and files this Complaint ATLANTA, against Defendants DAVIS BROADCASTING OF

L.L.C. (hereinafter

referred to as "Davis Broadcasting"),

JORGE

LOPEZ, a/k/a "El Vampiro"

("The Vampire"),

and ULISES UGALDE, a/kla

"Bocho" (the "Beede") and shows to the Court as follows: PARTIES, JURISDICTION, AND VENUE 1. Defendant Davis Broadcasting is a Delaware corporation with its principal Defendant

office located at 2203 Wynnton Road, Columbus, Georgia 31902.

FACTUAL ALLEGATIONS 6. Plaintiff Gonzalez-Lamberson Mexico, Inc., a Georgia non-profit is the Executive Director of the Instituto de organization dedicated to developing and

promoting Mexican interests in the State of Georgia.

Defendant Davis Broadcasting is the licensee of the FM radio station

WLKQ, broadcasting at 102.3 MHz under the trade name "La Raza" from 1176 Satellite Boulevard, Suite 200, Suwanee, Gwinnett County, Georgia 30024 ("La Raza 102.3 FM"). 8. Defendant Davis Broadcasting is the owner and operator of the radio

program "Los Hijos de la Manana" ("The Children of the Morning") which is broadcast on La Raza 102.3 FM. program. Los Hijos de la Manana is a "call-in" radio

Telephone calls are received from members of the listening public, and provide commentary related to such "call-in"

employees of Davis Broadcasting statements.

9. Defendant Jorge Lopez is an on-air personality known as "EI Vampiro" ("The Vampire") on the radio program "Los Hijos de la Manana."

10. Defendant Ulises Ugalde is an on-air personality, known as "Bocho," on the radio program "Los Hijos de la Manana." 11. On July 13,2011, Defendants Lopez and Ugalde knowingly and maliciously broadcast Lamberson inappropriate Mexico. 12. On July 13, 2011, Defendants Jorge Lopez and Ulises Ugalde, within the scope of their employment with Davis Broadcasting, broadcast the following false and defamatory inter alia, statements that concerning Plaintiff Gonzalezhad

The following colloquy occurs after a "call-in" message is received from an unidentified caller, complaining about the Mexican Consulate in Atlanta. The

14. Included within the aforesaid colloquy are the following slanderous and defamatory statements (hereinafter collectively referred to as the "Defamatory Statements") : (a) Vampiro -"[Tjhere is some type of political favor and that is the

reason she is in a position that should belong to a Mexican either from here or from our country. " ... [Emphasis supplied.] (b) Vampiro - "Or, also, some type of sexual favor. Yes sir, don't let your

jaw drop or your mouth open. Many things are driven within this environment. " Bocho -- "Do you know what happened? The Consul's wife called, right?

The wife of Consul Salvador Lara called the Consulate from Mexico and the 1MB girl answered. What's her name?"

Liliana - "The Cuban girl. I'll give you her name now. " Bocho - "She answers and the Consul's wife says" Did my husband come already?" "Oh yes, twice already. Defendants Lopez and Ugalde committed the intentional tort of slander or oral defamation by imputing to Plaintiff Gonzalez-Lamberson the crime of

adultery (O.C.G.A. § 16-6-19). 17. At all times relevant to this Complaint, Plaintiff Gonzalez-Lamberson has

been married to Mr. Bart Lamberson Lamberson.i and she is the mother of their

three year old daughter. Plaintiff has never been married to Salvador de Lara and has never had sexual relations with him. 18.. Persons listening to the aforesaid broadcast Defendant reasonably understood that of

Defendants published the Defamatory Statements on July 13,2011, by broadcasting them over the radio airwaves on La Raza 102.3 FM to third persons who reasonably understood these publications to be defamatory.

27. Each of the Defamatory Statements was made intentionally or by reason of the negligence of the Defendants. Defendants Lopez and Ugalde made the knowing such

Plaintiff is, thus, entitled to recover the reasonable cost of this action against Defendants, including reasonable attorneys' fees, in accordance with O.C.G.A. § 13-6-11. 59. Pursuant to O.C.G.A. § 13-6-11, it is well settled that there is implied in every intentional tort a specie of bad faith, entitling the Plaintiff to an award of the expense of litigation, including reasonable attorneys' fees.
