We are writing to you with deep concernover an improper chargeagainstU.S.


Border Patrol agentsIgnacioRamosand JoseAlonso Compean.

Border Patrol agentsRamosand Compeanwere convictedof violating 18 V.S.C.


§924(c). This statutemakesit a crime to carry or usea firearm during commissionof a
violent or drug trafficking crime. Violations of the statutecarry a mandatorysentenceof
no lessthan 10 years. Currently,this is the only chargefacing both Ramosand Compean
requiring mandatoryprison time not to be servedconcurrently.

Yesterday,a motion to delay sentencingfor Ramos and Compeanwas denied.


Sentencingis now scheduledfor Thursday,October 19th.We urge you to take any action
you can to either delay this sentencingor have the 18 U.S.C. §924(c) chargesdropped.
This statutehas historically beenused in violent crime and drug trafficking cases.It has
also been applied to law enforcement when necessary,however, based on past
applicationsof §924(c)to law enforcement,it appearsthat its applicationin the present
caseis unwarranted.

When §924(c) is applied to law enforcementofficers, it is in the context of


heinous crimes, such as sexual assaults,which are clearly outside the realm of official
duties. The application of §924(c) in this case is overly broad, setting a dangerous
precedentof applicationto law enforcementofficers trying to act within the scopeof their
official duties.

We strongly urge you to use any authority you have to overturn the unnecessary
andoverzealous§924(c) conviction againsttheseBorderPatrol agents.
