WHAT CREW HAS LEARNED SO FAR ABOUT JERRY LEWIS
INTRODUCTION

The Department of Justice (DOJ) began an investigation of Rep. Jerry Lewis (R-CA) in
February 2006, and closed the investigation on September 24, 2010, without taking any action.

Freedom of Information Act (FOIA) request, however, CREW received more than fifteen
hundred pages of highly redacted documents from the Federal Bureau of Investigation (FBI)
regarding the investigation of Rep. Lewis.

While much of the information pertaining to the
investigation remains secret, CREW has been able to glean some insight into the federal probe.
The investigation spanned four years and stemmed from allegations of bribery, as well as the
presumed earmarking of funds in exchange for campaign contributions. These charges
originally were documented by an investigative reporter, and forwarded to DOJ by CREW.

Beyond providing some details of the investigation itself, the documents released to
CREW reveal the DOJ investigation was severely hampered by a lack of resources at both the
U.S. Attorneys Office and the FBI. Further, the decision to run the investigation out of the

EOUSA claims to have located approximately 95,000 documents responsive to CREWs FOIA
request but, to date, has released only public source information. The Criminal Division has

Riverside Resident Agency of the FBIs Los Angeles Field Office likely hurt the FBIs ability to
fully investigate Rep. Lewis in a timely manner. Finally, as of 2009, after successfully
investigating and prosecuting a number of individuals, including former Rep. Duke Cunningham
(R-CA), the FBI had no protocol or resources in place to track the flow of earmarks that resulted
from contacts with lobbyists. In the end, decisions by DOJ as to how the investigation would be
run and the limited support given to the Lewis investigative team ensured the agents and
attorneys assigned to the investigation would not succeed.

THE INVESTIGATION

In February 2006, the FBIs Public Corruption Unit, Criminal Investigation Division
referred allegations about Rep. Lewis to the Riverside Resident Agency (Riverside RA) of the
FBIs Los Angeles Field Office.

The matter was opened as a full investigation on February 24,
2006, and captioned Corruption of Federal Public Officials Legislative Branch. Initially, Rep.
Lewis was not specifically listed as a subject of the investigation.

Two specific allegations were at the
core of the investigation. First, Rep. Lewis allegedly had inappropriate relationships with
certain individuals that led to the securing of earmarks for clients of those individuals.

Second,
Rep. Lewis improperly assisted Cerberus Capital Management, a private equity fund in New
York. Cerberus raised over $100,000 for Rep. Lewis Future Leaders PAC one day before the
House passed a defense spending bill preserving $160 million for a Navy project in which
Cerberus held a financial stake. Notably, Rep. Lewis previously had criticized the Navy
project.

firm had ties to Rep. Lewis: Bill Lowery was a former congressman closely associated with
Rep. Lewis,

and Letitia White previously had served on Rep. Lewiss staff before becoming a
lobbyist.

Another individual, Jeffrey Shockey, also had worked for Rep. Lewis before going
to work for CLJ, and after a stint at the lobbying firm returned as a staffer to the House
Appropriations Committee, then chaired by Rep. Lewis, in January 2005.

The Riverside RA initially proposed a three-step investigation that would take three
months and include: (1) gathering open-source information and issuing third-party subpoenas
to learn as much as possible about the subjects of the investigation; (2) conducting limited
interviews; and (3) issuing grand jury subpoenas.

Although opened as a full investigation, Rep. Lewis was not initially named in the title
in efforts to keep the existence of this investigation unknown from those without a need to
know.

By April 20, 2006, however, both Rep. Lewis and Cerberus Capital Management
were added to the title of the captioned investigation based on recent developments and in an
effort to fully disclose the extent of the investigation.

access in the ACS, and had to retroactively seek permission to do so.

In the spring of 2006, the FBI began serving grand jury subpoenas and interviewing
witnesses throughout the country, including areas surrounding Phoenix, New York, Washington,
D.C., Los Angeles, Las Vegas, and Philadelphia.

why no instructions on performing these tasks were ever provided to the Riverside RA agents
when the case was assigned to them.

Despite the FBIs attempt to keep most of the details of the investigation secret, media
reports about the investigation surfaced. The Los Angeles Times reported on May 11, 2006, that
according to sources, the investigation concerned the connection between Lewis and his
longtime friend Bill Lowery.

severance payments received by Jeffrey Shockey as he left the employment of Lowerys
lobbying firm to return to the staff of the House Appropriations Committee to work with Rep.
Lewis.

In early June of 2006, it was reported that San Bernadino County, Riverside County,
Cal State Bernardino, and the city of Redlands, California all with ties to the lobbying firm
CLJ had received grand jury subpoenas.

Meanwhile, the three-month period initially
established for the investigation passed and the investigation continued.

While the FBI documents CREW obtained contain numerous memoranda summarizing
information obtained from witnesses, they are so heavily redacted as to reveal very little about
what the FBI was learning. Some tantalizing portions remain, such as this partial sentence from
a June 5, 2006 memo from the FBIs Los Angeles Field Office: Lewis was telling people to do
whatever [they] could do to help [name redacted].

Despite these ripe areas of investigation, signs of DOJs disinterest began to surface in
September of 2006, approximately six months after the investigation began. On September 11,
2006, FBI agents sought authorization to again travel to New York and Washington, D.C. to
interview witnesses.

agents and support staff providing additional administrative support in analyzing their contents.

reputation.

investigation, and intended to proceed with the intention of completing a thorough

As the investigation approached its one-year anniversary, additional grand jury
subpoenas were issued.

At the same time, FBI agents assigned to the case sought additional
resources. On February 5, 2007 and May 1, 2007, the Riverside RA agent assigned to the
investigation asked for investigative assistance . . . as needed.

By 2007, the investigation included numerous interviews of clients of CLJ, which
demonstrated a unified belief that CLJ and/or its partners [were] productive and effective in
obtaining earmarks for their clients.

An analysis of earmarks sponsored by Rep. Lewis was
expected to demonstrate a disproportionate focus on CLJs clients. But, as the investigation
had the assistance of only one part-time analyst, the Riverside RA had to seek help from the
Public Corruption/Civil Rights Intelligence Unit at FBI Headquarters to perform the analysis.

Ultimately, the FBI was unable to develop a list of congressional earmarks for the 2004-2005
timeframe. According to an FBI employee, finding specific data on earmarks prior to 2008
has proven to be very difficult and time consuming.

additional resources to review the evidence gathered to date in the investigation. A meeting on
January 10, 2008 resulted in only one additional agent being detailed to the investigation for just
90 days in February 2008.

On January 14, 2008, and again on March 3, 2008, the Riverside
RA requested that two agents review documents two days a week for a 90-day period.

May 13, 2008 meeting with U.S. Attorneys Office and FBI personnel, the investigative team
discussed preparing a detailed investigative plan of how they want the investigation to proceed
with the limited resources that the case currently has, and potential interview of witnesses.

No representatives from the Criminal Division of the Department of Justice attended this
meeting. At that point, over two years had passed since the start of the investigation and no
indictments had been issued. In July of 2008, DOJ declined to prosecute anyone associated
with the investigation of Cerberus.

By October 2008, the FBI had reviewed 72,000 documents.

believed the investigation had progressed to the point of a possible honest services fraud
charge.

documents provide no additional details concerning the outcome of the investigation, including
reasons why DOJ ultimately declined to prosecute Rep. Lewis. On December 3, 2010, a
spokesman for the U.S. Attorneys Office for the Central District of California summarily
announced DOJ had closed its investigation into Rep. Lewis conduct.

CONCLUSIONS

The investigation of Rep. Lewis and his associates was doomed by decisions of
upper-level management of the Department of Justice dating back to the beginning of the
investigation. The decision to run the investigation out of the Riverside Resident Agency of the
FBIs Los Angeles Field Office likely hampered the FBIs ability to fully investigate Rep. Lewis
in a timely manner, as the agents assigned to the case appeared to have little or no experience in
these types of investigations and were over 3,000 miles away from where many of the alleged
crimes occurred. Upper-level management at the FBI, after successfully investigating and
prosecuting a number of individuals, including former Rep. Duke Cunningham, had no protocol
or resources in place for conducting investigations of lobbyists and members of Congress. Of
particular significance here, they had no way to efficiently track the flow of earmarks that
resulted from contacts with lobbyists. DOJs mishandling of this investigation clearly hampered
its agents from being able to determine the truth about the activities of Rep. Lewis and his
associates.

The FBI documents also reveal the investigation was not provided sufficient resources in
either the U.S. Attorneys Office or the FBI despite its denomination as a high-level
investigation. The investigative team was denied support for some of the most basic aspects of
the investigation. The investigative team also took a very insular approach, refusing to go
outside DOJ to locate documents that were readily available from others, such as the travel
records of Rep. Lewis.

Yet, even with these obstacles, investigators were able to assemble a wealth of evidence
gathered from a substantial number of interviews and document subpoenas. Nevertheless, DOJ
refused to act on this evidence, suggesting a reluctance to pursue such a strong political figure as
Rep. Lewis. In the end, DOJs decision not to prosecute Rep. Lewis is more an indictment of
DOJ than a vindication of Rep. Lewis.

Cunningham. As you will recall. Mr. Cunningham pleaded guilty to bribes from the

Campaign for a Cleaner Congress has learned that Congressman Jerry Lewis of California
appears to have flipped his position and ultimately changed a decision of Congress on behalf of a
New York hedge fund called Cerberus .Capital Management.
The switch was followed by a $110,000 donation to his leadership political action committee. A
published report in today's USA Today documents this story of what seems to be a startling vote-
for-money swap.
We request that you investigate whether Rep. Lewis's conduct violates federal bribery and
gratuity statutes.
As we understand it, Cerberus is one of a number of so-called "vulture" funds, which bought
debt in MCI WorldCom shortly before its bankruptcy so it would be at the front of the line if the
company paid back debt or would get equity in a revitalized company. Cerberus invested so
heavily in the company that one of the Cerberus executives got on the MCI board.
MCI WorldCom was a subcontractor on a Navy-Marine Corps communications network- an
$8.8 billion program to connect all the Navy offices on a secure computer network. The program
has been troubled throughout, enough to cause prime contractor EDS (Electronic Data Systems)
~ - ~ -financiattrouole.Melwas-oneofthe-main-subcontractors,providing-all-of.thetelephone-links-
between the offices.
Congressman Lewis was quoted in The Washington Post on October 2, 2002, criticizing the
program and the involvement ofMCI WorldCom.
"When you have a big piece of the pie that's already in trouble, it just gums up the process that
already has great difficulty," he said at the time.

On May 16, 2003, the House Armed Services Committee voted out a budget calling for $160
million cut in the program. This threatened the cash flow and future viability of the company
and, therefore, Cerberus's investment strategy.
On J u n ~ 16,2003, however, thebefense Appropriations Subcommittee and its chairman,
Congressman Lewis, put out its spending bill preserving the money and keeping MCI (and
Cerberus's investment) safe.
On June 26, 2003, the full Appropriations Committee approved the bill with the program's
funding preserved. -
Within two weeks, on July 7, 2003, Lewis held a fundraiser and received $110,000 from
Cerberus and its executives and representatives, who had not previously been political donors to
Lewis. The followjng day, July 8, 2003, the House passed the bill with the preserved funding.
Congressman Lewis later used the funds in his political action committee to win support within
the House Republican Caucus for his successful bid to chair the full House Appropriations
Committee.
Inasmuch as the Public Integrity Section oversees the federal effort to combat corruption through
the prosecution of elected and appointed public officials at all levels of government, we request a
prompt investigation into this matter.

According to published reports, feder-
al prosecutors are examining links be-
tween Lewis, the chairman of the appro-
priations panel, and the lobbying firm's
founder, former San Diego Rep. William
Lowery, in connection with the bribery
investigation of convicted Rep. Randy
"Duke" Cunningham.
Shockey was not identified in the re-
ports as being under investigation.
Lewis has vigorously denied any
wrongdoing. He condemned Cunning-
ham's behavior as egregious, adding "the
standards of integrity I have followed in
my career are a direct repudiation of the
kind of behavior displayed by Mr. Cun-
ningham."
Shockey, who first worked for Lewis
in the 1990s before joining Lowery's
fum, is one of two aides who have trav-
eled between the congressman's office
and the lobby shop. Shockey's 2005 sev-
erance agreement, according to financial
disclosures, included compensation for
undistributed profits, receivables and six
months of calculable revenue from the
clients he brought to Copeland Lowery.
Shockey did not return a call for com-
ment. House Appropriations Committee
spokesman John Schofield said Shockey
is being penalized in the press for being
financially successful and honest.
"He had a stake of ownership in a busi-
ness which he was required under law to
divest before he came back to theHill,"
Schofield said, adding that Shockey fol-
lowed "not just the letter of the law, but
the spirit of the law" in publicly detailing
his severance package.
"He came back because he believes in
Chairman Lewis and what he's about,"
Schofield said. "The only thing I guess
the guy is guilty of is being successful in
the private sector."
Congressional Accountability Project
Director Gary Ruskin said the size of the
payment is unusual, and underscores the .
persistent problem of the revolving door
between Capitol Hill and K Street, where
many lobbying firms have their offices.
"It helps point out how, increasingly,
Washington is seen as a favor factory and
you can get paid a lot of money if you can
shake the Washington money tree," he
said.
Even other lobbyists were surprised by
the amount of the severance package.
"Wow," David Turch, a lobbyist in
D.C. since 1987 whose client list includes
a raft of San Bernardino County and
Riverside County agencies, said of
Shockey's $600,000 payday.
"I should be so lucky, and I own the
fum," Turch said.
Shockey grew up in Redlands, attend-
ed Redlands High School and worked lo-
cally during summers.
Fred Ford, a local logger, once em-
ployed Shockey, who .was his son's
friend.
"He was a young man still trying to
find himself," Ford said of Shockey. "It
was clear he wasn't going to be working
in orchards his whole life."
Ford recalled Shockey as being a hard,
thorough worker.
"I'm not surprised he's made the mon-
ey he's made," F9rd said. "He was a very
determined guy."
Shockey graduated from Cal State San
Bernardino with a political-science de-
gree and later earned a master's there in
public administration.
Harold Willis, a businessman in San
Bernardino who lives in the same Red-
" lands neighborhood as Shockey's family,
met Shockey one day when both were
preparing to go jogging. They decided to
run together.
The two became friends and would
frequently meet to tackle their runs of at
least six miles, if not longer, Willis said.
In a way, it was an odd partnership, Willis
said, because he was in his late 50s at the
time and Shockey was a college student.
But they took to each other because
they shared topics of interest, Willis said.
"He is a good distance runner," said
Willis, who is now 78. "He's a very nice
young man. We talked about water issues,
and it was clear he knew his stuff."
While running, the pair discussed pol-
itics, local issues and Shockey's future,
Willis said. Shockey was interested in a
career in law enforcement, but Willis
lightly prodded Shockey toward politics.
"I'm not saying I was the reason it hap-
pened," Willis said. "It's just something
we talked about."
The friendship continues to this day.
Willis ran with Shockey around the
Christmas holidays, he said.
Shockey f\rst joined Lewis' office in
1991, working as a legislative director
and point man on an appropriations sub-
committee overseeing veterans and hous-
ing issues that Lewis then chaired.
Shockey left Lewis for Lowery's firm
in 1999. Within months, 10 agencies in
Riverside and San Bernardino counties
had flocked to him, some of them sever-
ing longtime ties with other D.C. fums.
By 2005, Shockey had racked up a
lengthy client list in the region, including
water agencies, universities, the city and
county of San Bernardino, Riverside
County, and the cities of Redlands, Mur-
rieta, Loma Linda, Twentynine Palms
and Victorville. .
The University of Redlands, for exam-
ple, hired Shockey in July 1999, accord-
ing to lobbying reports. Ron Stephany,
vice president of university relations, said
officials decided to hire a professional
lobbyist for the first time largely based on
a positive relationship they had built with
Shockey when he served on Lewis' staff.
"When Mr. Shockey accepted a posi-
tion with Copeland Lowery, we, in
essence, followed him there," Stephany
said. He said the university has benefited
from employing a D.C.-based lobbyist
and continued with the firm after Shock-
ey returned to Capitol Hill. .
. Of"Shockey, Stephany noted that his
parents still live in Redlands and said,
"He's very interested in the region; he's
very committed to the quality of life in
this community."
Randy Van Gelder, assistant general
manager of the San Bernardino Valley
Municipal Water District, said his
agency also hired Copeland Lowery in
2000, after their previous lobbyist re-
tired, based on having worked with

"It was primarily that we already kneW
him; we knew he knew how the system
works back there," Van Gelder said. "He
is very, very knowledgeable."
Victorville Councilman Terry Cald-
well said he could not remember why the
city terminated its relationship with E.
Del Smith & Co., then hired Shockey, in
2000. "Del Smith had done good work
for us," Caldwell said. "But we kin.
reached a consensus that it was appr
ate to make a change."
Caldwell maintained that it was not
Shockey's relationship with Lewis that
prompted the switch, but rather the lob-
bying firm's. expertise in transportation
issues.
Turch, who represented the city and
county of San Bernardino as well as the
Inland Valley Development Agency be-
fore they switched to Shockey, said his
fum "scored very high and delivered."

But, he said, "This is a competitive
business. I think (Shockey) did the best
job he could to market his skills the best
he can."
Ruskin and Sunusco both said Con-
gress has failed to adequately address the
revolving-door issue. An ethics bill that
recently passed the House was w..
down so that instead of forcing an e -
ed waiting period before lawmakers and
aides can lobby their former colleagues;it
merely emphasizes added education of
the current regulations.
Neither version included any restric-
tion on lobbyists returning to elected of-
fice.

a $600,000 severance payment that a
lobbying firm with ties to Rep. Jerry
Lewis paid to one of its partners
days before he assumed a top slot
with Lewis on the House Appropria-
tions Committee.
Redlands native Jeff Shockey lob-
bied Congress on behalf of dozens
of San Bernardino County and
Riverside County agencies in his six
years with Copeland Lowery
Jacquez Denton & White. Shockey
quickly rose to partner, and before
leaving in 2005 to become Lewis'
deputy staff director, he earned $1.5
million, rriaking him one of Wash-
ington's top-paid lobbyists.
Considering Shockey's salary and
stake in the firm, several political
ethicists said they do not consider a
$600,000 severance payment exces-
sive. At the same time, such a rich
going-away present from a firm with
vested interests in Congress to an
aide who would have his hands on
congressional purse strings troubled
inany watchdogs.
"Here is this aide who clearly in-
fluences what happens on the com-
mittee," said Michael Surrusco, di-
rector of Common Cause's ethics
campaign. "Immediately before tak-
ing the job he's 'being paid by a se-
lect group of clients, and that

A federal grand jury has subpoenaed San Bernardino County for records relating to its Washington lobbyist
and its communications with Inland Rep. Jerry Lewis as part of an ongoing criminal investigation, according
to federal legal documents.
San Bernardino County and a host of Inland cities and
agencies use the lobbying firm Copeland, Lowery &
Jacquez, a company linked to convicted former Rep. Randy
"Duke" Cunningham. The Rancho Santa Fe Republican
pleaded guilty to tax evasion and bribery and was
sentenced to more than eight years in federal prison.
San Bernardino County and Lewis, R-Redlands, have not
been accused of any wrongdoing.
A subpoena was issued May 17 as part of a criminal
investigation by the FBI, Defense Criminal Investigative
Service and the IRS, according to the documents obtained
by The Press-Enterprise.
In a letter to the county, Assistant U.S. Attorney Daniel N.
Shallman did not disclose the nature of.the criminal
investigation. Thorn Mrozek, a spokesman for U.S. Attorney
Debra Wong Yang in Los Angeles, said he could not
comment.
The county has until June 13 to provide the documents to
the FBI or appear with the records before a grand jury.
According to the subpoena and the letter, federal authorities are seeking:

All communications between the county and Lewis, and any member of his congressional staff or the staff of
the House Appropriations Committee he chairs.
The firm's other clients include the cities of San Bernardino and Redlands, along with Lama Linda University
and Cal State San Bernardino. Sources in Redlands City Hall confirmed Thursday that Redlands received a
subpoena about the lobbyist.
Lewis, 71, whose congressional district includes most of San Bernardino County, has served in the House
since 1978 and became chairman of the House Appropriations Committee in January 2005.
Clients of Copeland, Lowery & Jacquez have benefited from millions of.dollars worth of congressional
earmarks -- special projects inserted into federal legislation by lawmakers.
Lewis has helped secure funding for projects in San Bernardino County, including measures to ease the fire
threat in mountain communities.
Copeland, Lowery & Jacquez also is working to help Redlands get federal money to fund a downtown
parking structure, flood-control improvements, a sports park, fire station, police station and Seven Oaks
Dam water quality.
Lewis Connection
The firm has close ties to Lewis.
Bill Lowery, one of the firm's partners, was a member of Congress from 1980 to 1993 and served with Lewis
on the House Appropriations Committee. Jeffrey Shockey, the county's former lobbyist with the firm, is a
former Lewis staff member who left the lobbying .firm last year to return to work for Lewis on the
appropriations committee.
The firm's lobbyists have made individual donations to Lewis' campaign totaling $28,650 since 2002,
according to FECinfo, a campaign-finance database. Lowery has contributed $23,000 to Lewis' political
action committee.
Lewis last month said Lowery is a close friend but.that he.has never traded access or earmarks for
campaign donations. Lewis declined to comment through his spokesman Thursday about the records
request by federal authorities. Attempts to reach Lewis and his spokesman, Jim Specht, after The Press-
Enterprise obtained the subpoena were unsuccessful.
Earlier, Specht said, "There's been no contact whatsoever from the Justice Department," in the three weeks
since reports surfaced that federal investigators were looking into the link between Lewis and Lowery.
San Bernardino County spokesman David W.ert said Thursday the county has received the subpoena. The
county will fully comply with it, but at the request of the U.S. Attorney's office, will not discuss details, Wert
said.
Firm's County Work
Meanwhile, Patrick Dorton, a spokesman for Copeland, Lowery & Jacquez, said Thursday the firm's work for
the county has followed ?II rules governing Capitol Hill lobbying.

"It is the exact same work that happens every day, every month and every year in Washington on behalf of
counties all over the country," Dorton said in a telephone interview from Washington.
The county hired the firm in 2002 during Supervisor Dennis Hansberger's tenure as chairman. The firm's
contract runs through the end of the year.
Hansberger said the firm's selection was above board.
The county picked Copeland, Lowery & Jacquez in part because of its connections in Washington and
because it knew San Bernardino County, Hansberger said.
Hansberger said he met Shockey, a former Redlands resident, through Lewis and has known him seven or
eight years but does not have a personal relationshi'!)with him.
Lobbying reports filed twice yearly by firms, including Copeland Lowery & Jacquez, show that San
Bernardino County paid the firm $60,000 in 2005.
Three of the firm's lobbyists, Lance Larson, Meredith. Stanford and Letitia White, represented the county.
Calls and e-mails to those lobbyists and Lowery were not returned.
From 2002 to 2005, Shockey lobbied on behalf of the county on matters including the federal budget,
according to records.
David Turch, a Washington, D.C.-based lob.byist: who held the contract before Copeland, Lowery & Jacquez
took it over, said he lost the county's business amid .a wide-_ranging bribery and corruption scandal.
The malfeasance sent several top county officials to jail and eventually forced then-Supervisor Jerry Eaves
from office.

RIVERSIDE, Calif. - Riverside County and the Cal State Bernardino Foundation have been subpoenaed in the federal investigation into
the ties between Rep. Jerry Lewis, R-Redlands, and a Washington, D.C., lobbyist, it was reported Saturday.
That's in addition to subpoenas of San Bernardino .County and Redlands, Calif., that were confirmed earlier this week. The subpoenas are

Lowery is a close friend of Lewis' whose firm's clients include a number of municipalities,, businesses and agencies in or around Lewis'
inland Southern California district. Some aides to Lewis at the House Appropriations Committee, which he chairs, have also gone to work
at the firm, which helps clients get federal dollars "earmarked" for projects.
The U.S. attorney's office in Los Angeles is investigating. Spokesman Thorn Mrozek did not immediately return a call for comment
Saturday.
The subpoenas to Riverside County and the Cal State Bernardino Foundation were reported Saturday by The Press-Enterprise of Riverside.
Lewis' spokesman didn't immediately return a call for comment. In a statement Friday Lewis denied wrongdoing and defended obtaining
earmarks for his district.

It is anticipated an analysis of the earmarks sponsoreq
by Lewis will demonstrate a disproportionate focus on CLJ's
clients.
Currently, the FIG, Los Angeles, has assigned one
analyst, part-time, to assist with this investigation. The
analyst has been tasked to conduct CART review of a voluminous
amount of electronic evidence provided by CLJ. The analyst has
worked for approximately one year on the review and completed
less than one-tenth of the review. Requests from the FIG for
additional analytical help have been denied. In addition, the
analyst working on the review has not been allowed to work full-
time on the review.

analysis and possible products. A final decision will be made
after discussion with the assigned analyst but it is anticipated
a search of open sources could provide the data necessary to

Strange connections are still
cropping up among players in the
expanding Cunningham probe.
House Appropriations Chairman Jerry Lewis (R-CA) is the latest congressman
to find himself under investigation in the scandal. One of his closest former
aides, Letitia White, is also under scrutiny from federal prosecutors.
White left Lewis' staff in January 2003 --and started working as a lobbyist the
very next day. (Her lobby finn, Copeland Lowery & JacqLiez, is also under
investigation.) Less than a month later, she signed on Trident Systems Inc. as
one of her first clients. Then later that same year, White and her husband
purchased a house on Capitol Hill together with the owner of Trident and his
wife.
Letitia and Richard White bought the house on 3rd Street SE --just behind the
Library of Congress -- with Nicholas Karangelen and his wife, Kathy
McPartlan, in December 2003. The price was a flat million dollars-- no odd
dollars, extra pennies on the end. Just a one and six zeroes.
Beyond that, it's a mystery. I could find no public record showing how much
each couple paid. Neither couple lists the house as their primary residence. My
calls to Letitia White and Karfu1gelen went unreturned; McPartlan, whom 1
reached at home, told me, "I don't have any comment for you."
Of course, White is now a private citizen, not an elected official or a
congressional staffer. She can buy a house with whomever she wants. It's only
an illustration of the extraordinarily close relationship that a very influential
defense lobbyist and former Hill staffer has with a client.
As White's client, Trident paid Copeland Lowery $360,000 from signing on in
2003 to the end of2005. In at least one identifiable instance, White appears to
have delivered for the company: in 2005, according to records kept by the
watchdog group Taxpayers for Common Sense, White helped win Trident a $2
million earmark for a system of wireless beacons to mark targets in preparation

Like I said, White can buy a house with anybody she wants. But I'm curious: if
the couples don't live there, who does? is it rented? Aild if so, by whom? And
how much do they pay? Since federal investigators are now scrutinizing
White's ties to key defense contractors, I think we can assume that they're
asking those questions too.

A stepdaughter of Rep. Jeny Lewis (R-Calif.),
chairman of the House Appropriations Committee, has
a second Washington job, working for a lobbyist who
has business before the committee.
Julia Willis-Leon, who lives in Las Vegas, is a
"strategic partner" in Potomac Partners DC LLC,
President Richard Alcalde said in a recent interview.
Alcalde said he has paid Willis-Leon $40,000 to
$50,000 over the last year for advice on several
clients.

News accounts disclosed recently that Willis-Leon was paid more than $40,000 by a political action
committee operating out of a Capitol Hill townhouse half-owned by Letitia White, a former Lewis staff
aide-turned-lobbyist. Willis-Leon's fees as PAC director were considerably higher than the PAC gave in
donations to federal candidates.
Steven C. Tabackman, a Washington lawyer representing Willis-Leon, said last night that his client has
a background in event planning and met the PAC leaders and Alcalde through earlier contacts, including
White. That led to work with groups representing alternative fuel users and charter schools. She also has
worked part time for General Atomics, a Southern California defense contractor, including on the
magnetic levitation issue where she met Alcalde, he said.
Tabackman and Alcalde both said Willis-Leon does no lobbying in her Washington work.
Six of Alcalde's 13 clients have business before the Appropriations Committee, according to reports of
his lobbying activity. Lewis had "nothing whatsoever" to do with his decision to hire Willis-Leon,
Alcalde said, adding that he did not hire her in hopes of currying favor with the committee chairman.
"I'm not trying to get a racer's edge with the Lewises by her working here, because it wouldn't do any
good. They aren't those kind of people."

Alcalde said he met Willis-Leon about a year ago when they were working for American Magline
Group, private companies seeking federal funding for high-speed train service from Las Vegas to
Anaheim, Calif. "Julie did some great work on the ground in Las Vegas, like with the mayor's office," he
said. He noted that the Magline Group sought funding from the Transportation Committee, not Lewis's
committee.

Numerous interviews of clients of CLJ have demonstrated
a unified belief that CLJ and/or it's partners are productive and
effective in obtaining earmarks for their clients. Typically,
the firm's ties and access to Lewis and his staff are well-known
and weighed into the decision to hire the firm.
It is anticipated an analysis of the earmarks sponsoreq
by Lewis will demonstrate a disproportionate focus on CLJ's
clients.
Currently, the FIG, Los Angeles, has assigned one
analyst, part-time, to assist with this investigation. The
analyst has been tasked to conduct CART review of a voluminous
amount of electronic evidence provided by CLJ. The analyst has
worked for approximately one year on the review and completed
less than one-tenth of the review. Requests from the FIG for
additional analytical help have been denied. In addition, the
analyst working on the review has not been allowed to work full-
time on the review.
On 11/01/2007, writer spoke withl I
Intelligence Analyst, PC/CRIU, regarding the potential topics for
analysis and possible products. A final decision will be made
after discussion with the assigned analyst but it is anticipated
a search of open sources could provide the data necessary to
compile a list of earmarks sponsored by Lewis and those who
benefitted from the earmarks.

I'm sorry to report that I was not able to develop a thorough list of earmarks for the 2004-2005 time period like we
discussed. I have solid data for 2008 but finding specifics for earlier time periods has proven to be very difficult and time
consuming. I spent the last week or so reviewing the 2008 data in an attempt to discern some sort of logical pattern from
the dates of the activity. For example, it would be interesting to see when earmarks were inserted to a bill--in the initial bill,
in a subsequent revision, or after it's already been approved by the House/Senate. I was also trying to determine if there
was a pattern to when campaign/PAC contributions were made with respect to the time an earmark was received. I
guessed that if I found a pattern, I could apply that pattern to the 2004/2005 campaign/PAC contributions and work
backwards to find the information. No such luck. I was not able to discern any obvious pattern in any of the information.
also spoke with other coworkers about different ways to approach the situation, hoping to find an alternative. I received
some great ideas but none that gave me what we need.
I know that you're under pressure to find a "smoking gun" and I know the AUSAs will be meeting about this case in May to
discuss its future. I feel terrible that I've not been able to make a significant contribution to date. Is there anything else I
can do that may help develop the case? Is it possible to go through seized material with you, for example? Or review
emails and other communications? I don't know that I would necessarily see anything that you've not already found but I
would certainly try. I've already spoken with my supervisor about such a possibility and I've got her approval if you feel it
would be beneficial. Please let me know.
