Dear Property Owner: Please be advised that it has been brought to the Borough of Roselle Park’s attention that the current use of the above-referenced property is in violation of your September 28, 2012, waiver of site plan review for a change of tenancy, which was approved on September 28, 2012. Specifically, you submitted a waiver on or about September 26, 2012 in order to use your property for Health and Nutritional Counseling Services (NAICS 621399), which is a permitted use in the zone where the property is located. However, it has been brought to the Borough of Roselle Park’s attention that you are currently conducting fitness classes, i.e. Zumba Classes, in the premises. As you are aware, fitness classes are not a permitted use in your zone and were not permitted by the waiver. Kindly take this notice as an official cease and desist of all fitness activities at the above-referenced property. Kindly be advised, that you have the right to apply for a subsequent waiver or make an application before the Roselle Park Municipal Land Use Board to obtain relief and conduct your fitness classes. An application may be obtained at the Construction Department at Borough Hall, located at 110 East Westfield Avenue, Roselle Park, New Jersey. If you do not cease and desist the current activities without obtaining a revised waiver or a variance from the Municipal Land use Board, you may be subject to a summons from the Deputy Code Enforcement Officer for violating the zoning requirements.
