Enclosed please find the Final Order of License Revocation received from the
Department of Highway Safety and Motor Vehicles. Unfortunately, I was not successful
in getting the administrative suspension set aside. What this means in that you have a
thirty (30) day hard suspension from August 1, 2007 to August 30, 2007. You may not
lega"y drive for any reason during that period. Thereafter, if you present proof of
enrollment in DUI School, you can petition for a hardship license at the DMV hearings
office at 2814 E. Hillsborough Avenue, Tampa which will allow you to drive for work
purposes and other driving essential for life.
You will have the administrative suspension in effect from May 11,2007 to
November 11, 2007. This suspension is not affected by the criminal case. Since you
must complete DUI school to get your license back regardless of what happens with the
DUI in criminal court, I suggest you enroll immediately. That information can be
obtained through their website at www.duicounterattack.org.
Your next court date is August 22,2007 at 9:00 am in Courtroom 8 at 800 E.
Kennedy Blvd., Tampa, Florida 33602. If we are going to resolve your case at that time,
then you should be present. If you have not completed DUI School at that time, then we
should continue your case for another month to have that completed.

14 Statement of Case
15 The Department of Highway Safety and Motor Vehicles suspended the driving
16 privilege of Linda Hart Flax after it received documents from Officer J. Vallejo of the Tampa
17 Police Department. These documents asserted that there was probable cause to believe that
18 Petitioner was driving or in actual physical control of a motor vehicle in this state while under
19 the jnfluence of alcoholic beverages or chemic:ll or controlled gubst3l1ces, and that Petitioner
20 submitted to a chemical test ofher_breathlblood, the results of which indicated an unlawful
21 breath!blood alcohol level of .08 or higher.
22 The hearing was held as noticed on 07/20/07, 10:00 A.M., at 2814 East Hillsborough Avenue,
23 Tampa Florida 33610-4479.
24 Hearing Officer Eva Peterson conducted the hearing.

14 Pursuant to section 322.2615 of the Florida Statutes, the scope of the hearing is limited
15 to whether the law enforcement officer had probable cause to believe that Petitioner was
16 driving or in actual physical control of a motor vehicle in this state while under the influence
17 of alcoholic beverages or chemical or controlled substances and whether Petitioner had an
18 unlawful blood-alcohol1evel or breath-alcohol level of 0.08 or higher as provided in s.
19 316.193.

21 Findings Of Fact
22 I find that the following facts are supported by a preponderance of the evidence:
23 On 05111107 Officer J Vallejo of the Tampa Police Department made contact with the driver
24 of a motor vehicle, who was identified as Linda Hart Flax by her Florida's driver's license.

FEE AGREEMENT FOR LEGAL REPRESENTATION .
1. I, LINDA HART FLAX, hereinafter "CLIENT', do hereby employ and engage LORI D.
PALMIERI, P.A., hereinafter "ATTORNEY", to represent me on the following charge or charges:

2. ATTORNEY'S FEES: I agree to pay a flat, NON-REFUNDABLE, reasonable minimum
fee for the representation of $2,500.00 . Receipt of $1250.00 is hereby acknowledged. The
balance of $1250.00 is due by June 16, 2007 ($625.00) and July 16, 2007 ($625.00).
Upon the happening of the following event{s), additional, non-refundable attorney's fee and cost
retainers in the amounts set forth below shall be due as follows:
a. CLIENT understands that in the event that CLIENT desires to proceed to trial, an
additional attorney's fee of $ (to be negotiated) will become immediately due upon setting the
case for trial by the court. In the event the trial results in a mistrial or hung jury or any other
circumstances making a new trial necessary, CLIENT agrees that an additional trial fee will
immediately become due for each additional trial.
3. EXPENSES: The ATTORNEY is authorized to payor incur liability for all expenses such
as long distance phone calls, photocopies, travel expenses, court reporters (including
transcripts), subpoenas, witness fees, expert fees, private' investigator fees, computer research
access time and other expenses the ATTORNEY deems necessary in the preparation of and/or
trial of my case. CLIENT is to pay for all such expenses. In certain cases, a cost retainer will
be required and held in trust prior to expenses being incurred by ATTORNEY on behalf of
CLIENT.
4. PAYMENTS: I understand that I may be billed periodically, both as to fees and costs,
and agree to pay same upon receipt. I also understand that any unpaid bill will incur interest at
the rate of 1 -1/2% per month (18% per annum). If I fail to fulfill my obligations under this
contract and it is necessary for the ATTORNEY to bring suit to collect the bill, I will be liable for
attorney's fees and costs connected with that action.
5. ASSIGNMENTS: To the extent of any fees and costs due to the ATTORNEY pursuant
to this agreement, CLIENT hereby assigns to the ATTORNEY, any unexpended trust monies on
deposit with the firm, arising out of the subject matter of this representation. The CLIENT also
specifically authorizes and empowers the A TIORNEY to receive said funds to pay herself, all
said funds before it releases the balance to the CLIENT.
6. TERMS OF REPRESENTATION: I understand that my representation for the above
charge{s} is through final disposition, or trial by judge or jury, and does not include
representation on post-trial motions for new trial, etc., or for appeal that may be taken from any
verdict, judgment or order. This representation does not include violation of probation charges

occurring subsequent to this representation. I authorize the ATTORNEY to waive my right to
speedy trial on my behalf at her discretion.
7. WITHDRAWAL: I agree that the ATTORNEY shall have the right to withdraw from my
case if I fail to make payments required by this contract, if I have misrepresented or failed to
disclose material facts, or if I fail to follow my attorney's advice. In any of these events, I will
execute such documents as will permit the ATTORNEY'S immediate withdrawal.
8. NO DISCUSSION: CLIENT shall not discuss the subject matter of the cause described
in Paragraph 1 above with anyone other than ATTORNEY without Attorney's express
permission. Client shall: (1) follow the advice and direct instructions of Attorney; (2) cooperate
fully with Attorney in the handling of the cause; (3) act in con'nection with said cause only
through Attorney; and (4) avoid all acts that are illegal, immoral or unethical that might
jeopardize said cause.
9. CLIENT'S ADDRESS NOTIFICATION: I hereby agree to keep the ATTORNEY, at all
times, informed of my business and residential addresses and my business and residential
and/or cellular telephone numbers. Failure to disclose my present location and contact
information to ATTORNEY will be cause for immediate withdrawal by ATTORNEY.
10. CO-COUNSEL: CLIENT agrees that associate counsel may be employed at the
discretion and expense of ATTORNEY and that any attorney so employed may be designated
to appear on my behalf or undertake my representation in this matter.
11. REPRESENTATION AND RECEIPT: I acknowledge that the ATTORNEY has made no
representations or guarantees concerning the outcome of this case and that I have received a
copy of this agreement. Further, I enter into this written agreement freely and voluntarily with a
full understanding of its contents.
12. LIMITED SCOPE OF REPRESENTATION: This representation contract is for the
negotiated representation only. This is limited to demand and review of discovery, conference
with client and discussion of same, negotiations with the State Attorney or United States
Attorney, attendance at pre-trial conference(s) through final settlement of case, whether by
dismissal, plea or trial.

I responded to the scene at the request of Officer Owen. I met with the
defendant, who was standing near her vehicle. The distinct odor of an
alcoholic beverage was observed on the defendant's breath. The defendant's
eyes were bloodshot/ glassy and the speech was slurred. The defendant had
an unsteady appearance that was consistent with that of an impaired person.
Field sobriety tests were administered. The defendant exhibited clues of
impairment. The defendant agreed to submit to chemical tests. See video
and/or alcohol attachment for details. The defendant was transported to CBT
where breath-alcohol tests resulted in a brac .278/.277. The defendant's
vehicle was released to her husband who was present on the scene.

I hope this finds you doing well and enjoying the New Year. I am (thankfully) approaching the
end of my hardship license, probation and other consequences resulting from my DUI that
occurred on May 11, 2007.
I received this notification from the State of Florida in October and I believe I sent it to your
attention. We had some family issues, including the illness and death of Steven's father during
October through December and I wanted to be sure to follow up with you on these notifications.
As you know, on September 6,2007, we went to court and you were successful in having the
State stipulate that the B.A.C. was less than a .20, and did not require an ignition interlock
device. Note: I have attached the letter that you sent to me on September 6, 2007 for your
reVIew.
I received 2 (two) orders from the State of Florida, Division of Drivers Licenses.
1. Dated September 27,2007, indicates that my license is revoked for a period of 180 days
and that prior to the issuance of a permanent license, I prior to the issuance of a
permanent license, I may be required to have an ignition interlock device installed.
2. Dated September 27, 2007, indicates that my license is cancelled for an indefinite period
of time and that in order to reinstate, I must have the device installed for a period of 6
months.
I did go, as you instructed, and had a hearing on September 6, 2007 and received a hardship
license (business purposes only) for a period of 180 days. That hardship restriction will be
completed on March 4,2008 and the hearing officer indicated that on March 5,2008, I could go
to a DMV office and receive an unrestricted license.
I have completed all but my community service hours, which I will complete by March 1, 2008
and have completed all other requirements.
Can you please verifY that the reinstatement of my license on March 5, 2008 is NOT contingent
upon the interlock device, which is what the Court indicated?

*Registration Hours*
1. Enrollees must register for DUI school in the county where they live, work, or attend school, unless
an exception has been granted. Enrollment may be done in person at DUI Counterattack, on the
Internet, or via mail-in registration. The client will be requested to present proof of positive
identification (a picture 10 is required such as a Driver License, Florida 10 Card, work 10 or Military
ID). A readable copy of the DUI arrest affidavit or traffic crash report, and a current official DHSMV
full driving record (must be dated within 30 days) is needed to complete registration. The arrest
affidavit and driving record are available from the Clerk of the Circuit/County Court. If available, it
may be necessary to produce the arrest citation and the blood or urine test results.
2. The registration fee is $205.00 for first offenders (Level I) or $310.00 for multiple offenders (Level
II). The fees include the $12.00 state assessment fee and a $5.00 testing fee. The registration fee
must be paid in cash, money order, certified check, Visa, MasterCard or debit card. Debit card
payments available at North Hubert office only. Personal checks are not accepted. Please allow at
least 45 minutes for registration.
3. The DUI program consists of classes conducted by a certified Instructor and an evaluation
appointment with a certified Evaluator. Class schedules are assigned when fees are paid in full.
Weekend, evening and daytime classes are available. Classroom locations are available in Tampa,
Plant City, and Brandon. The Level I program comprises the evaluation appointment and a twelve
(12) hour course of instruction. The Level II program comprises the evaluation appointment and a
twenty-one (21) hour course of instruction. The evaluation appOintment is approximately one hour.
Appointments are assigned at the time of registration. Daytime and evening evaluation
appOintments are available.
4. Students must appear free of alcohol or other drugs for registration, class, and evaluation
sessions. Appropriate behavior and attire are required at all times. Violation of this policy shall
result in dismissal from registration, the evaluation or class. Students who are dismissed for a policy
violation shall be reported to the court, DHSMV and the probation department.

Florida law requires that anyone requesting a hearing for possible early reinstatement of a suspended or revoked driving privilege, prior to the
expiration of the suspension or revocation period must enroll in the appropriate Driver Improvement or Alcohol Education course. However.
if a person is convicted of DUI and applies for early reinstatement, they must show proof of DUI School Completion. Habitual Traffic
Offenders must also show proof of school completion.
