The Wade Avenue Connector is a greenway connector/access located along the northernright of way of Wade Avenue extending from the intersection of Wade Avenue andRidge Road to the Reedy Creek Trail at the eastern end of the pedestrian bridge over I-440. This route is located within the Control of Access area of I-440. The use of thisarea for a greenway connector requires execution of a Control of Access Agreementbetween the City of Raleigh and North Carolina Department of Transportation (NCDOT).
Recommendation:
Authorize the City Manager to execute the agreement.

The American Recovery and Reinvestment Act of 2009 (stimulus package) has madefunding for drinking water and wastewater infrastructure available through the NorthCarolina State Revolving Fund. The Public Utilities Department has identified thefollowing capital projects as candidates for funding under this program:Solar Powered De-stratification Mixers on Lake Benson $392,000Solar Powered Potable Water Storage Tank Mixers $1,846,232Lake Johnson Dam Improvements $3,780,000Crabtree Creek North Bank Interceptor Sewer Replacement $11,000,000Cemetery Branch Sanitary Sewer Interceptor Replacement $2,876,581Southeast Beaverdam Creek Sanitary Sewer Interceptor Replacement $2,000,000Southeast Raleigh Reuse Distribution System Expansion, Phase 3 and 4 $7,000,000Dempsey E. Benton Water Treatment Plant Backwash Waste Facility $6,300,000The Public Works Department, Stormwater Division, has identified the following capitalprojects as candidates for funding under this program:Rainwater Harvesting at Fire StationsEnhanced Stormwater Infiltration at the Market at ColonnadeUpper Longview Lake and Stream Rehabilitation ProjectFunding will be made available based on a priority ranking system for each project.Projects selected by the State for funding will be eligible for up to $3,000,000 in loans orgrants. The loans are to be structured with 50% principle forgiveness and 50% at a 0%

interest rate. The remainder of the project costs will be funded through the PublicUtilities Capital Improvements Program. In order to apply for the loans, Council isrequired to adopt a resolution to arrange for financing for the remainder of the projectcosts, maintain a user charge system adequate to repay the loan, properly operate andmaintain improvements, assign an authorized representative to execute the loandocuments, and comply with all applicable Federal, State and local laws.
Recommendation:
Adopt the resolution.

In 2003 the North Carolina Legislature enacted General Statute (GS) sec. 99E-21, et seq.to protect government entities and encourage the provision of facilities for skateboarding,inline skating and freestyle bicycling. Staff proposes new language that will require usersof a City of Raleigh skate park to wear a helmet, knee and elbow pads as specified by theGS, and that these requirements be posted on site. Rules for the skate park, consistentwith the proposed ordinance have been developed and are in the agenda packet.
Recommendation:
Adopt the ordinance and immediate implementation of the rules consistent with GS sec.99E-21, et seq.

The City has been working with the North Carolina Department of Transportationregarding the relocation of water lines as part of the roadway improvements for theAustin Creek Bridge (B-3919; Bridge No. 448) and the Smiths Creek Bridge (Bridge No.140) on SR 2053 (Jones Dairy Road) in the Raleigh service area. The relocation of thewater lines is necessary to move them beyond the proposed roadway improvements bythe Department. The amount of this agreement is $320,810.
Recommendation:

The Wilders Grove Landfill, permitted and opened in 1972 (NCDENR Permit No. 92-01), is owned and operated by the City of Raleigh. This unit was active until December31, 1997, when disposal operations ceased in order to comply with state regulations. Thefacility is currently in the Post Closure phase.Hazen and Sawyer, under contract to the City, prepared the Assessment of CorrectiveMeasures (ACM) Report for the Wilders Grove Landfill and submitted it for review andapproval by the State of North Carolina in accordance with 15A NCAC 13B .1634. Thereport was approved by the State in September 2007 pending a Public Hearing and formalapproval of the selected remedy by the City.
