ssumingthatObamawas bornintheUnitedStates,hewasnotonlybornadualnationaloftheUnitedStatesandGreatBritain,butatpresenthecontinuestobesuch.SomemaintainthatAmericanlawoncitizenshipcannotbesubjectedtoanyforeignlaw.Butsuchanar-gumentdoesnotresolvetheques-tionofObama’sdualnationality,foreachnationhasthesovereignrighttomakeitsowncitizenshiplawsandonenationcannotdenyanothernationthatright.This pointcanbebetterunderstood whenweconsiderthatMcCainwasborninPanamatoU.S.citi-zenparentsandU.S.citizenshiplawdeclaredhimaU.S.citizeneventhoughhewasborninPana-maandPanamanianlawmayhavedeclaredhimacitizenofPanama. NeitherPanamanoranyotherna-tionquestionedtheUnitedStates’righttopassalawthatgaveMc-CainU.S.citizenshipbydescentfromhisparentseventhoughhewasborninPanama.GreatBrit-ain,beingasovereignnation,hasthesamerightasdoestheUnited Statestopasssuchcitizenshiplaws.NowletusexaminetheBritishlawthatappliestoObamaandhisfatherandwhichmakesObamaaBritishcitizennotonlyatthetimeofhisbirthin1961butstilltoday.The British Nationality Act of 1948 provides in pertinent part as follows:
“4. Subject to the provisions of this section, every person born withinthe United Kingdom and Coloniesafter the commencement of this Act shall be a citizen of the United Kingdom and Colonies by birth: Provided that a person shall not besuch a citizen by virtue of this section if at the time of his birth—(a) his father possesses such immu-nity from suit and legal process asis accorded to an envoy of a foreign sovereign power accredited to His Majesty, and is not a citizen of theUnited Kingdom and Colonies; or(b) his father is an enemy alien and the birth occurs in a place then un-der occupation by the enemy.5.—(1) Subject to the provisions of this section, a person born after thecommencement of this Act shall beacitizen of the United Kingdom and Colonies by descent if his father is acitizen of the United Kingdom and Colonies at the time of the birth ....”
UndertheBritishNationalityActof1948,Obama’sfatherbecameaBritishcitizenunderSection4by beingbornonthesoilofanEnglishColony,Kenya.UnderSection5,whenObamawasbornin1961inHawaiiorsomeotherplace,heau-tomaticallybecameaBritishcitizen bydescentfromhisfatherwhowasaBritishcitizenunderSection4.Obama has deflected attention tohis British citizenship by focusingthe public’s attention on his for-mer Kenyan citizenship. Notwith-standing what Obama may lead the public to believe, this Britishcitizenship is not a type of citizen-ship that he has since lost. More-over, this citizenship did not expirewith Obama’s 21st birthday nor is itonethat had to be registered in anyspecified period of time.Chapter VI, Section 87 of the Ke-nyan Constitution specifies that:
“1. Every person who, having beenborn in Kenya, is on 11th Decem-ber, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall become acitizen of Kenya on 12th December,1963…2.Every person who, hav-ing been born outside Kenya. [sic]is on 11th December, 1963 a citizenofthe United Kingdom and Colo-nies or a British protected person shall. [sic] if his father becomes.[sic] . . . a citizen of Kenya by vir-tue of subjection (1). [sic] becomeacitizen of Kenya on 12th Decem-ber. [sic] 1963.”
UndertheKenyanConstitutionof 1963,Obama’sfatherandObama becamecitizensofKenya.Butnei-therKenya’sindependencefromGreatBritain,northeKenyanCon-stitution,northeKenyanIndepen-denceActof1963,asamended,causedObamatolosehisBritishcitizenshipwithwhichhewasborn.ObamaconcedesthathiscitizenshipconvertedfromBritishtoKenyan butheaddsthathethenlostthisKenyancitizenshipwhenhedidnotconfirmituponreachingtheageof 21.TherearenoknownstatementsfromeitherObamaorhiscampaigncontendingthatheeventuallylosthisBritishcitizenship.Rather,thestatementshavebeenthathisBrit-ishcitizenshipconvertedtoKenyancitizenshipwhenKenyaobtaineditsindependencefromGreatBritainin1963andthathethenlostKenyancitizenshipundertheKenyancon-stitutionandlawswhenhedidnotrenounceU.S.citizenshipatage21.ButsinceObamaneverlosthisBrit-ishcitizenship,itdoesnotmatter thatObamamayhavelosthisKe-nyancitizenshipashecontends.Let us now see how Obama did notlose his British citizenship. TheKenyan Constitution which cameinto effect in 1963 at Article 97 provides the following:
“97. Dual citizenship1.Aperson who, upon the attain-ment of the age of twenty-one years,
Obama is NOT anArticle II Natural Born Citizenand therefore is NOT Eligible to be President
The President and CINC of the USA Must be a “Natural Born” Citizen — U.S. Constitution,Article II, Section 1, Clause 5
No Person except anatural born Citizen, oraCitizen of the UnitedStates, at the time of the Adoption of thisConstitution, shall beeligible to the Officeof President
Per the British NationalityAct of 1948, Obama whenborn in 1961 was a BritishSubject at birth.Obama’s Father was NOTaU.S. Citizen, nor was hean Immigrant to the USA,nor was he even a PermanentResident of the USA.
