Material Ignited: Explanation: 1. On Wednesday July 18. 2012 at approximately 1035 hours, the Ludlow Police Department responded to 795 center Street in the Town of Ludlow for a well being check. Upon Officer DeBarge's arrival he observed smoke emanating from the one story, single family, ranch Slyle home. The Ludlow Fire Department was requested.
2. On same date at approximately 1040 hours, Ludlow Fire Department arrived and encountered smoke puffing from the garage and eves of the home. Fire fighters made entry and contained the fire damage to the center of the home in the area of the kitchen. Several searches for the resident of the home were with negatiVe results.

3. On same date, at appfoximafely 1100 hours, this officer was contacted by Chief Babineau who requested the assistance of the state Flre Marshal's Office. Ohief Babineau reported that they had suppressed the fire and that they W1J(econtinuing to search for the resident 01the home. later identified as, STUART, George W., who was considered suicidaL 4. On same date at approXimately 1215 hours, this officer atrived on scene and met with Chief Babineau and Capt. Lavoie. At that time, this officer learned that the 275 gallon oil tank in the basement had been tampered with resulting in a large oil spill. Fire fighters also found a 20lb propane take in the front seat of the passenger compartment of the Cadillac sedan parked in the attached garage. This officer was funher informed that the home owner. STUART, had since fled into the wooded area at the rear of the property and was in the possession of a firearm. This officer also learned that STUART had been scheduled to appear in probate court earlier in the day and failed to show. STUART, an expert marksmen, had made other indicatOrs that he may be attempting to harm himself. It was determined at that time that the scene would remain secure until the area surrounding the home could be made safe

5. Police officers located and surrounded STUART in the wooded area. An 8 112 hour stand off ensued. STUART later suffered from a self Inflicted gunshot wound and was transported to Bay Slate Medical Center in Springfield. 6. On same date, at approximately 2002 hOUTS. ttle fire scene examination commenced by Capt .Lavoie and troopers assigned to the State Fire Marshal's Office. At that time, an exterior exam of the home indicated that the greatest fire damage was towards the rear and center of the home. The interior examination revealed that the greatest fire damage was in the kitchen table area of the home. An AK-9 search of the dwelling r'9Vealed positive alerts to the 1toor next to the kitchen table, the kitchen countertop, the computer desk in the kitchen and the living room carpet. Fire was set to the top of the kitchen table and contents thereof. along with the floor surrounding same. EYldence of US currency was noted as being burned on the counter top and atop a stool next to the counter. Also noted on tile counter top at the location of a AK 9 alert was the charred remains of scrapbooks covering the police career of STUART. Fire spread outwards towards the kitchen, sun porch. living room and center hall way. A further examination revealed that the 275 gallon oil tank in the basement had been tampered with. pre fire. causing an introduction of an unknown quantity of home fuel oil to the basement of the home. Also noted was that the pull down stairwell in the garage was in the open position and that the heating duct work in the living room was open both in an attempt to spread the fire. Located in the picnic table area of the back yard were two. 4 It glass jugs filled with gasoline.

7. The following samples were secured for further testing and analysis: 1 Carpet and foam from the floor beneath the left side of the kitchen table. 2. carpel; foam, and mouse pad from living room floor. 3. Control sample of carpet and foam from living room next to garage wall. 4. A melted plastic container frorn the floor area along kitchen table. 5 The liquid contents frOm two 4 It jugs secured from picnic table area. 8. On same date, Officer Fernadez discovered a roll of paper towe1s along with a long charcoal griU ligoter in the, rear yard jUst into the WOOdline. Same were secured and later turned over to Tpr, Percy.
9. On same date. at approximately 2300 hours, Tpr. Cahill arrived back from Bay State Medical Center. Tpr. Cahill had in his possession the clothes secured from STUART by hospital personnel. A K 9 Search of same resulted in a positive alert to the right shoe. Same was later secured and submitted for further

analysis.

10. It is the opinion of this officer that the fire was inrendlary in nature. The cause was the application of an open flame to an unknown quantity of gasoline spayed and or poured onto the kitchen table and surrounding area.
11. At this time, this officer respectfully requests that this case be closed pending any new information which would warrant same being re-opened.

NARRATIVE FOR PATROL ALISON M METCALFE (A) 12-687-0F

On July 18,2012, I was contacted by dispatch to respond to 795 Center St. for a dwelling fire and attempted suicide. My responsibilities were to control the residence/crime scene. Working with me during this investigation were Detective Sergeant Thomas Foye, Trooper Mike Mazza from the Fire Marshall's Office and Trooper Paul DiPietro from the District Attorney's Office's Investigative Unit. At approximately 1920 hours I heard two shots being fired. Officers proceeded in the direction of Stuart's location, where it was found that Stuart had shot himself. When George Stuart fired his weapon, he was at the stone wall at the back of his property. This location is 361' from his dwelling and is believed to be past his property boundaries. I had the opportunity to interview Chief James McGowan, who was alongside George Stuart at the time. Chief McGowan explained that George Stuart discharged the weapon, striking himself. A written statement from Springfield Police Commissioner William Fitchet, who was also alongside George Stuart, corroborated Chief McGowan's statements. George Stuart will be charged accordingly for discharging a firearm within 500' of a dwelling.

I was handed Stuart's weapon by Springfield Swat Officer Greg Bigda, who recovered it from the ground next to Stuart. This weapon, a Smith and WessonBf Special, had two spent shell casings and'three live rounds in the
revolver: All items were tagged accordingly and placed into the secure evidence room. .

Lisa K watowski, George Stuart's daughter, provided us with a packet of papers that Stuart had mailed to her mother, Rena Stuart. Rena Stuart is George Stuart's estranged wife. The packet included "the last statement and thoughts of George Stuart." George wrote in first person the problems he has had with Rena over the years. Stuart indicated that he had to be buried on Saturday, July 21, 2012, the day of Rena's birthday. He also stated that he had to "wrap it up so he can prepare the house, car, sheds, and me for the grand finale." This entire document is attached. Also attached is a letter he had written to his daughter, Lisa, explaining the problems between he and his wifelher mother. The Fire Marshall's Office conducted their investigation and took the evidentiary items pertinent to their arson investigation. According to family members, there were many weapons in the house. There were a total of 20 weapons recovered from the home as well as miscellaneous ammunition. Troopers Jeff Cahill and Peter Konstantakos responded to Baystate Medical Center and at 2021 hours collected George Stuart's clothing items and the gold chain he was wearing. Those items were also tagged and placed into the evidence room. All items collected by the Ludlow Police Department sheet. At approximately 10:14 AM, Jeffrey Roberts ~came into the police lobby to report that his friend, George Stuart, had intentions of ending his life due to marital/family problems. While gathering information from Mr. Roberts, I dispatched Officer DeBarge to Mr. Stuart's residence to conduct a welfare check. I asked Mr. Roberts to provide a written statement (attached) and I then proceeded to the residence. While enroute, Officer DeBarge report heavy smoke emanating from the Stuart residence at 795 Center Street. Upon my arrival, I observed the home to be completely filled with heavy black smoke. Officer Fernandes also arrived to assist The fire department arrived and began extinguishing the fire and were advised that Mr. Stuart was suicidal and that he may be in the home. Officer Fernandes began checking to sheds in the rear of the property and found open containers of what appeared to be gasoline. The fire departrrient reported that they did not locate anyone in the home, but did find propane tanks with open valves located in the home. At this point, based on the information that was provided by family that Mr. Stuart had several firearms, was suicidal, and was mentally unstable, I decided to discontinue a search of the property and maintain a perimeter until such time that additional personnel could be called in. I then conferred with Off. DeBarge and it was determined that the Special Response Team should be called in to conduct a search of the shed and surrounding area at the rear of the property as it was possible that Stuart may have been hiding there. While maintaining our perimeter, I advised the station to contact the Air Wing of the Massachusetts State Police to conduct a search of the extensive wooded area located behind the property. I also requested our canine unit and that Center Street be closed down due to the unknown nature of weapons that the suspect may have in his possession. I was further advised through friends and family that Stuart was an expert marksman and a former police sergeant in Springfield. As the operation progressed, fire personnel were staged on scene in front of the home for any potential medical needs. While maintaining a visual on the backyard area, Officer Fernandes reported movement behind a stone wall at the right rear section of the property. I then observed the subject near the wall walking back into the woods. I was able to identify that the subject appeared to be George Stuart. I advised all units of my observations and noted that the subject was wearing a gray tank top shirt. At this time, I was met by Lt. Hioms of the Massachusetts State Police who offered his resources. I requested that he have his canine troopers respond to the end of Fox Hill Road, which abuts the wooded area on the northerly side. The Ludlow canine Officer Whitney arrived and the Ludlow SRT also arrived and were briefed. They proceeded to take position in the back yard area half way between the house and the wood line. I then made contact with the State Police helicopter and advised them to search the wooded area behind the home where the subject was last seen. They located a subject midway between the Stuart property and Fox Hill Road. At this time, Springfield Police Commissioner William Fitchet arrived with support staff and I briefed him on the situation. He advised me that he knew Mr. Stuart extremely well, and reiterated that Stuart was an expert marksman and to use extreme caution. In speaking to Commissioner Fitchet, it was agreed that due to his personal association with Stuart, that he attempt to initiate contact with Stuart via the P.A. system of his cruiser with our humvee unit preceding his vehicle for cover. Commissioner Fitchet made several calls via his P.A. system and Stuart acknowledged his calls, but only showed himself briefly. Stuart then retreated back into the wooded area. It should be noted that attempts to call Stuart's cellphone were unsuccessful and attempts to ping the phone location were futile.

After several more attempts to initiate contact, it was decided that our Special Response Team would enter the wooded area and attempt to locate Stuart. SRT members Sgt. Michael Brennan and Officer's DeBarge, Shameklis, Balbina, Chelo, Knox, and canine Officer Whitney assembled and entered the wooded area. At this time Chief James McGowan arrived on scene and was briefed on the situation and it was determined that he would accompany Commissioner Fitchet in an attempt establish contact. Troopers near Fox Hill Road reported seeing Stuart in the woods just south of their location. Officer Paul Dobek was directed to go to Fox Hill Road to provide additional support to the troopers at that location. At this point, Commissioner Fitchet, Chief McGowan, Springfield Officer Richard Rodrigues, Officer Dennis Fernandes and myself entered the woods following behind the SRT unit. At approximately 100 yards into the woods, I observed Stuart standing 30 yards to the right. I alerted the others in my group and we approached Stuart who was holding a handgun. Commissioner Fitchet made verbal contact with Stuart and asked if he could approach and if Stuart would not shoot him. Stuart sat down with the handgun pointed to his chest. Stuart allowed the Commissioner to approach and stated that he would not shoot. Officer Rodrigues was also allowed to approach and a few minutes later, Chief McGowan approached Stuart's location. Off. Fernandes and I remained within visual and audio range to monitor the dialogue and provide cover until SRT officers could set up a perimeter. Once the SRT units were in position, Off. Fernandes and I backed off toward the wood line. As the incident developed, a command post was set up at the end Fox Hill Road as it allowed better access to the area for responding persormel. State Police Major Barry O'Brien, Springfield Captain's' Trites and Cheetham, and I made several conference calls to Chief McGowan and Commissioner Fitchet in order to establish a plan to resolve the incident. Lieutenant Penniman of the Massachusetts State Police was called upon as a negotiator to .assist and he approached Stuarts location and eventually joined Commissioner Fitchet and Chief McGowan in negotiating. After several hours, Chief McGowan radioed to me that he and the Commissioner were walking Stuart back toward Center Street. At this point I was unable to make any further radio contact with Chief McGowan. It was a few minutes later when there were two shots fired and it was reported that Stuart was down. I responded to the Center Street location to assist and learned that Stuart had shot himself in the abdomen after a struggle with Commissioner Fitchet who tried to grab the revolver from Stuart's hands resulting in the first round going off into the air. Commissioner Fitchet's fingers had been scorched from the muzzle flash and were visibly blackened. Stuart was immediately treated at the scene and transported via ambulance to Baystate Medical Center. Shortly after, all Officers were accounted for and we cleared the scene. On 07118/2012 at approximately 10:30 a.m. a Mr. Jeffrey L Roberts of cam :into the station to request a well-being checked on his friend George Stuart of795 Center Street Ludlow, MA. who he believed to be suicidal. Mr. Roberts reported that he had spent the night trying to talk him out of ending his life. He stated that at 8:30 a.rn, he asked him to leave the house as he had to get ready. Mr. Roberts was aware that Mr. Stuart was to appear before probate court that morning but had no intention of going. After speaking with several of his friends Mr. Roberts came into the station to seek help for Mr. Stuart. While taking Roberts report officers began their response to 795 Center Street in prepreparation of making contact with Mr. Stuart who was familiar to department personnel, and known to possess firearms as a licensed resident. At 10:33 a.m. Officer DeBarge who arrived on scene first reported an active fire at the Stuart residence and requested that the Fire Department respond. As support personnel arrived and the Fire Department battled the fire a rescue and recovery team began to search the house for Mr. Stuart. After a thorough search it was determined that Mr. Stuart was not in the house. As fire and police personnel checked the out-buildings of the property they found multiple incendiary devices that were set to be ignited. At this time officers secured the residence and pulled back fire persormel as it was believed that Mr. Stuart was still on scene within the wood line as both of Mr. Stuart's' vehicles were still on scene. At 11:00 a.m. Sgt. Tulik requested additional support in order to secure the scene as Mr. Stuart was spotted i~ >; wood line behind his home in a crouched position and presumed to be armed. A request was made to the S"L,,"":: Police for Airwing support along with special response personneL Chief McGowan was advised of the ongoing situation and indicated that he would be responding to the scene as Mr. Stuart was well known to him. Chief McGowan indicated that City of Springfield Police Commissioner William J. Fitchet be contacted and informed of the developing situation, as Mr. Stuart was a retired Springfield Police Officer. Commissioner Fitchet offered his assistance to the police department under mutual aid, which was accepted. Chief McGowan along with Commissioner Fitchet responded to the scene and coordinated with the State Police and its Negotiator LT. James Penniman in making contact with Mr. Stuart. With the deployment of the departments Special Response Team along with support from the State Police Stop Team, and the Springfield Police Special Response Team a secure perimeter was established around Mr. Stuart, After 7 hours of negotiations between involved officers and Mr. Stuart he attempted to leave the area. In an attempt by negotiators to disarm Mr. Stuart he succeeded in discharging his weapon into his torso causing injury to himself. Officers immediately disarmed him and provided emergency treatment with transport to Bay State Medical Center. At that time Ludlow Police Detective Sgt. Foye and Detective Metcalfe assisted the State Police and Ludlow Fire Department Arson Investigators in securing the fire scene along with securing the shooting scene for CP AC investigators responding from the District Attorneys Office. Attached to this reports are written statements provided by family members along with a statement from John N. Sampson of Sampson Funeral Home Springfield,Jv1A.., that documents Mr. Stuart providing them with a request for funeral services along with payment dated July 17,2012. The investigation is ongoing with with possible charges to follow.

He told me he would make a note with the medical staff and have it placed with Mr. Stuart's file.
