(a) INFORMATIONSHARING.—Section 384(b) of the

3

Illegal Immigration Reform and Immigrant Responsibility

4

Act of 1996 (8 U.S.C. 1367(b)) is amended—

5

(1) in paragraph (1)—

6

(A) by inserting ‘‘Secretary of Homeland

7

Security or the’’ before ‘‘Attorney General

8

may’’; and

9

(B) by inserting ‘‘Secretary’s or the’’ be-

10

fore ‘‘Attorney General’s discretion’’;

11

(2) in paragraph (2)—

12

(A) by inserting ‘‘Secretary of Homeland

13

Security or the’’ before ‘‘Attorney General

14

may’’;

15

(B) by inserting ‘‘Secretary or the’’ before

16

‘‘Attorney General for’’; and

17

(C) by inserting ‘‘in a manner that pro-

18

tects the confidentiality of such information’’

19

after ‘‘law enforcement purpose’’;

20

(3) in paragraph (5), by striking ‘‘Attorney

21

General is’’ and inserting ‘‘Secretary of Homeland

22

Security and the Attorney General are’’; and

23

(4) by adding at the end a new paragraph as

24

follows:

‘‘(8) Notwithstanding subsection (a)(2), the

Secretary of Homeland Security, the Secretary of

2

State, or the Attorney General may provide in the

3

discretion of either such Secretary or the Attorney

4

General for the disclosure of information to national

5

security officials to be used solely for a national se-

6

curity purpose in a manner that protects the con-

7

fidentiality of such information.’’.

(b) GUIDELINES.—Section 384(d) of the Illegal Im-

9

migration Reform and Immigrant Responsibility Act of

10

1996 (8 U.S.C. 1367(d)) is amended—

11

(1) by inserting ‘‘, Secretary of State,’’ after

12

‘‘The Attorney General’’;

13

(2) by inserting ‘‘, Department of State,’’ after

14

‘‘Department of Justice’’; and

15

(3) by inserting ‘‘and severe forms of traf-

16

ficking in persons or criminal activity listed in sec-

17

tion 101(a)(15)(U) of the Immigration and Nation-

18

ality Act (8 U.S.C. 1101(a)(15)(u))’’ after ‘‘domestic

19

violence’’.

(c) IMPLEMENTATION.—Not later than 180 days

21

after the date of the enactment of this Act, the Attorney

22

General, the Secretary of State, and Secretary of Home-

23

land Security shall provide the guidance required by sec-

24

tion 384(d) of the Illegal Immigration Reform and Immi-

25

grant Responsibility Act of 1996 (8 U.S.C. 1367(d)), con-

sistent with the amendments made by subsections (a) and

2

(b).

(d) CLERICALAMENDMENT.—Section 384(a)(1) of

4

the Illegal Immigration Reform and Immigrant Responsi-

5

bility Act of 1986 is amended by striking ‘‘241(a)(2)’’ in

6

the matter following subparagraph (F) and inserting

7

‘‘237(a)(2)’’.
