Cool Trees Rebate Application,Agreement and Release
I am a PWP residential electric customer and have elected to participate in the Cool Trees Program. I have read the Cool Trees Program Guidebook and understand propertree selection, site planning, and care techniques. I drafted a site-specific plan for my home to strategically place my new shade tree(s) in areas where the tree(s) will createnatural cooling.I will call Underground Service Alert at 1-800-227-2600, at least two working days prior to planting, to receive assistance in best planting locations and to have my under-ground utility lines marked. Prior to planting, I checked the location of overhead and underground utility lines to make sure the new tree(s) on my property will not interferewith them. This service is free of charge. I will properly plant the tree(s) in the proposed location(s) indicated on my site plan within two weeks of purchase in order toencourage growth. I will not plant trees within the “no-plant” zones (near infrastructure) within and around my property.I will care for the tree(s) at my home, including following the correct procedures for watering, weeding, pruning, and inspecting, to ensure the growth of (a) healthy tree(s).Trees obtained through this program belong to me and do not belong to the City of Pasadena. The trees are private trees, not City trees, and the City is not responsible forthem. I will consult with a private arborist of my own choosing on all tree questions, including planting (location, overhead utility lines and underground utility lines),maintenance, inspections, and tree safety.I agree to release, defend, indemnify and hold harmless the PWP, the City of Pasadena, its directors, officers, employeesandagents,treeplantinginstructors,treeplantingguideauthorsandreviewers,andotherprogramrepresentatives and contractors, from any claims, expenses, actions or liability arising from participation in this program,including planting, inspection, maintenance and the presence of tree(s), and from all responsibility for damages (including damage to the home’s foundation and other landscapefeatures, damage to underground lines of utilities or others, and any other damages), and personal injury or death (including from falling limbs or trip and fall hazards createdby roots).I certify that I am the legal owner of the property listed below and that this Agreement and Release applies to me and to my successors in interest, and shall run with theland. Complete, sign and mail this application toPWP along with a copy of the store receipt.(Application must be received by PWP withinsixty days of purchase date.)If your application is approved, your rebate check willarrive within 6 to 8 weeks. This program is subject to verification of the purchase and installation of thetree(s).
