ORDER OF DISMISSAL

Counsel for respondent has advised the Board that the parties have agreed to dismiss the
appeal without prejudice in order to perform an audit of appellant's contract. Accordingly, the
appeal is dismissed without prejudice. However, if the parties fail to settle their dispute, the
contracting officer shall issue a new final decision pursuant to the terms of the Contract Disputes
Act of 1978 from which a new appeal can be taken within the time limits of the Act if appellant
considers itself aggrieved thereby.
