Sessions Court, Mumbai awarded life imprisonment to all six accused convicted in the murder case of matka-king Suresh Bhagat. Among the accused are Bhagat's wife and son. According to the prosecution, the motive behind the murder was Bhagat's wife Jaya and son Hitesh's intention to usurp his property and take over his multi-crore gambling business.

Bhagat, along with five others, was killed, in pursuance to a conspiracy, on Alibaug-Pen road on June 13, 2008, when a truck collided with his Scorpio. Later, police found that the accident had been orchestrated by his wife and others, for taking over the matka business, and they had hired Suhas Roge to do the job. Mumbai Crime Branch arrested Suhas Roge, Harish Mandvekar, Kiran Amle, Shaikh Azimuddin, Pravin Shetty, Jaya Bhagat, Hitesh Bhagat and Kiran Pujari; however Pujari and Azimuddin were granted pardon as they turned approver. The rest were convicted. The prosecution had argued that the accused should be given capital punishment as the case falls under 'rarest of the rare' category. However, the Court observed that though six innocent persons were killed in the orchestrated accident (apart from Bhagat), it was not a rarest of the rare case and "life imprisonment would meet the ends of the justice". Although the conspiracy aimed at eliminating only Bhagat, the intention of killing the co-passengers must be attributed to the accused, the court said

Tushar Shah, P.W.32 Vinod Kalyanji Bhagat, who is the brother of

deceased Suresh Bhagat and P.W.45 Ashok Habu Kamble, who is the

father of deceased Kamlesh Kamble. P.W.17 Varsha Tushar Shah

deposed that she married Tushar Shah on 16/12/2007 and residing at

Worli with her in-laws. Her husband was businessman. Deceased

Suresh Bhagat was maternal uncle of her deceased husband. On the

day of the incident i.e. on 13/6/2008, matter was fixed for hearing in

Alibaug Court. She received phone call from the servant of Suresh

Bhagat and informed that Tushar is serious and informed about the

accident. On 14/6/2008, dead body of Tushar was brought to the home

and she also learnt that Suresh Bhagat was also no more. Two

months prior to the incident, her husband was under tension and

used to remain serious. When she asked, he stated her on a condition

not to disclose anybody that he is getting threats on phone call from

Suhas Roge, Jaya Chheda, Kiran Pujari, Chintu @ Hitesh Bhagat

and Arun Gawali, to leave the company of Suresh Bhagat. Her

husband also informed that Suhas Roge and Kiran Pujari threatened

him on the point of pistol (“pistol sar pe laga diya tha”) to leave the

company of Suresh Bhagat, otherwise he will be eliminated . Her

husband  also  informed  that  Suresh  Bhagat  already  filed  the

complaint to the police.
