State of Florida vs.Ueorge ZimmernulIJ Case No.: 2012-001033-CIl'A

Your Honor: Please accept this as response to the inquiry regarding the existence and availability of"kgal defense funds" during the time just before and just after the hond hearing on April 20, 2012. I have enclosed for your review a summary page entitled "Monthly Sales Report for the month of April 2012", which documents the inflow of monies into the Payl'al account during its active time period (Exhibit A). As can be seen, the first monies were deposited on 4/9/2012, and the last monies were deposited on 4/2712012. Of note is that. while these monies would have been identified as transactions on (he dates ofthis report, those monies would not actually have been available in the account for several days, as a transaction delay.
$ I97,773,13. Please note that M(. Zimmerman was, as documented by the Florida Department of Law Enforcement,

The report documents that $205,637.96 was received, and fees and refunds reduced the amount in the account to

traveling in hiding up until the day he was met by FDLE agents so they could effectuate the-arrest on April 11.2012 .. Next, [ have included copies of both Mr. Zimmerman's and Shellie Zimmerman's hank account statements for the relevant lime period, (Exhibits B and C). As can be seen, monies were forwarded into Mr. Zimmerman's account and then moved over to Ms. Zimmerman's account during that time period, While an initial review ofthese bank statements suggest some curious transfers of $9.990.00 (Of similar amounts) from one account to the other, the explanation is quite simple .. Payl'al only allows transfer' less than $1 O,OOO.OOto through the account at anyone go time, and what was occurring was those monies were transferred from the PayPal account into these two accounts (and on occasion, into his sister's account) in order to accomplish moving the money from Payl'al into the personal accounts. The monies were finally amassed in Mr. Zimmerman's account. 1t was Mr. Zimmerman's brother-in-law, Scott Wilson, who was administering transfers between the accounts as, again. George Zimmerman was not available. these funds, and handling the

The results of this, which would be of particular relevance to this Court, IS that as of the date of the bondhearing, April 20,2012, the Zimmerman accounts had approximately $120,000.00 to $130;000,00 available within them (variables being the transactions delays and that some funds were being used during this time as well). The testimony by Shellie Zimmerman, and as corroborated by Mr. and Mrs. Zimmerman, Sr., supported that the parties were of meager means. At tint blush, this would certainly seem to be inconsistent with the fact that a large amount of money was available to them in their accounts at the tittle of that testimony. As explanation for that perceived inconsistency, I would offer the following: After thtl bond was granted at $150,000.00, I had ongoing conversations with the Zimmerman family and Shenk

The Honorable Kenneth R. Lester, .11'. May 18,2012 Page Two Zimmerman regarding attempting to accomplish a bond. During the first 36 hours, it took an enormous amount of effort from me to convince the Zimmerman family to trust utilizing a bail bondsman to help accomplish George's release. I convinced them that this was the appropriate way to handle this, and (to my knowledge at that point) the only way to secure his release. Before I was able to convince them to use a bondsperson, they had been attempting to secure second mortgages on both the Zimmerman Sr ..residence and George's grandmother's residence in order to accomplish coming up with necessary $150,000.00 in cash. I offer this information at this point because had they believed tbat they had free access to the funds in their account, they could easily have used that money to accornpl ish their goal of gathering together the full $150,000.00. Again, they never did that, Rather, the rationale the Zimmerman family seemed to have was that the money sitting there .. as given to them to support their living expenses and necessary legal expenses, but was not simply available to them for whatever other purpose they may want. Further, anecdotal evidence supporting this is that even when they decided to utilize the services of a bail bondsperson, they decided to take $5,000.00 from this fund and still owe an 'additional SI0,000.00, rather than simply remove a full $15,,000,00 from these funds. As further documentation of their judicious use ofrhose funds (as compared to unfettered use of'those funds), Ihave enclosed a listing of expenses taken our of'that account during the relevant time period (Exhibit D). As can be seen from that list (titled "total deposited into my account from Payl'al" ), there are the following expenditures: Firstly, there was only $177,790.00 actually put Into the account because there is still some $20,000,00 being processed by PayPal. The second entry identifies the $122,393.00 which was forwarded to me upon request (this represents the entire amount: left in the account minus the $20,000.00 cash which is identified as the third entry). The $20,000.00wa5 based on my suggestion that they hold on to a certain amount of money for ongoing incidentals. The list documents that the majority 0 fthe expenses were that they had to purchase a Wi- Fi service for $370.00; spend $800.00 at the jail commissary; paid off a $.3,900.00 American Express bill for various expenses incurred because of their forced move out of the home; purchase prepaid phones; paid car payments; utilities; vehicle maintenance; airfare; groceries; dog care and Fedl-x expenses. They also repaid a $J,OOO,OO loan to a family member for additional debt that they incurred during the intervening time when they had 10 leave their home and go into hiding. I believe it is also relevant to acknowledge to this Court what was stated on record concerning my knowledge of the monies in these accounts. As stated, 1 became aware of the funds on the following Tuesday, April 24, during a conversation with Mr. Zimmerman regarding closing down his entire internet presence. Upon identifying that these funds existed, he immediately forwarded the entirety of those available funds (minus the $20,000.00 referenced above) to be held in trust upon my request. Again, I think that this is further evidence of Mr. Zimmerman's position that. though these funds were "available" to him, they could only be used for particular purposes. 1mention that at this point because though it does seem that those funds were 'available' to the family at the time of the bond hearing, that money is certainly nat available to them at this point, as have been secured and being handled by a third party administrator. Of further note is that based upon the existence of these funds, 1 do not believe H appropriate that Mr. Zimmerman seek a finding of indigene)! at this point, unless and until those funds

are exhausted ..

In sum, while I understand the question that there was not full disclosure of these "trust" funds, I would ask that the court consider that to be a non-material failure to disclose based upon the evidence of how they handled themselves and, more particularly, how they handled those funds both before and after the bond hearing. I would note that I haw redacted certain portions of the bank records in order to maintain security, though J have uri-redacted copies available for 'in camera' review ifnecessary. Finally. I removed some of the language from one particular expense of $2.500.00 on the list of expenses, as that might be information helpful in identifying Mr. Zimmerman's whereabouts. Thank you very much for your time and consideration to this matter.
