The general framework for the prohibition of racial discrimination in Austria is provided by its
obligations under international human rights law, in particular the ECHR, the ICCPR, the
ICESCR and ICERD. A Federal Constitutional Act implementing the International Convention
on the Elimination of All Forms of Racial Discrimination was adopted in 1973.47

This Act

specifically prohibits any form of discrimination on the grounds of race, colour, descent, or
national or ethnic origin in Austrian law and in the policies and practices of its public
authorities. More concrete protection against racial discrimination is provided by the 2004
Equal Treatment Act, which creates a right, enforceable in the courts, to non-discrimination
on the grounds of ethnic origin and religious belief in the areas of employment and the
access to goods and services, including housing and education, in both the private and the
public sectors.48
