OnDecember10,1985,ArizonaStateSenatorWayneStumpaddressedalettertotheState's DirectorofPublicSafety,RalphMilstead,thatissuretoshakeupthebureaucracy.Thesameletter wasaddressedtothesheriffofeverycounty,everypolicechief,andtheheadofeverylaw enforcementagencyhavingtodowithtrafficregulationintheStateofArizona. Lettheletterspeakforitself:"Ithascometomyattentionthatnumerousindividualsinourstate haverescindedalloftheircontractswiththeUnitedStatesfederalgovernment,theStateof Arizona,andeachofitspoliticalsubdivisions,establishingthemselvesasfreemenunderthe organicnationalConstitutionoftheRepublicoftheUnitedStatesofAmerica.Consequently,they maybedrivingwithoutautoregistration,driver'slicense,oranyotherevidenceofcontract. "Becausemanylawenforcementpersonnelmaybeunawareofthecontractualnatureofauto registrationanddriver'slicenses,itisconceivablethatthissituationmayleadtoconfrontation betweentheseindividualsandlawenforcementpersonnel. 14THAMENDMENT CITIZENSHIP
The14thAmendmentwasnotproperlyratifiedbythestatesoftheUnion.Likethe16th and17thAmendments,itisalawthatdoesnotexist.Wemustbeginforcingthedialogue inpoliticaldiscussions,meetingsandtalkradiotothesekey,coreissues. TheyarecriticaltotheUnseenHandandcontinuingtoyapaboutthesymptomsinstead ofthetreatmentwon'tgettheissuesoutintothepublicdomain. ThefollowingisareprintfromtheFreeEnterpriseSociety'snewsletter,May1989.Itis authoredbyformerArizonaStateSenatorWayneStump: Towhomitmayconcern: "Asmyinterestinconstitutionallawhasexpandedoverthepastyearsandthewordof myinterestspread,IhavehappilybecometherecipientofPatriotpapers,circularsand lettersfromalloverthisgreatland. Manyfolksinvolvedintheresearchanduseoftheprinciplesinvolvedinour "Republican"formofgovernmenthavebecomepersonalfriends.Thesefriendshipshave enabledagreatdealofactivity,fromdiversesources,todeveloptogetherforcomparison andevaluation. Ihave,fromtimetotime,endeavoredtopassinformation,onalimitedbasis,fromone sourcetoanotherforenlightenmentofindividualsongeneralissues. Thistime,however,itwouldappearthattheemergingprinciplesaresofundamentalto ourformofgovernment,andofsuchmagnitudeastoencompasseveryman,womanand childinourunitedRepublics,thatonewondershowtheycouldhaveeverbecome obscured. TheprinciplestowhichIreferarethoseheraldedinthePreambleoftheConstitution, whichbeings:"We,thePeople...."andcontinues"....securetheblessingsofLibertyto OurselvesandourPosterity."Thesewords,withoutquestion,wereusedtorepresentthe interestsofthesignersoftheConstitutionalcontract.Thatistosay,"TheFounding FathersandtheirPosterity." Whenonereflectsonthismeaningof"WethePeople"itwouldseemtomeanthatthe PreamblePeoplewereaclassofpeoplewho,withtheaidofGod,originallysecuredtheir LibertywiththeprotectionstheyconstructedintotheOrganicConstitutionandthefirst tenAmendmentsthereto.This,beingthecase,tendstobringtheimportofthe14th Amendmentintofocus. The13thand14thAmendments,aswehavebeentaught,werefashionedtogivefreedom

toslavesandtosecureforthemprivilegesofcitizenship. OurEducators,however,neglectedtoexplainthatthe14thAmendmentcreationwasthat ofanew"class"ofcitizenship.Itbecomesclearwhenonestudiesthewordingofthe OrganicConstitution,thattheoriginalpeoplecitedinthe"Preamble"couldnotlosethe "Blessings"securedtherebyaslongastheConstitutionwasintact,becauseour Constitutionisperpetual. The14thAmendment,thenhadtocreateanother"position"forthosepersonsforwhom itwascreated.Scrutinyofthe14thAmendmentrevealsthatpersonsencompassed therebywere"subject"tojurisdictionthereofandmaynot"question"thevalidityofthe publicdebt. Big"C"Little"c" WhenthisNationwasfoundedeachoftheindividualStatesofthisunionhadtheirown Citizens(spelledwithacapital"C").Today,wehaveasecondclassofcitizen(notethe small"c"),the14thAmendmentcitizen. Inlaw,everyletterinawordisimportant.Awordcapitalizedmaymeanonespecificthing, whilethesamewordwithoutcapitalizationmaymeansomethingentirelydifferent.Inthe caseofCitizenship(orcitizenship),thisismorecertainlytrue. ThereisacleardistinctionbetweennationalandStatecitizenship,U.S.citizenshipdoes notentitlecitizenoftheprivilegesandImmunitiesoftheCitizenoftheState.K.Tashirov. Jordan,256P545,affirmed49SCt47,278US123 Black'sLawDictionary,5thEdition,agreeswiththedistinctionbetweenthesedifferent classesof(C)itizenship:TherearetwoPrivilegesandImmunitiesClausesinthefederal ConstitutionandAmendments,thefirstbeingfoundinArt.IV,andthesecondinthe14th Amendment.Section1,secondsentence,clause1.TheprovisioninArt.IVstatesthat "TheCitizensofeachStateshallbeentitledtoallPrivilegesandImmunitiesofCitizensin theseveralStates,whilethe14thAmendmentprovidesthat"NoStateshallmakeor enforceanylawwhichshallabridgetheprivilegesorimmunitiesofcitizensoftheUnited States. Notethelackofcapitalizationinthewordingusedinthe14thAmendment,this specificallymeansthatthewords"citizens,privileges,immunities"arenotthesameasin ArticleIV.TheStateofCaliforniawasadmittedintotheUnionoftheUnitedStatesin 19499StatutesatLarge452.ItwasadmittedonanequalfootingwiththeoriginalStates inallrespectswhatsoever. TheStateofCaliforniawasrequiredtohaveitsownCitizens,whowerefirstState Citizens,thenasaconsequenceofStateCitizenshipwereAmericanCitizens,knownas CitizensoftheUnitedStates.Therewasnospecificclassasthis,butfortravelingand protectionbytheUnitedStatesgovernmentwhileoutofthecountry,theyweregenerally calledCitizensoftheUnitedStates. TheConstitutionfortheUnitedStatesofAmerica(1787)usedtheterm"Citizenofthe

UnitedStates"inArticleI,Section2,(capital"C"),andnumerousothersections.This referredtotheSovereignPoliticalBodyofStateCitizens,thisCitizenisentitledtoallthe PrivilegesandImmunitiesoftheCitizensoftheseveralStatesunderArticleIV. Congressutilizedthesameterm"citizenoftheUnitedStates"qualifyingitwithasmall "c"todistinguish"federalcitizen"inthesocalled14thAmendment.These"citizens" haveonlystatutoryrightsgrantedbyCongress. Thus,CongressandmostoftheJudiciary,withoutdistinctionbeingproperlybrought forthhavemaderulingsbaseduponthefederal"citizens"whoareresidentinaState,not StateCitizensdomiciledwithintheirownState. V.Canter,1Pet.511,whichalsodistinguishes"persons"and"Citizens."Thesewerethe personsthatweretheobjectofthe14thAmendment,togivetothisclassofnativeborn "persons"whowere"resident"intheunionoftheUnitedStatescitizenship,and authoritytoplaceotherthanthewhiteracewithinthespecialcategoryof"citizenofthe UnitedStates." ToovercomethestatementinDredScott,supra,thatonlywhitepeoplewereCitizens, andallotherpersonswereonly"residents"withoutcitizenshipoftheUnitedStates, CongressthenpassedtheCivilRightsActof1866,14STAT27. country: 1.PreambleCitizen:personsbornornaturalizedwithinthemeaningoftheOrganic ConstitutionandinhabitingoneoftheseveralRepublicsoftheUnitedStateswhoenjoy fullcitizenshipoftheOrganicConstitutionasCitizensoftheRepublicwhichtheyinhabit. 2.Citizen"subject":personsenfranchisedbythe14thAmendmentwhoarebornor naturalizedintheUnitedStateswithinthemeaningofthe14thAmendmentandare residingthereinasaUnitedStatescitizenandareenjoyingtheprivilegesandimmunities of"limited"citizenship. Whenoneseparatestheclassesamongtheirappropriatedividinglines,itappearsthat: 1.PreambleCitizens: a.HavedirectpersonalaccesstoaGodinspired,originalConstitutionandit'srestraints ongovernmentfortheprotectionoflife,libertyandproperty. b.HavedirectpersonalaccesstotheArticleIIIcourtsknownas"justicecourts"which dealwithlaw. 2.Citizen"subjects": a.Haverepresentativeaccesstothefirsteightamendmentsaspurviewedbythe14th Amendment.b.HaverepresentativeaccesstoArticle1courts,providedbylegislature, thatareknownas"legislativecourts"whichdealwithstatutesandareservedbybar members,orofficersofthecourt,knownaslawyers. Myconcernhere,stemsfrommyobservationthatfolksinvolvedwiththepreservationof ourbelovedConstitutionareunawareofthe"limited"citizenshipcreatedbythe14th Amendment.Additionally,thesefolksdon'trealizethattheyare,orhavevoluntarily become,citizensubjectsbecauseoftheiracceptanceofthe"benefits"oflimited citizenship. Themain"benefit"thatIwillmentionhereisSocialSecurity.Therearemanyother "benefits"suchasthebenefitof"regulationbylicensing"thatgivecontrolofyour childrentotheStatebymakingthem"wardsoftheState"andsubjecttothe"regulation" ofthe"legislativecourts"bystatute,etc. Theintentionofthisarticleistopointouttheapparentdifferenceintheclassesof citizenshipandthedifferenceinthecourtsinservingtheseclasses. Ihavenoticedthat,inmanypublications,andalsopersonalconversations,people conveytheirfeelingsofalarmordespairinfindingthat"thecourt"or"government"isin violationoftheConstitutionwithoutrealizingthatthecourttheyareaddressingisa legislativecourtanddoesnothearcasesbasedonjustice,butrather,casesbasedonly onstatutelaw.

Therealityofthefollowingexampleofstatutelawisthatthestatutespecifiesaspeedlimit tobeheldat30m.p.h.Theonlyquestionthatcanbeentertainedbythecourtisthatof whethertheaccuseddidinfactgofasterthanthelimit.Thatisayesornoquestion.The accusedcannottrytotellthecourtthatitwasasixlanehighwayonacleardaywithno trafficinsightandthathisspeedof60m.p.h.didnotinjureanyone. Thecourtisnotobligatedtohearthatargumentasitisnotajusticecourt.Thefinal questionthenwouldseemtobe"whereisthearticleIII"justice"courtandwhocanuseit? Iamveryawarethatmanyofthefolksreadingthisarticlearenotgoingtobeabletouse thejusticecourts,astheyhavenaturaloracquireddeficienciesthatwillnotallowthem PreambleCitizenship,butforthepeopleendowedwiththeproperqualifications,it appearsthatthestraightlineapproachofbarringjurisdictionoflegislativecourts (tribunals)throughrecisionofcontractsanddeclarationofArticle IV,Section2statusisessential,asitappearsthatonlyPreamblePeoplecanexercisethe officesassetforthintheOrganicConstitution.Additionally,itseemsthatthissameclass (PreamblePeople)istheonlyclassthatmayclaimtheprotectionofthefirstten Amendmentsaswritten. Asthetruthofourpersonalstatus,andtheresponsibilitiesconnectedtherewithunfolds, itbecomesclearthattheArticleIII"justice"courtmustbeaccessedindividuallybythe personclaimingtheright.Atpresentitisbeingdonebycommonlawfilingofactions"in law"withtheCountyRecorderswhohavebeenfoundtobe"exofficio"clerksofthe Countycourts.Theauthorityfortheexerciseofthe"justice"officeisfoundinthe9th ArticleofAmendmentandIbelieveallStateConstitutionshavesimilarprovisionsforthe PreambleCitizens(alsoknownasdejureCitizens). Iwillnotgofartherwithanattempttowardinstructionbutwillleavethisinthehandsofthe manypatriotsengagedintheresearchofthesedevelopments.Mymissioninpresenting thisinformationinageneralsenseistohelptheunfortunateindividualswhorepeatedly bashthemselvesagainsttherocksofmisinformationorignoranceinvain,though laudable,efforttoprotectourbelovedConstitution.IhopeIhaveachievedthisend." itwassoimportantfortheshadowgovernmenttocomandeerpubliceducationin 1978bycreatingtheFederalDepartmentofSocialistEducationandmakingita cabinet?Bettertoteachcondomsand"alternativelifestyles"tochildren,provide freeabortioncounselingandeliminateallteachingofthehistoryofthiscountry thantoallowthecitizenrytodiscoverhowthey'vebeenhoodwinked.Getthe populationhookedonpornography,drugs,sportsandcreditcardsandwhala!A greedy,selfishandapatheticpeople,justripeforthepickins. The14thAmendmentwasneverproperlyratified.Aswiththe16thand17th Amendments,itisalawthatdoesnotexist.Therefore,IamaPreambleCitizen oftheRepublicofCalifornia.Unfortunatelythatdoesn'tmeansquattothis governmentorourjudicialsystem.Theoneandonlywaytoreintheminand rectifythismessistoshoutdowntherooftopsaboutthenonratificationof thesethreecriticalnewworldorderamendmentsanddemandthattheU.S. CongresscomecleanwiththeAmericanpeople. Yes,itisamessbeyondanyproportionbutournationcannotcontinuetosurvive ontheselies.Thepeopleofthisnationstillholdthepoweriftheywouldjustfind thecouragetoexerciseit. Thatisthebottomlineandthatistheonlycure.Ifwehavetotaketothestreets bythetensofthousands,thenwemustdoit.Wesimplycan'tgoonwiththe government'smediacomplexandthesepoliticians,mostofthemtoostupidto understandwhatwaswrittenabove,lyingtoournation.
