Caballero, Secretary of California State and Consumer Services Agency, in her official capacity; Denise Brown, Director of Consumer Affairs, in her official capacity; Christine Wietlisbach, Patricia Lock-Dawson, Samara Ashley, Harry Douglas, Julia Johnson, Sarita Kohli, Renee Lonner, Karen Pines, Christina Wong, in their official capacities as members of the California Board of Behavioral Sciences; Sharon Levine, Michael Bishop, Silvia Diego, Dev Gnanadev, Reginald Low, Denise Pines, Janet Salomonson, Gerrie Schipske, David Serrano Sewell, Barbara Yaroslavsky in their official capacities as members of The Medical Board of California appeal to the United States Court of Appeals for the Ninth Circuit from the Court’s Memorandum And Order Re: Motion For Preliminary Injunction (Docket # 55), entered in this action on December 3, 2012. Pursuant to Ninth Circuit Rule 28-2.6 and General Order 2.1, Defendants wish to apprise the Ninth Circuit of a related case currently pending before it, Pickup et al. v. Brown, et al., No. 12-17601, filed on December 4, 2012, in which Plaintiffs-Appellants appeal from the December 4, 2012 Order of Judge Kimberly J. Mueller in Case No. 2:12-cv-02497 (Docket # 80) denying a motion for a preliminary injunction that would have enjoined enforcement of Senate Bill 1172 (Cal. Stats. 2012, ch. 835, § 2), the same Act enjoined by Judge William B. Shubb in this case. Both appeals involve the constitutionality of Senate Bill 1172 and raise the same and/or closely related legal issues.
