HISTORY / OVERVIEW:
Amends the Zoning code to comply with recently enacted State legislation, Session Law 2009-321(Senate Bill 44). The text change primarily addresses quasi-judicial proceedings related to site plans andsubdivisions.

Amends the review process and standards of approval for site plans and subdivisions.
•
Strengthens the link between the standards of approval in the zoning code and the approvalprocess.
•
Identifies the appeals process and notification requirements for site plans and subdivisions.
•
Describes the scope and conduct of quasi-judicial proceedings. Appeals of administrative orPlanning Commission decisions would be heard by the City Council. These appeals would be denovo quasi judicial proceedings.

SCOPING OF IMPACTS:Potential adverse impacts of the proposed text change have been identifiedas follows:
The text change will change the approval process for site plans and subdivisions.Administrative and Planning Commission decisions could be appealed to the CityCouncil. These City Council proceedings must then be conducted as de novoquasi judicial hearings. This could result in additional hearings for City Council.
