ORDER OF DISMISSAL WITHOUT PREJUDICE

Appellant Cedar Cliff Systems Corporation has filed a motion on August 1, 1994, to dismiss the
instant appeal without prejudice, subject to a condition upon the satisfaction of which the dismissal
will become final with prejudice. The parties have agreed that the satisfaction of the condition will
occur when Appellant notifies this Board that the delegation of procurement authority for the contract
in issue in this case has been modified in accordance with the settlement agreement dated July 28,
1994, between Appellant and the U.S. Department of Labor (DOL), and the General Services
Administration has notified DOL, and DOL has notified Appellant, that such modification is
effective. Upon notice to this Board in writing that the condition has been thus fulfilled, the dismissal
shall convert, ipso facto, to a dismissal of the appeal with prejudice.
