Solon moves to expand scope of acts constituting sexual harassment
A lawmaker is urging Congress to expand the scope of acts constituting sexual harassment by including offenses committed through modern electronic devices. Rep. Rolando Andaya, Jr. ( st !istrict, Camarines "ur# filed $ouse %ill & '(, which seeks to amend Republic Act )o. *+** or the ,"exual $arassment Act of --../ 0nder the Andaya bill, sexual harassment shall include acts that are physical or verbal in nature1 acts committed using electronic devices or any available technology or means and acts that have been perpetrated either within or outside the place of employment, training or education. 2t shall also include offensive remarks about a person3s sexual orientation. 4he bill was referred to the $ouse Committee on Revision of 5aws chaired by Rep. 6arilyn 7rimicias8Agabas (9th !istrict, 7angasinan#. As proposed, ,sexual harassment is committed when the act or series of acts are unwanted, improper or offensive1 if the victim3s refusal or acceptance or the behaviour influences decisions concerning the victim3s employment, education or apprenticeship1 or when the conduct creates an intimidating, hostile or humiliating working, learning or training environment for the recipient./ ,4hrough this measure, a harasser is no longer confined to :ust being someone who has authority or moral ascendancy over the victim but anyone, including a colleague or subordinate staff, who makes gestures which are sexual in nature and create an intimidating, hostile or humiliating working, learning or training environment for the recipient of said unwelcome gestures,/ Andaya explained. $% & '( also provides that ,any person who directs or induces another to commit any act of sexual harassment as herein defined, or who cooperates in the commission thereof by another without which it would not have been committed, shall also be held liable under this Act./ 2t shall be the duty of the employer or head of office in a work8related education or training environment to, among others, ,adopt a comprehensive and detailed written policy on sexual harassment, rules and regulations prescribing guidelines or proper decorum in consultation with and :ointly approved by the employees or students or trainees or through their duly designated representatives, prescribing the procedure for the investigation of sexual harassment cases and the administrative sanction therefor./ (&;# dpt
