175602 By PJ Facts: PO2 Eduardo Valdez and Edwin Valdez were tried were tried and convicted for three counts of murder in the Regional Trial Court. The Court of Appeals upheld the conviction with some modifications as to the civil indemnity. Both of them appealed before the Supreme Court but Edwin Valdez withdrew from the appeal. The Supreme Court downgraded the Appellate Court’s ruling finding PO2 Eduardo Valdez guilty of three counts of homicide, instead of three counts of murder. Subsequently, Edwin the co-accused filed through the Supreme Court Administrator Midas Marquez, an application of the judgment in favor of the accused, Eduardo Valdez insofar as it shall be favorable to Edwin. Issue: Should Edwin be barred from the application of the crimes committed and the resultant lighter penalties because of the finality of his convictions for the three counts of murder due to the withdrawal of his appeal? Held: No. Edwin’s plea of the downgrading of his crimes is to be granted. Section 11(a) of Rule 22, Rules of Court provides that “an appeal taken by one or more of several accused shall not affect those who did not appeal, except insofar as the judgment of the appellate court is favorable and applicable to the latter.” The two accused have acted in concert in their deadly assault against the victims, warranting their equal liability under the principle of conspiracy. The law provides that an appeal taken by one or more of several accused affects those who did not appeal “insofar as the benefit of lessened criminal liabilities is contrary to law and is highly unfair.
