Robert Troup Deputy General Manager of Operations Washington Metropolitan Area Transit Authority 600 Fifth Street, NW Washington, DC 20001 Dear Mr. Troup: This letter acknowledges Montgomery County, Maryland’s (County) receipt of Washington Metropolitan Area Transit Authority’s (WMATA) letter dated April 12, 2013. On September 25, 2008, WMATA and the County executed an Amended and Restated Memorandum of Understanding (MOU). The MOU establishes WMATA’s and the County’s respective obligations for the construction, ownership, operation, and management of the Silver Spring Transit Center (SSTC). As I stated during our meeting at your office on April 26, 2013, the County disagrees with WMATA’s assertions in the April 12, 2013 letter. The County will deliver to WMATA a fully functional facility consistent with the design approved by WMATA under the MOU. The County continues to honor its obligations under the MOU and it expects WMATA to also honor its obligations under the MOU. During our meeting WMATA agreed to provide the County with the results of WMATA’s inspection and testing of the SSTC. In addition, WMATA agreed to provide the County with its projected operation costs for the SSTC. As of the date of this letter, the County has not received WMATA’s inspection and testing results and projected operation costs. Please send this information to me as soon as possible.
