DYNAMIC MEDICAL SERVICES, INC., Defendant. ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) )
MOTION FOR STAY OF PROCEEDINGS IN LIGHT OF LAPSE OF APPROPRIATIONS The U.S. Equal Employment Opportunity Commission (“EEOC” or “Commission”) hereby submits this motion for stay of proceedings in the above-captioned case: 1.

At the end of the day on September 30, 2013, the appropriations act that had been funding the EEOC expired and appropriations to the EEOC lapsed. EEOC does not know when funds will be restored by Congress. 2.

Absent an appropriation, EEOC attorneys are prohibited from working except in very limited circumstances. 3.

Undersigned counsel for EEOC requests a stay of proceedings until appropriations are restored to EEOC.

2 4.

If this motion for stay is granted, undersigned counsel will notify the Court as soon as Congress has appropriated funds for EEOC and may, at that time, request extensions commensurate with duration of the lapse of appropriations. 5.

EEOC conferred with opposing counsel for Defendant Dynamic Medical Services, who stated that Defendant does not oppose this motion. Therefore, although we greatly regret any disruption caused to the Court and the other litigants, the EEOC hereby moves for a stay of proceedings in this case until EEOC attorneys are  permitted to resume this usual civil litigation functions.
