identified by changes in themean and/or variability of its properties and that persists for an extendedperiod typically decades or longer, whether due to natural variability or as aresult of human activity.(d)
Community-Based Disaster Risk Management (CBDRM)
 – refers to activities,projects and programs to reduce disaster risks which are primarily designedby the people living in high-risk localities based on their needs and capacities,in close coordination with their respective Local Disaster ManagementCouncils.(e)
Complex Emergency
 – a form of human-induced emergency in which the causeof the emergency as well as the assistance to the afflicted is complicated byintense level of political considerations.
